FINDINGS,DELIBERATIONS AND DETERMINATION2 4 X117 MEETING OF MAY 18,2017 & Town Clerk ZBA FILE 7052 NAME OF APPLICANT: Arthur Picchione PROPERTY LOCATION: 830 Eastwood Drive, Cutchogue,NY 11935 SCTM No. 1000-110-3-10 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not referred as required to the Suffolk County Planning Department under Administrative Code Sections A 14-14 to 23. PROPERTY FACTS/DESCRIPTION: The subject property is a 22,400 square foot parcel in the R40 Zoning District. The subject parcel measures 140 ft. along Eastwood Drive and 160 ft. along the western property line, 140 ft. along the northern property line and 160 ft, along the western property line along South Cross Road. The property is improved with a one story single family dwelling with attached garage and a conforming shed in the rear yard as shown on a survey prepared by Roderick Van Tuyl, P.C., dated November 10, 1975. BASIS OF APPLICATION: Request for a Variance under Article XXIII, Section 280-124 and the Building Inspector's July 6, 2016, amended February 14, 2017 Notice of Disapproval based on an application for a permit to legalize an "as-built" deck addition to an existing single family dwelling, at: 1) less than the code required minimum rear yard setback of 50 feet; at: 830 Eastwood Drive, Cutchogue, NY. SCTM#1000-110-3- 10. RELIEF REQUESTED: The applicant requests a variance to legalize an "as built" deck addition which has a rear yard setback measuring 38.1 ft. on a parcel with two front yards. The attached deck measures 23.6 ft. by 18.6 ft. ADDITIONAL INFORMATION : The deck, now completed, was constructed before the applicant received the original notice of disapproval for an "as-built" structure from the Town's Building Department in July 2016. A letter of objection was received and testimony given by neighbors who share the southern boundary line with the applicant. They raised concerns about the size of the as built deck and encroachment towards their property line. They asserted that the peaceful enjoyment of their home will be disrupted by the location of their neighbor's deck. The applicant explained that he had not initially planned to build the attached elevated deck but to install pavers. However, because of severe rain and the sloping of his property and the possibility Page 2, May 18, 2017 #7052, Picchione SCTM No. 1000-110-3-10 of damage by flooding to his home, he indicated that hisr contractor suggested that an elevated wood deck would be necessary to create a functional outdoor area that would not be impacted by the flooding on the property. Subsequently, the deck was built immediately along with drains installed and large evergreen trees and other vegetation was planted to impede the flow of storm water runoff and to provide privacy for both the neighbors and the applicant. Pursuant to the Board's request the applicant submitted copies of similar variances for rear yard setback relief for attached decks granted in the subject neighborhood as follows: 1) File #6636 relief of 5.8 feet for deck addition granted where the code requires 50 feet; 2) File #6754 relief of 22 feet where the code requires 35 feet; and 3)File#3202 relief of 21.6 feet for deck addition where the code requires 25 feet. In addition, the applicant submitted a landscape proposals for additional evergreen privacy screening and estimates dated November 23, 2016 and April 4, 2017 from Owen Brothers Landscape Development detailing the number and type of vegetation to be planted on his property The applicant also submitted a proposal from Blue Line Builders dated May 5, 2017 that he received from a builder which estimated that the removal of 10 feet of the deck would be very costly. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 4, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of mostly small homes, although many have been improved and enlarged by their original and/or subsequent owners. Attached decks in the rear yard with non-conforming setbacks already exist in the subject neighborhood. The property consists of two front yards having street frontage on both South Cross Road and Eastwood Drive which creates difficulty when determining placement of improvements. 2. Town Law $267-b(30)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Although the Board recognizes and does not condone the fact that the applicant built the subject deck without first receiving the benefit of variance relief, at this point it would not be economically feasible for the applicant to demolish most of the deck in order to conform to the code, as disclosed by an estimation submitted by the applicant's builder. Moreover in weighing, the balancing test, the Board believes the benefit to the applicant outweighs the determined to the community. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 23.8% relief from the code. However, the applicant has already planted many large trees and other vegetation in order to visually screen and buffer the deck from neighboring properties; and the condition from additional privacy screening along the rear lot line imposed herein will further mitigate the degree of non-conformity. Additionally, at the Board's request the applicant researched similar prior variances for rear yard setback relief granted by the ZBA in his neighborhood. The applicant submitted copies of the following decisions; 1) File #6636 relief of 5.8 feet for deck addition granted where the code requires 50 feet; 2) File #6754 relief of 22 Page 3, May 18, 2017 #7052, Picchione SCTM No. 1000-110-3-10 feet where the code requires 35 feet; and 3) File #3202 relief of 21.6 feet for deck addition where the code requires 25 feet. