Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the below listed LWRP polices and therefore INCONSISTENT with the LWRP: Policy 4.1. Minimize losses of human life and structures from flooding and erosion hazards. The applicant proposes to fill the property up to 4.3' over existing grade. The purpose is to accommodate the new sanitary system. There is a concern about storm water movement on the property post filling. The subject lot has an existing, 1-story residence with 2 bedrooms, aloft sleeping area and 1 bathroom on a block foundation with crawl space, attached wood patio with walkways, outdoor shower, shed and wood boardwalk/dock for boating access. Mrs. Bontje is proposing to construct a 2nd story over a portion of the one story structure on site and a 2 story addition to the north side of the house (away from the water). The 13 feet of the 1-story residence closest to the water will be removed entirely. This will include the addition of two (2) bedrooms for a total of four (4) bedrooms, the addition of two (2) bathrooms for a total of three (3) bathrooms. The plan will reconfigure the existing wood patio, walkways, outdoor shower, sanitary system (moving away from the water), shed and driveway. The addition will be constructed in similar fashion to the existing structure by utilizing a concrete foundation but with a first floor elevation set to accommodate FEMA 100 year flood elevations. As the side yard setback variance was for only one foot and a deck, the owner agreed to eliminate that variance requirement. Thus, we have submitted a site plan for the property re-development which shows a 10 foot westerly side yard (to the deck) and a 15 foot easterly side yard. We received a revised disapproval letter' for the two setbacks only so that we may proceed to the ZBA. Attached please find the ZBA application and the required attachments per, your checklist. The existing condition survey was prepared in December 2015 by Nathaniel Corwin, L.S. and the proposed reconstruction was designed by B. Laing Associates, Inc. and Eugene Kempe, P.E.
