In the event mat such approval is. necessary, tile holder of this permit shall not commence operations.here- under until such approval has been obtainediiS'w¢ t rig. The failure to obtain such other approval when reoutred shall suoject this permit to immediate revocation by the Trustees upoh receipt by the Trustee~- of written notice from such other governmental or municipal authorities of'its refusal or disapproval. The applicant does by the acceotance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to Demons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and emoloyees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this permit are being conducted, do, by the acceptance of this permit, give consent to the Town. and its officers and employees to enter upon the premises where such ol:erations are being conoucted to make such inspections as the Town may deem necessar¢ to insure that such operations are being con- ducted in conformity with this permit. This operation witl not substantially: A. Adversely affect the wetlands of the town, B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aouatic wildlife and vege- tation or the natural habitat thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. Otherwise adversely affect the health, safety and general welfare of the people of the town. New York 11971 September 25, 1987 Mr. Joseph Marrapodi 4115 Stillwater Ave. Cutchogue, New York 11935 Re: Application No. 397 Dear Mr. Marrapodi: The following action was taken by the Board of Town Trustees during their regular meeting held on September 24, 1987 regarding the above matter. WHEREAS, Joseph Marrapodi applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated April 25, 1986, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with ~espect to said application on September 24, 1987 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Joseph Marrapodi BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF ]~HE TOWN OF SOUTHOLD TO: Construct a retaining wall and steps, to backfill and to construct dry welts to contain roof run off on property located at 4115 Stillwater Avenue, Cutchogue. Joseph Marrapodi - Page 2. This permit will expire on September 24, 198~ if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurar~ce policies ~nsuring against any liability which may arise in the performance of the operations pursuant To such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. Please take further notice thai this declaration should not be considered a determination made for any other depar~men~ or agency which may also have an application pending for the same or similar project. PLEASE RETURN TO THE BUILDING DEPT. FOR A DETERMINATION ON THE NEED OF ANY OTHER TOWN PERMITS THAT MAY BE REQUIRED FOR THIS PROJECT. The Trustees have found that the Highway Dept. has installed a drain in the road in addition to installing a small berm in the road to alleviate any road run off° The Board of Trustees stands on the determination that was adopted by resolution during their meeting held on June 26, 1986 declaring that this project would have a significant effect to the environment should this project be implemented as planned. WHEREAS, Joseph Marrapodi has heretofore applied to the Southold ~own Trustees, pursuant no Chapter 44 of the Code of the Town of Southold for permission to construct a retaining wall with sneps and to back- fill on propert~ located at 4115 Stillwater Avenue, Cutchogue, NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: i. Pursuant to the provisions of Article 8 of the Environmental Conservation Law; Part 617 of Title 6 of the New York State Code, the Southold Town Trsutees, as lead. agency does hereby determine that the action proposed is a Type 1 Action and is likely to have a significant effect on the environment. 2. That the clerk to the Trustees shall file and circulate such determination as required by the aforementioned law, rules and code. 3. That the Clerk to the Trustees shall immediately notify the applicant to perpare a Draft Environmental Impact Statement all in accordance with said law, rules and code.
