That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authotized. 6. That there shall be no interference with the fight of the public to pass and repass aioag the beach bet~veen high and Iow water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall came unreasonable obstrnetmn to free navigation, the said Permittee will be requiled, upon due notice, to remove or alter this work or project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permktee ot the completion of the work anda- orized. 9. SCTM ~49~t-18 Dear Mr. Just, The following action was taken by the Board of Town Trustees during its regular meeting held on October 26, 1995 regarding the above matter: WHEREAS, J.M.O. Consulting Inc.,on behalf of DR. EARL A. LOOMIS, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated August 15, 1995, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 26, 1995, at which time all interested persons were given an opportunity to be heard, andr WHEREAS, the Board members have personally viewe~ and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW T~EREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of DR. EARL A. LOOMIS to construct approx, i01' of timber bulkheading, a 20' return and to backfill structure with approx. 2~ c.y. of Clean sand which will be trucked in from an upland source, a 20' non-turf, non-fertilized b~ffer landward of bulkhead, and a plantin~ plan seward of b~lkhead. Located: Cove Circle, Private Road, Greenport, and, that this determination should not be any other Department or an application pending for the same or -ect. Permit to construct project will expire two years from the date it is signed if not started. Fees must be paid, if applicable, and permit issued within six months of the date of this notification.
