Dear Mr. Magill, The following action was taken by the Board of Town Trustees during their regular meeting held on March 23, 1989, regarding your request ro amend the above permit. RESOLVED that the Tovau Trustees Approve the request of Alfred A. Magill to amend permit number 1911 to include a floating dock which will "T" off the existing dock structure, parallel to the shoreline, with the condition that the floating dock does not ex~end more tha~ 4 ft. wide by 40 ft. in length, and that it does not obstruct the waterway. This letter is to notify you that we will amend the permit on payment of fees for work to be done and the amended permit shall take conditions in the original permit granted shall remain. Magill: The following action was taken by the Board of Town Trustees during its regular meeting held on January 17, 1991: RESOLVED that the Town Trustees DENY the request for a waiver to increase the present width of the dock to five feet from four feet. The Trustees feel an increase in the width of the dock will obstruct the waterway, as there is limited space in that area. WHEREAS, Ken Hahn on behalf of Alfred Magill has heretofore applied to the Southoid Town Trustees, pursuant to Chapter 44 of the Code of the Town of Southold for permission to construct a mooring basin for docking of boat by bulkheading perimeter of basin. Bulkhead will stabilize property which has experienced some erosion in the past. To dredge an area, 80 ft. by 20 ft. to 5' and to dry excavate an area 65 ft. x 25 ft. and to fill with 930 cu. yds. co be placed upland of property. LOCATION OF PROJECT: 700 Glen Court, Cutchogue, New York. NOW, tHEREFORE, BE IT RESOLVED AS FOLLOWS: 1. Pursuant to the provisions of Article 8 of the Environmental Conservation Law; Part 617 of Title 6 of the New York State Code the Southold Town Trustees, as lead agency does hereby determine that the action proposed is a Type 1 Action and is likely to have a Significant Effect on the Environment. 2. The Clerk to the Trustees shall file and circulate such determination as required by the aforementioned law, rules and code. 3. That the Clerk to the Trustees shall immediately notify the applicant to prepare a Draft Environmental Impact Statement all in accordance with said law, rules and code. The applicant is to address the loss of productivity to the creek, by that amount of the intertidal marsh and the proposed dredging operations. Box 1179 Southotd, New York 11971 RE: Variance to Dock Permit No.1911 Dear Sirs, I would like to ammend the original dock permit to increase the present width of the dock to five feet. This width will increase the stability and provide a safer platform. I strongly feel the additional width would not hampe~ the safe navigation of the limited use channel. The spacing between the decking will be increased to permit adequate light penetration for the marine life.