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an as built deck addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Planamento, and duly carried,to GRANT the variance as applied for, and shown on the site plan (Sheet 1) and Rear Addition Building Plans (Sheets 1 and 2)prepared by Kenneth Schulman,Architect, last revised January 23, 2017. SUBJECT TO THE FOLLOWING CONDITIONS: 1) Prior to the issuance of a certificate of occupancy, the applicant shall plant evergreen and other vegetative screening(minimum 5 feet tall from the base when planted in the ground to the tip) along the rear property line, so that at maturity, they will substantially buffer and visually screen his deck from view by the neighbors sharing the rear yard property line, 2) Landscape screening shall be maintained in perpetuity; 3) The deck shall remain open to the sky. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, Page 4, May 18, 2017 #7052, Picchione SCTM No. 1000-110-3-10 and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. RELIEF REQUESTED: The applicant requests variances for: l) a 6.02 foot rear yard setback, where the code requires 50 feet, to a proposed deck addition and 2) to construct a 9ft. x 18 ft. accessory shed in the side yard where the code requires a rear yard location. ADDITIONAL INFORMATION: A letter in support of the application was received from a neighbor. The agent for the applicant provided several setback variances that were granted in the neighborhood. The lot adjacent to the applicants' rear property line is owned by the applicants' family and is wooded and undeveloped. The two lots were unmerged by the Board of Appeals in 1998, FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 4,2013,at which time written and oral evidence were presented. The applicant proposes additions to an existing residence and the construction of an accessory shed,both of which are characteristic of properties in this neighborhood that have been similarly improved over time. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The pre-existing single family dwelling exists entirely within the 50 foot rear yard setback and has a pre-existing rear yard setback of 5.8 feet (as shown on the proposed site plan), which consequently creates the requirement for a rear yard setback variance for any proposed additions or alterations to the dwelling. The applicant's architect provided substantial documentation as to why an addition in . the existing front yard was not feasible because of the great expense required to re-locate existing mature trees, underground water and gas lines and overhead power and telephone lines.A variance from a conforming rear yard location for the proposed shed is required because there is no room in the rear yard in which to locate a storage shed. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial. The rear yard setback variance represents 88% relief from the code. However, this substantiality is mitigated when considering that the two story dwelling exists in its pre-existing location having a slightly lesser(5.8 feet) nonconforming rear yard setback than what the applicant requests, that new construction closest to the rear property line is proposed to be one story in height, and that an existing accessory garage at 2.6 feet from the rear property line will be demolished. The request for a proposed accessory shed in a location other than the required rear yard represents 100% relief from the code. However, this substantiality is mitigated when considering that the proposed shed location is within the 50 foot code required rear yard setback from the rear property line. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(30)(5). The difficulty has not been self-created. The difficulty is a consequence of the pre-existing non-conforming location of the existing dwelling. 6. Town Law 4267-b. Grant of the requested variance reliefs is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a additions and alterations to a pre-existing dwelling and the placement of a shed in a location other than the required rear'yard, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. However, the subject adjoining property line that creates the rear yard to the subject parcel is a side yard to the adjoining property most affected and if considered as such would mitigate the substantiality of the requested variance. 4. For the last 19 years, we have owned and occupied a house immediately west of 830 Eastwood Drive, at 630 Southern Cross Road. Our house, which is slightly more than one thousand square feet, is situated on a small, wooded lot (slightly more than one-third of an acre). The eastern side of our property shares a 100-feet property line with the rear of 830 Eastwood Drive, which is illustrated on the enclosed copies of our survey map and the Town's tax map for the area encompassing the two properties. For reasons summarized below, we respectfully ask the Zoning Board of Appeals to confirm the Town's disapproval of this deck, and to deny the Picchiones' request to have the disapproval rescinded. We appreciate the Town's diligence in having reviewed the most recent changes and expansion of the Picchiones' house, and in finding that one of the two new decks, both at the rear (western side) of their house, does not satisfy the required minimum set-back of 50 feet from our shared property line. The deck that violates the Town Code is large—measuring 23.3 feet by 19 feet according to a copy of an annotated site plan that we received—and it is very visible, not only from the interior and exterior of our home, but also from the street and