SCTM#1000-74- 1-35.56 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as for away from coastal hazard areas as practical. a. No development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRR 505.8. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. The proposed action is not a water dependent use and the "new deck" is located 15'to the CEHA line. The bluff is actively eroding resulting in recession of feature. The future loss to property or life due to the threat of erosion is high. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas maybe warranted for: a. structures which functionally require a location on the coast or in coastal waters. The proposed single family residential use does not require a location on the coast. The parcel has ample depth to relocate the structures to meet regulatory setbacks from the protected natural features. b. water-dependent uses which cannot avoid exposure to hazards. The proposed use is not water dependent. Policy 6.3 Protect and restore tidal and freshwater wetlands. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided: 1. Maintain buffers to achieve a high filtration efficiency of surface runoff. 2. Avoid permanent or unnecessary disturbance within buffer areas. 3. Maintain existing indigenous vegetation within buffer areas A vegetated buffer is not proposed. In the event that the action is approved, the establishment of a non-disturbed buffer is recommended landward of the top-of bluff to the CEHA line. Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. A hazardous condition currently exists due to recent erosion of the bluff adjacent to the existing dwelling. In order to eliminate the hazard,the dwelling must be moved back from the edge of the bluff to a safe location. Due to the back-sloping topography of the site, strict application of the requirement for a 100'setback from the bluff would completely eliminate the views of Long Island that the dwelling enjoys.These views substantially underlie the propert/s economic value and their loss would impose a severe economic hardship on the owner. 3. The requested relief for a 40' setback is not substantial because it is similar to the setbacks of existing structures neighboring the subject property and would therefore be consistent with the existing pattern of development in the immediate area. The house immediately adjacent to the west has a setback of approximately 10 feet.A new house is being constructed immediately west of that with a setback of approximately 50'.The house immediately east of the subject has a setback of approximately 12 feet and the house immediately east of that has a setback of approximately 45 feet.
