FINDINGS,DELIBERATIONS AND DETERMINATION J U N 1 201 d� MEETING OF JUNE 15,2017 ZBA FILE# 7054 S thold Town Clerk NAME OF APPLICANT: Amy Reichard PROPERTY LOCATION: 23650 NYS Route 25, Orient,NY SCTM# 1000-18-5-16.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its .reply dated March 13, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 13,563 square foot parcel located in an R-40 Zoning District. The parcel measures 65.76 feet along the northerly property line fronting NYS Route 25, measures 196.58 feet along the westerly property line, measures 70.57 feet along the southerly property line and measures 210.56 feet along the easterly property line. The property is improved with an existing one and two story frame house, a frame garage, and a concrete wall shallow pit as shown on a survey prepared by Nathan Corwin Taft III,L.S., dated February 12, 2016. BASIS OF APPLICATION: Request for Variance(s) from Sections 280-124 and the building inspector's January 13, 2017, Amended February 23, 2017 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling; at 1) less than the code required minimum front yard setback of 35 feet; at: 23650 NYS Route 25, Orient,NY. RELIEF REQUESTED: The applicant requests a variance to construct a two and one half story addition to a single family residence with an attached roofed wood porch and wood deck with a non-conforming front yard setback of 29.5 feet where code requires a minimum 35 foot setback. ADDITIONAL INFORMATION: During the public hearing,the Board asked the applicant to research the Town's historic records relating to her dwelling e and to report her findings prior to the Board's special meeting. In response, the applicant submitted a narrative of her research which determined that her home is not designated as historical, or a historic landmark. In addition, the Board requested that the applicant review comparable front yard area variances granted to homeowners in close proximity to this property. The applicant made reference,via email Page 2,June 15,2017 #7054,Reichard SCTM No. 1000-18-5-16.1 correspondence, to three prior variances; two for businesses, Appeal No. 2642 in 1979 granting 14 feet side yard setback relief and Appeal No. 4054 in 1991 granting 17 feet side yard setback relief; and the third for a dwelling, although was not located in close proximity, Appeal No. 5517 in 2004 granting a 36 feet front yard setback where 40 feet is the minimum required by code. In addition, the applicant has offered to eliminate a portion of the proposed rear deck to avoid removing an existing tree which will not have an effect on the area variance before the Board . FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 1, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a mixed use neighborhood consisting of single family homes, a school, fire department, and small commercial buildings. The house is an older home and has an existing setback of 14 feet. The proposed additions and alterations which will add a second floor to an existing section of the house are behind the existing setback and will not affect the character of the neighborhood. During a brief search of comparable decisions for single family dwellings granted by this Board, only one variance was found giving relief for front yard setback of 36 feet instead of the required 40 feet. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant, or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house has a pre-existing non-conforming front yard setback of 14 feet. Any additions and alterations in the non-conforming area would require an area variance. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 16%relief from the code. However, this is a second floor addition to a non-conforming one story section of the dwelling' and the proposed addition will have a more conforming front yard setback than the existing dwelling. and will not increase the non-conformity. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second story addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes , seconded by Member Goehringer, and duly carried,to GRANT the variance as applied for, and shown on the Architectural prints prepared by Mark R. Strazza,Architect dated August 20, 2016, revised September 27, 2016 and labeled T1; AO-A5; S1; E1; and RCP1 and survey prepared by Nathan Corwin LLS Taft, revised February 15, 2017. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under, this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted.
