Lehr to Walter& Pauline Scharpf, as issued on December 26, 1985; and BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Wetland Permit#2100 to reflect in detail the existing structures consisting of a ±122.5' (±72' plus ±50.5')total length of existing primary bulkhead; the existing ±9' easterly return; the existing westerly return which consists of four(4) sections having lengths (north to south)of±9', ±8.5', ±2.5' and ±9.5; and the existing 2.5'x4.5'wood platform and 2.5' wide steps located adjacent to the westerly return; and as indicated on the survey prepared by Peconic Surveyors, P.C., last dated December 27, 2016, and stamped approved on February 15, 2017. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standards and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction The as-built bulkhead structure does not comply with Wetland Permit No 2100 issued in 1985. Aerial analysis indicates that changes may have been madeafter 2004. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
