Fees: $0.00 Very truly yours, Yohn M. Bredemeyer III President, Board of Trustees JMB/eac DANA &.MICHAEL SAVINO; SCTM# 1000-106-6-37 11/16/2016 TRUSTEE PROPOSED PROJECT DESCRIPTION DOCK: • The Savino's existing dock has two unauthorized additions that would likely prevent transfer of the wetland permit to a new owner, particularly as the existing dock is much larger than the Chapter 275 standard dock allowed for residential waterway access. AT a minimum the offending structures would need to be removed before the Board would transfer the permit. • Removal of the unauthorized additions would allow transfer of the permit to new owners but not replacement. • Replacement of the existing dock, for any owner, would require a new application for a wetland permit with the likely requirement of substantial down-sizing as a condition of a new permit, the amount to be determined by the Board as part of the permit process. BULKHEAD & DECKING REPLACEMENT: • All timbers and sheathing of the existing bulkhead shall be cut flush to the native grade existing in front of the bulkhead. • The new bulkhead may be up to 18" higher (8"-12" suggested) than the existing to provide more storm protection and use the fill generated as a result of the new bulkhead's more landward position. • All construction of the new bulkhead is to be positioned at or landward of 170' from the property's upland corners in conformity with prior Board of Trustee action. • The new bulkhead may have affixed directly to it cantilevered beams supporting a maximum of a 6' wide non-toxic, "Thru-flow" style deck. There shall be no independent piles or supports extending into the creek bottom for supporting the maximum 6' wide deck. Plans for the deck and cantilevered supports shall be provided by a New York State licensed design professional. • A catwalk extension to bridge the gap created by the more landward bulkhead meeting the existing dock may include the minimum number of pile supports necessary (maximum of 4) and the deck must be surfaced with "Thru-flow" decking. • Plans to harvest a portion of the living Spartina alterniflora plants within 2- 3' of the existing bulkhead for subsequent replanting in the approximate 9' area of disturbance resulting from removing the old bulkhead and soils shall be considered in lieu of plants from an upland source. • Revegetation of the disturbed area is to be with Spartina on 12" centers. • The project will need to be bonded and/or securitized as provided in the Wetlands Code in the amount of $50,000-$60,000. • Construction will require the installation of a silt boom prior to and during construction. • Plans depicting the above changes are to be submitted for review by the Trustees prior to permit issuance. • There will be at least 5 inspections required for the project: 1) Pre-construction with the contractor, confirm staking and to review plant harvest prior to construction. 2) Silt-boom installation verification. 3) Construction in-progress inspection. 4) Final Construction with cantilevered deck. 5) Plant survivability. FarrelFritz ~ 100-Motor Parkway Suite 138 Hauppauge, NY 11788 RE: DANA& MICHAEL SAVINO 1945 BAYVIEW AVENUE, MATTITUCK SCTM#: 1000-106-6-37 Dear Mr. Armentano: Thank you for your recent submission of an application for a Southold Town Wetland permit with a modified bulkhead plan and your communication of June 16, 2016 confirming the Savino's Southold Town Wetland Permit. With respect to the existing permitted dock, although its total replacement is permitted under the provisions of the Savino's NYSDEC Article 25 tidal wetlands permit, total replacement under Chapter 275 of the Southold Town Code (Wetlands & Shorelines) requires a wetland permit from this office. The Southold Trustees met with Chuck Bowman of the Land Use Company onsite during our monthly field inspections on July 12, 2016 and discussed the modified bulkhead proposal at our regular monthly work session on July 18, 2016. The application has been scheduled for a public hearing on August 17, 2016. The Southold Trustees acknowledge and appreciate your ongoing efforts to quell litigation by submitting this modified bulkhead proposal. Accordingly, the Board thought it appropriate for me to communicate to you our concerns, while trying to address some of yours, ahead of the public hearing: 1) The Board, based on its experience, does not think a low sill bulkhead is appropriate for this site in any configuration. The Board may require an outside consultant to review on the advisability of a low sill bulkhead at the applicants' expense, under the provisions of Chapter 275, if you wish to continue this project attribute. I 2) Given site specific conditions and the configuration of the Mattituck Creek foreshore and wetland vegetation in the vicinity of the Savino property, the Trustees strongly believe that any bulkhead proposal which seeks placement on Town Trustee Lands may be problematic if located only 5' landward from the existing structure as you propose. 3)This Board is willing to consider a bulkhead located 10' landward of the existing structure as a proposal meeting the basic requirements for considering a quit claim issued to the Savinos, forever quitting any Town Trustee claim to lands further landward. Any proposal closer than 10' is an unlikely candidate for a quit claim, the Board having no obligation to issue one even if a bulkhead were to be approved at 5' landward of the existing. 4)The Board is willing to consider a maximum of a 4'wide cantilevered walkway extension of the deck extending over the creek, constructed of non-toxic decking material, not necessarily "Thru-Flo" style decking, provided it is attached solely to the bulkhead and deck and is substantially landward of the 5' offered. 5)All excess soils not used for bulkhead construction will be disposed off site. The existing bulkhead will be removed in the most environmentally sound manner, employing a silt boom. 6)All subsequent bulkhead replacements are to be in-place or landward of any"new" location receiving a permit. 