SPECIAL CONDITIONS: to construct 50 1.f. timber retaining wall
which will tie onto return of proposed wall of Passalaqua to
east and have a 12' return on west side. Approximately 150 c.y.
of backfill will be trucked in from access point at Duck Pond
Road (to west). Existing stone will be used for armor and lain
on filter cloth and 50-1001b bedding (core) stone. Construct
and access stairway from crest of bluff to beach consisting of
4' X 4' platform at crest of bluff; 4' X 30' staircase; (2) 4' X
4' platforms in fron and behind retaining wall; 4' X 10' steps
to beach. Located ROW off Oregon Road, Cutchogue.
Bluff restoration through a re-vegetation agreement is
attached hereto and is a necessary special condition of this
permit.
A relocation agreement is attached hereto and is a
necessary special condition of this permit.
A maintenance agreement is attached hereto and is a
~ecessary special condition of this permit. You MUST submit a
licensed Land Survey of the completed structure(s) for your
maintenance agreement to be validated.

Pursuant to the provisions of Chapter 615 of the Laws of
the State of New York, 18.93; and Chap+er 404 of the Laws of +he
State of New York 1952, and the Sou+hold Town Ordinance eh-
tiffed "REGULATING AND THE PLACING OF OBSTRUCTIONS
IN AND ON TOWN WATERS AND PUBLIC LANDS end the
REMOVAL OF SAND, GRAVEL OR OTHER MATERIALS FROM
LANDS UNDER TOWN WATERS:" and in accordance with the
Resolution of The Board adopted et a meeting held on October 22
19 92 , and in consideration of the sum of $ 150.00 paid by

of Southold Town Trustees authorizes and permits the following:
Construct 501f timber retaining wail which will tie onto return of

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees during
its regular meeting held on October 22, 1992 regarding the above
matter:
WHEREAS, En-Consultants on behalf of Josh London applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated August
17, 1992 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was'held by the Town Trustees with respect
to said application on October 22, 1992 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board me~ers have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that the Board of Trustees approves the application of
En-Consultant on behalf of Josh London to construct 50 1.f. timber
retaining wall which will tie onto re~urn of proposed wall-of
Passalaqua ~o eas~ and have a 12' return on west side.
Approximately 150 c.y. of backfill will be trucked in from access
point at Duck Pond Road (to west). Existing stone will be used for
armor and lain on filter cloth and 50-1001b bedding (core) stone.
Construct an access stairway from crest of bluff to beach consisting
of 4' X 4' platforms in frong and behind retaining wall; 4' X 10'
steps to beach. Located ROW off Oregon Road, Cutchogue.
This permit will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within slx months
of the date of this notification. Two inspections are required and
the Trustees are to be notified ~pon completion of said project.
Permit will be issued upon payment.of the following fees for work to
be done below Mean High Water Mark:

Protection Structure do hereby agree to a 30 year maintenance
program for a structure conunonly known as a Retaining Wall
of 50' ~ 12' return on west ~.as~shown on the attached
feet of length site
licensed survey of the as-built structure.
It is my/our understanding that we are to maintain this
structurewith materials designed to endure 30 years and or
equivalent to the original approved structure and that for any
maintenance which involves more than 5% in length of this
structure weare to give prior written notice to the
administrator, waiting for their approval in all but true
emergency situation's which would seriously endanger life,
property and important coastal natural resource features such as
bluffs or wetlands. We further understand that failure to
maintain the str~cture could result in a requirement to post a
bond and. or have the repairs ordered as a lien against the
property upon a finding by the Trustees that said lack of
~ai~tenance would risk life, prot~%rty or important natural
resources features inclu~ng l~r~e~ted, rare or threatened

the original construction and validated to show the the final
approval of the administrator. Subsequent owners may apply to
the Southold Town Trustees to re-authorize this maintenance
