The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such app royal is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing, The failure to obtain such other approval when
required shalt subject this permit to immediate revocation by the Trustees UDOn receipt by the
Trustees. of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceotance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and a claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
t~is permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.

Dear Mr. Luhrs:
The following action was taken by the Board of Trustees during
their regular meeting held on October 30, 1986 regarding your wetland
application.
WHEREAS, Richard A. Luhrs applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of Southold,
application dated August 8, 1986 , and
WHEREAS said application was referred no the Southold Town Conservation
Advisory Council for their findings and recommendations, and
WHEREAS, a public hearing was h~eld by the Town Trustees with respect
to said application on October 30, 1986 at which time all interested persons were
given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will not
affect the health, safety and general welfare of the people of the Town,
NOW, THEREFORE, BE IT
RESOLVED that Richard A. Luhrs BE AND HEREBY IS GRA/~TED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Construct $
catwalk 3' x 50' a 10' x 8' ramp and a 4' x 28 ft. floating dock to be constructed
with the provision that the catwalk be elevated 4' over the marsh and with the
stipulation that the dock does non impede navigation. Said catwalk is to follow
the existing walkway. Additional inspection after one year is to be conducted
for a determination of distruction of marsh for the possibility of additional
catwalk to be constructed landward of existing catwalk (to be put in).

This permit will expire on October 30, 1986 if work has not commenced by said date.
There are two
inspections required and the Trustees are to be notified upon the
completion of the work. Prior to the issuance of said permit by the
Clerk, the applicant shall file with the Clerk a certificate that he
has public liability insurance policies insuring against any li-a~ility
which may arise in the performance of the operations pursuant to such
permit in such 8mount as shall be fixed by the Trustees, which said
policies shall name the Town as a name insured. Please take further
notice that this declaration should not be considered m determination
made for any other department or agency which may also have an application
pending for the same or similar project.
The following fees are now due and payable.
3' x 50' Catwalk @ .25 per sq. ft. 150 sq.
8' x 10' Ramp @ .25 per sq. ft. = 80 sq.
4' x 28' Float @ .25 per sq. ft. = 112 sq.

DESCRIPTION OF WORK
The'apPlicant, Richard Lul~rs, requests after-the-fact
authorization to maintain as constructed an open pile timber pier
and install a ramp .and float in'James Creek, Gr~t Peconic B~y at
Mattituck~ SuffQ~Countyj ~e~ York.
The a 3 foot wic~e by 92 foot long

4 foot by 28 fO0~' ~Ioat would be installed in association with the
existing pier°
The ~bove work was partially completed without prior
Department of the Army authorization. The New York District Corps
of Engineers, having reviewed the matter, has declined at this
time to initiate legal proceedings for the undertaking of the
unauthorized work. The decision~ whether or not to grant
approval, rests With an evaluation of the probable impact on the
public interes~ of either allowing the work to remain as
COnstructed, or requiring its modification or removal.