7)A catwalk extension to the dock should be included in any plans. I hope this information and the Board's concerns will be the starting basis for productive discussion during the Public Hearing in this matter. This communication is in response to this pending application and confirms my phone conversation with Mr. Kevin Sweeney of Farrell Fritz of this date. As the proposed activity will not entail the need for-a-permit under the Coastal Erosion Hazard Area (CEHA, Chapter 111), there is not a requirement for a 30-year maintenance agreement, and a fee of$250.00 is all that is due for the Town wetland permit (Chapter 275). Therefore, please send us a check made payable to the Town of Southold in the amount of$250.00 and we will either return to you your check#556 in the amount of$500.00, or simply destroy same. The Trustees note the existence of a prior approval and "open" permit from the NYSDEC for an Article 25-Tidal Wetlands Permit for the replacement of the residential docking facility of the Savinos. Please be advised that repair or replacement of docks requires a permit from this office under the provisions of the town Wetland Code, Chapter 275. As the permit for the existing dock does not appear to be in the Savinos' name, you may wish to incorporate plans for a compliant dock into the pending application so that repairs and replacement may be contemplated. , The Board is available to meet with you during field inspections scheduled for Tuesday, July 12, 2016. Box 1179 Southold, New York 11971 Attn: John M. Bredemeyer, Board of Trustees President Re: Savino Application 1945 Bayview Avenue, Mattituck, NY Dear Mr. Bredemeyer, As you know, this firm is counsel to the applicant, Mr. and Mrs Savino (the "Savinos"), in connection with their wetland permit application to repair and replace an existing 100 linear feet of bulkhead with the respective returns and decking at their property located at 1945 Bayview Avenue, Mattituck, New York (the "Subject Property"). This letter is in response to your letter dated July 25, 2016. Please find the below responses to the Town's comments as follows: 1. The Board, based on its experience, does not think a low sill bulkhead is appropriate for this site in any configuration. The Board may require an outside consultant to review on the advisability of a low sill bulkhead at the applicants' expense, under the provisions of Chapter 275, if you wish to continue this project attribute. Response: Based on various meetings with members of the Board of Trustees ("Trustees") a low sill bulkhead was recommended to the Savino's consultant, Land Uses Ecological Services ("Land Use") as a possible option to mitigate the environmental concerns of the Trustees. As a result, Land Use submitted the proposed plans at considerable cost and expense to the Savinos. The Savinos will abandon the low sill bulkhead concept. NEW YORK I UNIONDALE I WATER MILL EE'_ -VE ; 0S AUG 10 2016 August 9, 2016 Page 2 Southold Town Board of Trustees-- 2. Given site specific conditions and the configuration of the Mattituck Creek foreshore and wetland vegetation in the vicinity of the Savino property, the Trustees strongly believe that any bulkhead proposal which seeks placement on Town Trustee Lands may be problematic if located only 5' landward from the existing structure as your propose. Response: We disagree with your generalization and comments concerning the Town Trustee Land and the negative impacts of locating a bulkhead five feet landward from the existing bulkhead. We also note your determination is at odds with several prior determinations of the Trustees expressly permitting construction and/or reconstruction of similarly situated waterfront structures on Town Trustees Land located along Mattituck Creek. Moreover, a decision of an administrative agency which does not adhere to its own prior precedent on essentially the same facts is arbitrary and capricious (Matter of Tall Trees Constr. Corp. v. Zoning Bd. of Appeals of Town of Huntington, 97 N.Y.2d 86, (2001). Thus, the precedent of the Trustees permitting other private property owners to construct structures and bulkheads on Trustee Land along Mattituck Creek must be carefully considered for the Savino application. 3. This Board is willing to consider a bulkhead located 10'landward of the existing structure as a proposal meeting the basic requirements for considering a quit claim issued to the Savinos, forever quitting any Town Trustee claim to lands further landward. Any proposal closer than 10' is an unlikely candidate for a quite claim, the Board having no obligation to issue one even if a bulkhead were to be approved at 5'landward of the existing. Response: Please find enclosed revised project plans locating the bulkhead 10 feet landward of the existing structure. 4. The Board is willing to consider a maximum of a 4' wide cantilevered walkway extension of the deck extending over the creek, constructed of non-toxic decking material, not necessarily "Thru-Flo"style decking, provided it is attached solely to the bulkhead and deck and is substantially landward of the 5'offered. Response: Per our several meetings with the Town Attorney's Office and the Trustees, it was agreed that a cantilevered extension of the deck extending over the creek, made of a translucent and "Thru-Flo" style decking would be an appropriate design. However, it was never limited to four feet as suggested in the Trustee letter. As such, the enclosed revised project plans provide for an extension of the cantilevered portion of the deck from a bulkhead located ten feet landward of the existing structure. i August 9, 2016 Page 3 5. All excess soils not used for bulkhead construction will be disposed off-site. The existing bulkhead will be removed in the most environmentally sound manner, employing a silt boom. Response: Comment noted and will be complied with. 6. All subsequent bulkhead replacements are to be in-place or landward of any "new"location receiving a permit. Response: Duly noted. 7. A catwalk extension to the dock should be included in any plans. Response: Duly noted and provided for by the revised plans. Enclosed within this submission are (4) revised plans for the Savino project as referenced above. These plans have eliminated the low sill bulkhead and relocate the proposed bulkhead 10 feet landward of the existing bulkhead, while leaving the deck area as an open grate decking. This communication is in response to this pending application and confirms my phone conversation with Mr. Kevin Sweeney of Farrell Fritz of this date. As the proposed activity will not entail the need for a permit under the Coastal Erosion Hazard Area (CERA, Chapter 111), there is not a requirement for a 30-year_ maintenance agreement, and a fee of$250.00 is all that is due for the Town wetland permit (Chapter 275). As the permit for the _existing dock does not appear to be in the Savinos' name, you may wish to incorporate plans for a compliant dock into the pending application so that repairs and replacement may be contemplated.
