Property Location: 8910 Peconic Bay Boulevard, Laurel. Parcel #126.-5-5.
BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated December 20, 2001, denying
a permit for alterations and additions to an existing detached accessory garage because the new
construction will result in total lot coverage in excess of the Code's 20 percent limit, pursuant to
Article XXIV, Section 100-244B.
AREA VARIANCE REQUESTED: Applicant wishes to construct a 24'8"+- ft. by 24 ft., one and
one~half story accessory garage for boat storage purposes with a maximum lot coverage of 23.5
percent of the total lot size. The survey submitted with the application shows the proposed setback
of the accessory garage at 2.4 ft. (at it closest point from the east side yard property line). Also
submitted for consideration is an architectural plan (Sheets A1 and A-2 dated 12-13-01) prepared
by Richard M. Surer showing the construction details of the proposed garage structure.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on April 18, 2002, at which
time written and oral evidence was presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
PROPERTY FACTS. The subject property is a very small, 9,793 sq. ft. substandard lot created
prior to zoning, located on the south side of Peconic Bay Boulevard in Laurel. The property is
improved with applicant's single-family residence and a detached accessory garage, according to
the survey prepared by John C. Ehlers, last amended March 30, 1999.
1. Although the board recognizes that the small lot size makes compliance with the 20 percent lot
coverage more difficult, the board believes the applicant could achieve the benefit of the new
accessory garage if it were slightly smaller to meet a maximum lot coverage of 23 percent. This
would also enable the applicant to adhere to the code's three-foot minimum side yard setback for
accessory structures.
2. The board discussed, and applicant's attorney agreed to, the ALTERNATIVE RELIEF set forth
above.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, the
board makes the following findings:

1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The neighborhood is primarily developed with
single-family residences, many with accessory garages similar to the applicant's proposed garage.
The accessory garage will be located in the code-required rear yard, and will comply with the
three-foot minimum side yard setback. No negative impacts have been identified that would be a
detriment to the neighborhood.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. Applicant's property is 9,793 sq. ft. and in order to
construct a garage large enough to accommodate the family's boats, a variance is required to
allow total lot coverage of 23 percent.
3. The variance granted herein is not substantial and represent a three-percent increase over the
code's 20 percent limit.
4. The alleged difficulty has been self-created and is due the construction limitations imposed by
the small size of the lot, which the applicants where aware of at the time of purchase.
5. The vadance granted will not have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district. No evidence has been submitted to suggest that this
minor variance will have an adverse impact on physical or environmental conditions in the
neighborhood.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an accessory garage addition while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Tortora, seconded by
Chairman Goehringer, to
GRANT a Variance authorizing an alternative total lot coverage f~j~rcent for a detached ~
accessory garage, with the CONDITIONS that: (1) the garage~et back a minimum of
tlzree feet from the east side.,,property line, ,a, nd (2) th.e only utility shall be~electric. //
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that violates the Zoning Code, other than such uses, setbacks and other features
as are expressly addressed in this action.
