Y., as part of the consideration for the issuance of the Permit does understand and prescribe to the fol- lowing: The SOuthold Town Trustees Permit must be prominently displyed on premises ffectsd during t e perd of work. 1. Box 728 Southold, New Y'iork 11971 June 23, 1989 Mr. Andrew Lettieri 1200 Cedar Point Drive East Southold, N.Y.: 11971 Re: Permit No. 3721 Dear Mr. Lettieri: The following action was taken by the Board of Town Trustees during their regular meeting held on August 25, 1988 regarding the above matter: WHEREAS, Andrew Lettieri applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 9, 1988, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on August 25, 1988 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED that Andrew Lettieri BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Construct 4 ' x 15 ' timber dock, install 7 pilings on property located at 1200 Cedar Point Drive East, Southold, N.Y. This permit will expire two years from the date it is signed if work has not commenced by said date. Fees must be paid and permit issued within six months of the date of this notification. Two inspectionsare required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this project. Danilczyk in the vicinity of a dock structure which was previously under permit to Andrew Lettieri under Permit '43721. As this structure may have been deeded to you when you purchased your house from Mr. Lettieri, we would ask that you remove said non-permitted structure so as to provide Mr. Danilczyk with sufficient room to moor his boat. Danilc yk was granted a mooring approval in accordance with this offfice°s standard procedures and as a result of a substantial waiting period on his part in :which he provided ample information to this office which we reviewed extensively. 2) The Southold Trustees do not recognize transfer of dock permits unless they are directly attached to ones real property.. If you are in possession of the copy of the former , owners permit #3721, you will see it clearly indicates the permit is non-transferable. It is an unfortunate fact that no docks at this location should have been permitted except for Mr. Eco's. Many past representations of residents in this area accepted in good faith by the Board of Trustees have been less than accurate, 3) This board believes it has no obligation to notify Mr. Lettieri or yourself concerning our management prerogitives on our underwater land. 4) 1 indicated in my telephone conference with your wife that I hoped we would not have to order removal of the dock and that the neighbors will work together. Further, should this matter escalate to require a formal revocation we may be forced to review all permits on this cove and possibly order removal of all dock structures not attached to real property. Your rights to be formally heard in this matter would only run with a valid permit. t ad With respect to any unfortunate dialogue your wife has had with Mr, Danilczyk I can only suggest that you avoid him from now on. The scenario you outline in your letter concerning possible settlement would not likely be possible unless there is an umbrella settlement of this issue which will not further disadvantage neighbors or establish any binding precedent on this board® To reach such an accord I would have no objection to holding off on enforcement in this matter for 60 days to give you an opportunity to set up a meeting among all boat and mooring owners (including the Eco°s) 'at which time I would be glad to speak. I would suggest you request such a meeting though your community association and send written notifications mailed to all involved. If we can possibly,,work on a solution, we will be glad to help. I reviewed the file and it didn't have enough information. It seems that B got a permit for some dock other than A. dock on the condition that he pulls out C's dock. Why were neither Mr. Lettieri nor myself informed about Mr. Danilczyk's request and the Southold Town Trustees' deliberations and afforded an opportunity to respond? 4. It is my wife's understanding based on a telephne. conference with you on November 25, 1991 that the Southold Town Trustees would not require the removal of the dock with permit # 372.1. What lead to a change in the Trustees' decision and again why was such a determination made without affording us the opportunity to be heard? When my wife "caught him" planting his mooring permit number # 3662 next to the dock with permit # 3721, he was rude and not wilting to discuss scuss the matter with her at all. My site, which was originally assigned to Mr. Latieri who moved away, has a high platform on it which was not finished. This platform, without safety rails, goes nowhere extending from the road (Cedar Point Drive East) out over the high water mark of Pleasant Inlet ending with a free fall of about 6 feet to the mud and water below. The reason for my letter is as follows: 1) I am concerned about the safety of this structure in the center of my site. This structure performs no function in this location. 2) This structure on my site blocks access to my boat. 3) I would like to install a safer stairway down to the water line in the same spot that would allow access to my boat by my family. My proposal is as follows: 1) If required, I will remove this high structure on my site at my expense. 2) I will install in my assigned location, with the Town Board's approvat, a stairway down to the water line in the same physical location as the current unfinished platform. What I suggest is that the board consider assigning me the next available location at Pleasant Inlet or in the Cedar Beach Area including those that are made available by residents that move out of Cedar Beach Park, Southold. For example, my wife, Bettina, as Secretary for the Cedar Beach Park Association and charter member of the Board of Directors for Cedar Beach Park Association, has been told that a member with a recent Pleasant Inlet dock permit was selling their home. Since each boat docking permit is assigned to an individual, I would assume that these locations would be reassigned by the Board Of Town Trustees when someone moves. Based on this theory, I wish to apply with this letter for the next available position at Pleasant Inlet, Cedar Beach, Southold or any other local area you might suggest. The town Constable said it was tight but that room was available. The additional room he saw was being wasted due to the 4 to 5 foot spacing between the other boats. He recommended that when all the offshore stakes were installed in 1989 that room be made for me. In 1989 I found out that my neighbors had agreed to rearrange their docks to make room for a new neighbor. With their support, a stairway and dock using approximately 10 feet of space was approved under Permit * 3721 and is currently in place in 1991. Dock Permit * 1780 which is closest to me was moved closer to me rather than further away to cure my space problem that they complained about in 1988 prior to Permit * 3721's approval. This new arrangement by my neighbors leaves me with about 1 foot for my boat on the West side of Pleasant Inlet and 10 new feet for Permit it 3721 in the center of Pleasant Inlet. Another interesting rumor is that the owner of Permit * 3721 who is in real estate and the building area has his house up for sale and may have his new dock listed as a possible asset.
