of New York, by a majority of its duly elected Trustees and by
virtue cf Ohapter 615 of the Laws of the State of New Yo~k, passed
Lu 1693, ~nd pursuant to a written resolution adopted by a ~ma~ority
of the Board of Trustees of said Town of Southold, at a meeting
held pursuant to notice duly given to all the members thereof, on

W!TNES~ETH, the party of the first part in consideration of
before thed~livery hereof, the receipt whereof is hereby duly
acknowledged, has granted and does hereby grant unto the said part~

second part, his heirs and assigns forever, permission to
dredg~ the'inlet channel at Cedar Beach, at Bay View, near Southol~
in the Town of Southold, Suffolk County, New York, Forty (40) feet
in width to s depth of five (%) feet at mean low water mark.
Subject, however, ~o the public right of navigation and sub~
Je~t to the right of the public to pass and repass along that por-
tion of the beach between low and high water msrk. On condition,
however, that the party of the second part will hold the said
Trustees and the Town of South61d harmless and free from any
all d~mages and claims arising under or by virtue of said d~edging.
IN W~TNESS WHEREOF, the said Town of Southold, party of the
first part, has by a vote of a majority of the Board of Trustees
said Town, caused its corporate seal to be hereunto affixed, and
these presents to be subscribed by ~. majority of said Board of
