Requests for Determinations on Fishers Island

Please be advised that Mr. Clavin gave the following recommendations:
Mr. Burr - Request for determination of jurisdiction - Mr. Clavin advised that
he had no problem with this, that according to our code it is well away from
the flagged D.E.C. wetland tine "no iurisdiction".
Henderickson - to extend a dock - no problem with this, it will not impede
navigation or interfere with any other boat.
Steve Maiinowski: John Clavin advised that this project takes up a very large area
that is set aside for future moorings for sail boats. The proposal does not reflect
the project accurately. This is a commercial venture and it will encroach on a
town mooring site (future) and it is not the best place for this project. Has
problems with this location. He will submit something in writing on this one.

Dear Mr. Malinowski:
A review has been made of this Parcel XXXX Proposal to:
establish a boundary measuring 300 ft. in diameter for the purpose of growing
american oysters (Crassostrea vir~inica). The growout trays each measuring 2 ft. x
2.5 inches would be located within the established boundary at a density, of 5 trays
every 40 sq. ft. The boundary shall be a maximum of 350 ft. offshore of- MHW aha
at a depth no ~greater than 3 ft. at
LOCATION: Fishers Island Sound, Block Island S6und, Fishers Island.
It appears that a permit is required from the Town Trustees in
accordance with the Code of the Town of Southold, Chapter 97,
Wetlands.

We have received a request for Department of the Army authorization
for the following activity:
ACTIVITY: to establish a boundary measuring 300 feet in diameter for

As this work is minor in nature, authorization may be by Letter
of Permission. This is in accordance with current Federal regulations
governing work in navigable waters of the United States. To accomplish
the coordination required, prior to the issuance of a Letter of Permission,
your review of the enclosed drawing is requested.
Pursuant to Section 307(c) of the Coastal Zone Management Act of
1972 as amended (16 U.S.C.1456(c), the applicant has certified that the
activity complies with and will be conducted in a manner that is consistent
with the approved state coastal zone management program.
To allow for the timely processing of the subject application,
comments are requested within 15 days of the date of this letter.
