SCTM#1000-70-10-29.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the actions are INCONSISTENT with the Policy Standards and therefore are INCONSISTENT with the LWRP. Policy 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The proposed pool and portions of the deck are located within the FEMA Flood Zone AE EI 6 and could be subject to flooding and associated damage. Policy 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. A Board of Trustees Wetland Permit (5421) was issued in 2000 that required a 50' wide, non-disturbance/non-fertilization buffer adjacent to the tidal wetland boundary (Figure 1). The submitted survey shows "edge of clearing" within the 50' non-disturbance/non-fertilization buffer area. Note that the wetland line differs from the 2000 approved survey and the September 2015 survey last revised April 29, 2016. This change would relocate the non-disturbed/non- fertilization 50' wide buffer. It is recommended that the 50' non-disturbance/non- fertilization buffer be added to the submitted survey to determine if any encroachments would occur.
