SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 3, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 21,780 sq. ft. rectangulaf lot located in the R40 zoning district with 110 feet road frontage on Tucker's Lane on the south side of the lot. The east side, bordering a residential neighbor, runs 200 feet perpendicular to the road with the north side of the lot measuring 110 feet abutting lands of Beavan. The west lot line, also shared with Beavan, is equal to the eastside lot line and runs 200 feet in length. The lot is improved with a two-story, wood frame residence, set back 22.2 feet from the road with"an enclosed front porch and rear wood deck. The west side of the house is 21.5 feet from the property line. Additionally, there is a vinyl sided, wood frame garage building with a second story wood deck and stairs set back 7.5 feet(deck amended to 8.5 feet) from the east property line. The north lot line is 32 feet from the edge of the deck addition of the garage. The property is described as being lot 7 and part of lot 8 of the Huntinghurst subdivision filed May 13, 1914 as recorded on the survey prepared by Frank Barylsky, Land Surveyor,November 16, 2016. BASIS OF APPLICATION: Request for a Variance under Article III, Section 280-15 and the Building Inspector's October 5, 2016 Notice of Disapproval based on an application for a permit to legalize an "as built" deck addition to an existing accessory garage converted into an "as built" accessory apartment; at: 1) less than the code required minimum side yard setback of 10 feet; at: 500 Tucker Lane, Southold,NY. SCTM#1000-63-5-3. RELIEF REQUESTED: The applicant requests a variance for a permit to legalize an"as built"wood second story deck to an existing accessory building that will result in a side yard setback of 8.5 feet where code requires a minimum of 10 feet. Page 2, June 15, 2017 #7029, Stepnowski SCTM No. 1000-63-5-3 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 1, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood has developed and evolved over the past one hundred years with a variety of housing styles, uses and accessory buildings. The applicant's garage (a renovation to an earlier accessory structure) has been in existence for over 20 years and is located 7.5 feet from the east lot line without any prior issue. The as built second story attached deck is not visible from the road but is visible to the Long Island Rail Road, will have little or no impact on the lives of area residents. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The accessory building was built in 1991 under Town of Southold Permit #20022 with a non-conforming side yard setback; so any addition that extends the subject dwelling along the existing side yard will require variance relief. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 15% relief from the code. However, the second story attached deck a is "as built" and has a side yard setback that s slightly more conforming than the existing dwelling. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel in the Zoning Code in effect prior to or at the time of purchase. 6. Town Law V67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second story deck with stairs on an accessory building while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member , and duly carried,to GRANT the variance as applied for, and shown on the drawings prepared by Kehl Design Associates, LLC, dated December 6, 2016 and signed and stamped on June 14, 2014 by Robert O. Barratt, and the survey prepared by Frank Barylski, LS, dated November 16, 2016. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The Board will ask the building inspector to inspect the vent located at the top of the landing of the exterior second floor deck stairs to the west side of the structure, and determine whether the vent is code conforming. If not, the applicant will be required to move the vent to a code conforming location prior to the issuance of a certificate of occupancy. 2. The "as built"second story deck addition and stairs shall remain open to the sky. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms.
