Dear Mr. Tessler:
The following action was taken by the Board of Town Trustees during
its regular meeting held on November 20, 1992 regarding'the above
matter:
WHEREAS, Tessler Associates on behalf of Joseph Mantione applied
to the Southold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated
and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on November 20, 1992 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted con=erning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety-and general welfare of the people of
the town,

R~SOLVED that the Board of Trustees approves the application of
Tessler Associates on behalf of Joseph Mantione to construct a
fixed pier structure 4' X 65', a 14' ramp & (2) 6' X 20' docks.

Protection Structure do hereby agree to a 30 year maintenance
program for a structure commonly known as a ¢~wod p~or m~d floating dock

It is my/our understanding that we are to maintain this
structure with materials designed to endure 30 years and or
equivalent to the original approved structure and that for any
maintenance which involves more than 5% in length of this
structure we are to give prior written notice to the
administrator, waiting for their approval in all but true
emergency situation's which would seriously endanger life,
property and important coastal natural resource features such as
bluffs or wetlands. We further understand that failure to
maintain the stzucture could result in a requirement to post a
bond and or have the repairs ordered as a lien against the
property upon a finding by the Trustees that said lack of
maintenance would risk life, property or important natural
resources features including protected, rare or threatened
animals and plants.
