No. 4779- David and Ann Coded 1000-123-7-9.2 STREET&LOCALITY: 412 Park Avenue, Mattituck DATE OF PUBLIC HEARING: January 13, 2000; February 3, 2000; March 2, 2000 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property comprises 57,115 sq. ft. in the R=40 Residential Zone District with 171 feet on Peconic Bay on the south and depths of approximately 325 feet on the west and 348 feet on the east. The property consists of part of Lot Nos. 7, 6 and 8 on the Map of Marratooka Park filed on November 1, 1905 as Map#450. It is reached by a right- of-way from ParrAvenue, which right-of-way continues over the easterly 25 feet of.the property all the way to Peconic Bay. An updated September 13 1999 survey by Joseph Ingegno shows a house with the following approximately setbacks at the closest points: 84 feet from the lower (outer) bulkhead, 36 feet from the westerly property line, 32 feet from the right-of-way along the east side, and 180 feet from the northerly property line. Two accessory buildings are located in the front yard along the west side of the property BASIS OF APPLICATION: Building Inspector's November 8, 1999 Notice of Disapproval, denying a building permit application for a 20 ft. by 40 ft. in-ground swimming pool, for the reasons that under Section 100-33 (ref. 100-30A.4 for R-40 Zone) requires that accessory buildings and structures or other accessory uses be located in the rear yard. AREA VARIANCE RELIEF REQUESTED: Applicants originally requested authorization to locate the pool in the side yard, 12 feet from the westerly property line. Following the first hearing, applicants submitted a February 3, 2000 revised plan for a narrower pool, with construction at 16 feet at,its closest point from the westerly property line. REASONS FOR BOARD ACTION DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicants state that it is impractical to locate the pool in either the rear yard or front yard. The newly built deck facing the rear yard and Peconic Bay measures, at the closest points, 84 feet from the lower bulkhead and only 52 feet from the top of the bluff. This is too shallow to accommodate the 75-foot setback from the bulkhead required by Code Section 109-239.48. Applicants state that it is impractical to locate the pool structure in the front yard because of the need to relocate the driveway and to destroy trees. Applicants further state that the pool must be in the side yard for reasons of child safety. (2) Applicants' revised February 3, 2000 plan will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties because it places the pool about as far from the westerly property line as is feasible. LWRP DETERMINATION: A Letter confirming inconsistency was submitted to the Board of Appeals under Chapter 95, Waterfront Consistency Review of the Town of Southold Code and Local Waterfront Revitalization Program (LWRP) standards. A site inspection by the Board of Appeals found that the applicant's bulkhead has been recently reconstructed and is in excellent condition, the bluff is vegetated and stable, and the applicant's property is flat and does not slope toward the bluff. The Board finds that these conditions are sufficient to bring the application into conformity with the intent of the LWRP. Neither the enclosed porch nor deck is closer to the bulkhead than the original dwelling. The house originally contained an attached screened porch with roof and the owner merely replaced the screens with windows, added heat and a bay window in 1971. The appearance remains the same. The deck was added in the westerly side yard more than 20 years ago and is located only one foot shy of the required 15 ft. side yard setback in one corner. The west side of the property is well buffered by a neighborhood right-of-way path to the beach and is very heavily landscaped with mature evergreens. 2. Town Law &267-b(3)N(2). The benefit sought, by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The porch is where it was originally built pursuant to a building permit and the cost to the applicant to remove one foot of decking seems excessive given the substantial existing landscape buffer and right-of-way. 3. Town Law &267-b(3)(b)(3). The variance granted herein is not substantial. Both structures are located at the same distance from the bulkhead as the original house and the setbacks appear to be in line with the residence to the east. The deck requires only a 1' variance and although the bay window does extend slightly closer to the bulkhead than the original porch, it is above ground and without foundation and is no closer to the bulkhead than the original roof overhang. 4. Town Law 4267-b(3) b( )(5). The difficulty has been self-created. 5. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The structures are behind a new bulkhead and do not create any increase in flooding or erosion danger to the subject property or neighbors. See LWRP Determination above. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a deck and enclosed heated porch, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
