TERMS ;',nd C:ONDITIONS
The Perm[~:ee Constanfinos Markotsis
residing ac Williamsburg (private) off Main Bayview, Southold N. Y~
part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold am released from any
all damages, or claims for damages, of suits arising directly or indirectly as a result of any opee-
adon perfomaed pursuant to this permit, and the said Permittee will, at his or her own expeme,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liubility
with respect thereto, zo the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Pem~it is valid for a period of 24 mos. which is considered to be the
estimated time required m complete the work involved, bet should cixt'umsmnces war~,~mt, reques~
for an extension ma)' be nmde to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the strucutm or project involved, to provide evidence to anyone concerned thor anth-

4. That the work involved will he subject to the inspection and approval of the Board or
im agents, and oon-compliance with the provisions of the orlginating application, ma7 be ~,,~e for
r¢*ocafion of this Permit by re~olution of the said Board.
5. That there will be no unreasonable interference with navigation a~ a result of the work
herein authorized.
6. That there shall be no interference with the rigbt of the pubilc to pass and repas~ along
the beach between high and low water
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Tm,~:ees, tbe
work shall cause unreasonable obstrucnon to free navigation, the said Permirtee wilt be required,
upon due notice, to remove or alter this work or project herein stated without expemes to the Town
of Southold.
8. That the said Board will be notified by the Permittee ot the completion of the work auth-
oti~ed.
9. That the Permittee will obtainall other p~rmlr~ and consents that may be required ~
plemental to this permit which may be subjec~ to revoke upon failure to obr~;n same.

The following action was taken by the Board of Town Trustees during
its special meeting held on September 26, 1991:
RESOLVED that the Town Trustees approve the request for a waiver to
construct a covered deck on property located at Williamsburg Road,
Southold.
Please note that permits from otheragencies may be necessary, as the
Trustees approval does not constitute approvals from other agencies.

Dear Mr. Fitzgerald:
The following action was taken by the Board of Town Trustees during
its regular meeting held on March 22, 1990 regarding the above
matter:
W~EREAS, Proper-T Services in behalf of Constantinos Markotsis
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated December 20, 1989 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on March 22, 1990 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
-submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT Proper-T Services in behalf of Constantinos
Markotsis BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND
ORDINANCE TO:
To replace 90 1.f. of bulkhead with new bulkhead 18" in kind/in place
to seaward of old bulkhead; extend bulkhead 5' with a 10' return
directed away from the wetlands; relocate walkway, ramp, and floating
dock at new bulkhead; dredge area around floating dock to a depth
equal to the depth of the channel at the center of the canal.
This permit will expire two years from the date it is signed if work
has not commenced by said date. Fees must be paid, if applicable,
and permit issued within sixmonths of thedate of this
notification. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project~
Permit will be issued upon payment of the following fees for work to
be done below Mean High Water Mark:

Dear Fir. Fitzgerald:
Trustee Vice President Henry Smith has re-visited the site of
the proposed bulkhead replacement and maintenance dredging of
Constantinos Markotsis on Williamsburg Road. He has
determined that this project is maintenance dredging because of
former operations of Mr. Julius Zebrowski who formerly dredged
the basin to its existing depth back in the mid 50's.
