1. Final survey of property with accurate location of all buildings,property lines, streets,and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1%lead.
5. Commercial building, industrial building,multiple residences and similar buildings and installations,a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of,completed site plan requirements.
B. For existing buildings(prior to April 9, 1957)non-conforming uses,or buildings and "pre-existing" land uses:

§ 100-30 ZONING § 100-33
(a) Not more than one (1) such sale shall be con-
ducted on any lot in any one(1)calendar year.
(b) Adequate supervised parking facilities shall be
provided.
(c) No signs, except one (1) on-premises sign not
larger than three by four (3 x 4) feet in size,
displayed for a period of not longer than one (1)
week immediately prior to the day of such sale,

§ 100-31. Bulk, area and parking requirements.
No building or premises shall be used and no building or part
thereof shall be erected or altered in the A Residential and
Agricultural District unless the same conforms with the `Bulk
and Parking Schedule" incorporated into this chapter, by
reference, with the same force and effect as if such regulations
were set forth herein in full.
§ 100-32. Accessory buildings.
In the A Residential and Agricultural District, accessory
buildings and structures or other accessory uses may be located in
the required rear yard,subject to the following requirements:
- A. Such buildings shall not exceed eighteen(18)feet in height.
B. Such buildings shall be set back not less than three(3)feet
from any lot line.
C. All such buildings in the aggregate shall occupy not more
than forty percent (40%) of the area of the required rear
yard.

The property contains A house (built prior to zoning) awaiting
issuance of a pre-c.o, a garage converted to a pool house in 1973
(application #6895 renewed as #31695) , and swimming pool. The
existing structures including the bathroom, rec room, bar,
dressing rooms on west side of garage (former permit 4603Z) and 2
chimneys in the ceiling are specifically identified in the
building permit of September 25, 1973 and have a certificates of
occupancy (Z7487) . [See attached exhibit 21 . This building
permit was in the file with the C.O. It appears that building
permit #6895 was renewed and then combined into CO #7487. It was
common in the 70 ' s to combine building permits and wrap them into
one overall c.o.
HOUSE: an application for a pre-c.o was submitted in 2008, the
house passed inspection but a shed in the front yard had to be
relocated before Gary Fish would approve the pre-co.
The property has the following Certificate of Occupancy:
1. C.O. #Z18623 12/7/89 (BP#11343 8/19/81)Addition to existing
accessory greenhouse. This greenhouse behind the existing
building is no longer there.
2 . C.O. ##Z7487 1/25/77 (BP#6355 2/1/71)Accessory garage with
addition & greenhouse is discussed above (combined Building
Permit #46032 application dated 12/2/69 for original garage,
& application dated 1/24/73 & building permit ##6355. Also
in that file was Building permit #6895 application dated
9/25/73 . In this file was an "order to remedy" dated
January 21, 1977 which included permits #4603, 6355 & 6895
with a notation on January 25, 1977 that C.O issued. These
permits have the same drawings of the work proposed.

(Plan shows garage with 20 ' x 9 ' addition (now a changing
room-also shown on permit #6895) , connection and existing
extension there by 1972 .

Building- "new recreation room" and "new connection" to
existing garage
The garage was converted to a pool house in 1973 with application
#6895 (renewed as permit #31695 issued 12/28/05 because it was
believed to be an open permit) : the building permit application
made on September 25, 1973 describes proposed work as "shower
room-bathroom recreation room & bar, Dressing rooms on west side
of garage (expired former permit #4603Z) and 2 Chimneys in
ceiling" ; also plans on the back of the permit shows hot tub (and
former greenhouse permit #6355Z) . This building permit covers
all existing conditions. The certificate of occupancy in the
same file with this building permit and together with building
permit #6895 & #6355 appear to have all been wrapped up and
consolidated into the Z 7487 C.O. dated 1/25/77 . The building
department has been inspecting the pool house which already has a
C.O
Inspection by Gary Fish for Pre-c.o of house & alleged open
permits (which may not have been open) .
First inspection of House & Pool House. Could not get into house
(he did not notice an existing shed which came up on second
inspection) . . .building inspector said to reschedule house pre-co
inspection. The re-scheduled pre-co inspection done in March
2008: Gary passed the inspection of the house but (one item
raised) required an existing @100 sq.ft. shed located in the
"front yard" to be either removed or relocated. The shed was
relocated to the rear yard (@2008) .
January 2008 :
Contrary to what appears in the existing C.O files
above:
Believing that there were open permits Gary Fish inspected
the Pool House.
In January 2008 Open permits of the pool house from 1971,
client paid & renewed permits and given new numbers:
• #31694 Alterations to Pool House
Open Building Permits issued 31694 (replaced 16134)
alteration to roof of pool house- the roof does not appear
to have been altered but note in the building department
inspection file says "ready for c.o".
• #31696 1/16/70 Addition to existing detached garage
Building Permit #31696 issued 12/28/05 (replaced BP
#4603)
• #31695 connecting accessory building (replaces
permit##6895) building department requested
1. Electrical Inspection for #31695 & 31696
(done June 1, 2016)
2 . Plumber' s Certificate (regarding no lead solder) done
also: 2 wood burning stoves removed/disconnected. . .although
shown as proposed chimneys on building permit #6895 dated
September 25, 1973
Follow-up inspection:
Inspection on March 24/2016 below items requested.
"Final" Inspection made 5/10/16- ready for C.O:
On Pool House: Advised to add chimneys to plans (again already on
1971 building permit application.
1. Single wall flue for chimney too close to combustibles (not
compliant) so remove chimney & patch roof. Done before June
inspection.
2 . Immobilize with lock one side of double gate on pool fence.
Done before June inspection.
Gary Did not add it to his list but asked us to fix latches on
hot tub cover (done)
Please review C.O files carefully. The major work to the pool
house was done in 1971 and a c.o. issued by 1977 (after building
permit expired & renewed)This permit includes everything.
The building permit in 1971 allowed full bathrooms in pool
houses, the sanitary code was not adopted till 1981. . .the
bathrooms and sanitary pre-date HD regulations. Please confirm
the 1977 C.O. covers this work.