nearby houses along a stretch of Southern Cross Road. (A second deck, measuring 14 feet by 13 feet, is located at the northwestern corner of the house, approximately 24 feet from the edge of the first deck. This second deck is set back more than 50 feet from the property line. Our references in this letter to a "deck" mean only the larger, non-compliant deck, located at the southwestern corner of the Picchiones' house.) According to an annotated one-page excerpt of a proposed site plan that was mailed to us last month by the Picchiones (a copy of which is enclosed with this letter),their original proposed 1 plan called for a large one-story addition to the rear of the original house (which originally had been a small, three-bedroom ranch), and, behind this addition, a deck of 23.3 feet by 12 feet. This plan would have left a distance of 44.7 feet from the edge of the deck to our shared property line. (The Picchiones further expanded the original house by adding not only the second rear deck, but also a porch along the entire front of the house, and a two-car garage, among other changes.) Instead of following this plan,the Picchiones, without approval from the Town and without notifying us, increased the deck by an additional 7 feet of depth,for a total depth of 19 feet, and they elevated the deck to the height of the raised one-story addition—making it, in effect, an extension of the added room. The annotated site plan shows that, with the deck and the adjoining one-story addition,the depth of the house increased in our direction by a total of 35 feet—resulting in a very noticeable reduction in the set-back from our shared property line. Most notably,the rear edge of the elevated deck is now only 37.7 feet from our property line, contrary to the minimum requirement of 50 feet. Before this construction,the set-back from the rear of the original house, as it was when purchased by the Picchiones, was almost 75 feet—approximately the same as the set-back of our home's north side from the shared property line. For small lots such as ours, as well as for other nearby small lots that have yet to be developed, an adequate set-back is essential in maintaining the rural character of the area and in allowing homeowners to have the quiet enjoyment of their properties in the beautiful, natural environment of Fleets' Neck. We ask the Board to deny the Picchiones' request not merely because the deck is in violation of the Code and would not have been built if they had followed the required process, but also because, under the circumstances, the deck significantly and unnecessarily violates the peaceful enjoyment of our home, its immediate environment, and the established character of the surrounding area. A brief visit to our home would make clear how significantly the deck intrudes personally on us. It directly faces the front (east) and the north side of our house. Along the northeastern side of our home is our outdoor living space—a concrete ground-level patio, about 10 feet by 14 feet, where, during more than half the year, we spend most of our waking hours, including having our meals, from breakfast through dinner, surrounded by oak trees that overlook the patio and continue down a hill in a northeasterly direction. Immediately next to our patio is our master bedroom, with large windows facing north and east. The Picchiones' deck is in open view from our patio and from our bedroom windows. We also anticipate that sounds from the deck, which appears to be an extension of a large dining room,will travel significantly longer and louder, in a direct line to our patio and master bedroom. (A copy from the survey of our home is enclosed; it illustrates the front and north side of the house, including the patio, and their relationship to the 100-foot property line shared with the Picchiones.) The deck, when considered with the many other changes made to the property, represents a significant deviation from the character of the surrounding area. From the early 1960s, 830 2 Eastwood Drive consisted of two lots, owned by Fr. Walter Murphy,who used it as his second home until his death a few years ago. The house,which had a small ground-level patio at the rear, was entirely surrounded by a dense collection of native trees, many of which were well- developed oaks, along with younger understory trees. Fr. Murphy left the second (northern) merged lot entirely in its natural state, filled with numerous substantial oak trees. The land on our property, which we purchased a short time after the original owner had passed away, had similar features, and over the past 19 years we have done our best to preserve its rural character. Our home remains surrounded, sheltered and enhanced by large oaks, along with other trees and plants. With relatively few exceptions, homeowners in the area have maintained this same character. Unfortunately, Fr. Murphy's two lots have recently been altered in ways inconsistent with the area's character. Immediately before the Picchiones' purchase, Fr. Murphy's two merged lots were separated, and the southern lot was then bought by the Picchiones. The new owner of the second, northern lot proceeded, shortly after his purchase of it and without approval from the Town or notice to his neighbors, to clear-cut all the trees on the lot, leaving behind nothing but sawdust and a still-visible mass of dead stumps. Although the Picchiones have kept several of the existing trees on their lot,they have cut out many more, along with understory trees and native groundcover. As a result, the natural environment—and the buffering that existed between our two properties, and between