3. Approval of electrical installation from Board of Fire Underwriters.
4. Commercial buildings, Industrial buildings, Multiple Residences and similar buildings and installa-
tions, a certificate of Code compliance from the Architect or Engineer responsible for the building.
5. Submit Planning Board approval of completed site plan requirements where applicable.

a. This application must be completely filled in by typewriter or in ink and submitted in triplicate to the Building Inspector, with
3 sets of plans, accurate plot plan to scale. Fee according to schedule. `
b. Plot plan showing location of lot and of buildings on piemises, relationship to adjoining premises or public streets or areas, and
giving a detailed description of layout of property must be drawn on diagram which is part of this application.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Bulldind Permit to the applicant Such permit shall be kept on
the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy shall have been
granted by the Building Inspector.

We discussed your recommendations regarding closing out all the open building permits and the
pre-co. You have recommended alterations to the pool house as shown on the attached floor
plans (with my hand written notes from our conversation regarding removal of closet doors).
Also my client will remove the toilet and sink in the second shower room. We need confirmation
of our understanding before they begin removing these existing improvements and a final
inspection.
As to the sanitary system which serves the pool house. The pool house was built in 1973 and
altered between 1973 and 1977. No work appears to have been done to the pool house after
1977. The Health Department sanitary code was adopted 11/19/80 and the Health
Department uses 1/1981 tax map to verify exempt parcels. The pool house pre-dates the
1981 adoption of the sanitary code. We have asked for a pre-co on the house and closing out
old permits on the pool house no Health Department approval is required.
There are two separate sanitary systems which are functioning. There is a system for the house
and a separate system for the pool house. At the time both systems were installed the Health
Department did not regulate the installation of either system [particularly for accessory
structures].
Here are the following applicable regulations:
§760-602 Department Approval of Realty Subdivision, Development, or Other
Construction Project Plans
A.No developer shall after the effective date of this Article:
1. engage in the creation of a realty subdivision, or sell,rent, offer for sale or lease any parcel
in a realty subdivision unless Department approval has been obtained of the existing or
proposed water supply and sewage disposal facilities in the subdivision;
2. engage in the creation of a development, or lease, rent, give, devise, or otherwise dispose
of any parcel in a development, or erect or cause to be erected any permanent building on
any parcel in the development unless Department approval has been obtained for the
existing or proposed water supply and sewage disposal facilities in the development;
3. engage in the creation of a construction project, or erect or cause to be erected any
permanent building unless Department approval has been obtained for the existing or
proposed water supply and sewage disposal facilities.
B. Exemptions. Requirements of this Article shall not apply to:
1. realty subdivisions which have previously been approved by the Department or the New
York State Department of Health, and have been filed in the Office of the Clerk of the
County of Suffolk;

2. developments or other construction projects which have previously been approved by the
Department;
3. developments or other construction projects, other than realty subdivisions,which have
been approved by a town or village planning or zoning board of appeals prior to January 1,
1981, and which met the requirements of the Department in effect at that time;
4. density requirements for one-family residences on parcels which appeared as separately
assessed on the Suffolk County Tax Map as of January 1, 1981,which presently
constitutes a buildable parcel under applicable municipal zoning ordinances and which
met the Department requirements in effect on January 1, 1981.No automatic waiver of these
requirements of this Article shall be granted where five (5) or more of such parcels are
owned by a developer.