the Picchiones' property and adjacent roads and properties— has been severely diminished, as an attached series of photographs illustrates. The non- complaint deck is now, with the removal of so many trees and other plants, coupled with its elevation well above ground level, in open view from our living areas (our patio and master bedroom), as well as from Southern Cross Road. The Picchiones' house has two decks, which together have a square footage of almost 625 square feet—which, for the sake of comparison, is more than half of the square footage of our entire home. The deck is out of character in the area not only in its size, but in its elevation. There are very few elevated decks in Fleets' Neck, and we are not aware of any houses that include two such decks, in addition to the new elevated porch along the entire front of the Picchiones' house. Following our receipt of the Picchiones' letter containing the notice of the hearing, we contacted them to discuss their request for a variance. As neighbors, we told them of our concerns, and we asked how the deck came be built. In essence,they admitted that it was built with the knowledge it did not conform to the plan filed with the Town, and they said it would be prohibitively expensive to scale back. In our view,the cost of re-sizing or eliminating the deck would represent only a small fraction of the expenses that the Picchiones have taken on themselves in buying and expanding the property. We recognize that our neighbors have a right to make changes to their properties. However, the requested variance for the subject deck follows many substantial changes already made to the Picchiones' property,which make the deck, as built, an intrusion that is deeply objectionable to us and that diminishes our property. The Picchiones' proposal to add more 3 plantings to buffer the deck is not realistic because new plantings will not cover the full elevation of the deck and will not restore the thick growth of established trees that were removed. Based on all these factors, we believe that the most respectful solution to this problem,which the Picchiones themselves created, is to require comipliance with the 50-feet set-back standard. Compliance can easily be achieved by reducing the deck's depth, or by installing a patio at ground level as was originally proposed. I We have attached ten exhibits to supplement our request in the hope that they will assist the Board in its evaluation. Included in the exhibits are print-outs of images currently viewable on Google Maps,which show in detail the heavily wooded landscape at and along 830 Eastwood Drive, 630 Southern Cross Road, and the immediately surrounding area, as it existed in August 2012. (We regret that our black and white reproductions fail to capture the area.) Those images are in stark contrast to the present sparse condition of the Picchiones' property and the completely empty lot immediately north of it. I Our objections to the deck and what it represents are in no way intended as criticisms of any person. I am sure there are complaints with the town,as our neighbors told us it was an eye sore. This is not a natural setting;we had ticks,termites and carpenter ants.We cleaned it up and took down the dead trees,which could have been a danger if they were to fall on their own from being neglected. Many of our neighbors were ecstatic when we started cleaning up the property and told us they were relieved they didn't have to look at the mess any longer. Mr. and Mrs. Courtney claim their house is"natural"which means it is overgrown and not maintained. The property is covered with years of leaves and dead branches. We have never complained because honestly, it does not affect our lives. If this is how they choose to live is it their own business. Since the plants and flowers started to bloom this week,the Courtneys house is far less visible and I am sure my deck will be. I feel this is an unreasonable request for something that is at least 80 feet away from their house. We have no problem planting whatever is necessary to alleviate their anxiety. In our hearts we do not believe it's the actual deck that is bothering them it seems to be any type of change. We took a substantial loan to do the construction and,after losing a large amount due to the flooding,we needed to borrow more from a family member to finish the outside plantings,sprinklers and put in grass (this will all be completed in the next week or two)We are finally at the stage to enjoy the house and neighborhood again. My wife and I are currently both Directors of the Fleet's Neck Property Owners Association as we care about the community and the people living here. We are also on the Beach Committee and are dedicated to preserving the beauty and integrity of our community. I can tell you that every person in the neighborhood stops and tells us what a beautiful job we have done; including Sean Courtney,who said that we have done "a beautiful, meticulous job" on our home. We are very surprised and disheartened by our neighbor's resistance as we thought they were pleased with the changes we made. This will not only be a financial burden but we will have to start more construction.The purpose of the deck was to avoid having to regrade the property and alleviate flooding, as we are situated below street level and our house is on a sloped grade. Removing only part of the deck would make it barely usable and would still cost close to the same amount of money. As you know,we are willing to work with the town and the Courtneys by adding additional plantings or a fence. Thank you for your consideration in this matter.
