Notice of Public Hearing to Consider Amending Town Code
Chapter 319 to Extend the Moratorium on All New Planned
Development District Applications within the Town of
Southampton for Three Months
RESOLVED, that the Town Board of the Town of Southampton hereby directs that a public
hearing shall be held on June 1, 2017, at 1:00 p.m., at Southampton Town Hall, 116
Hampton Road, Southampton, New York, to hear any and all persons either for or against a
proposed local law entitled, "A LOCAL LAW to consider amending Town Code Chapter 319 to
extend the moratorium on all new Planned Development District (PDD) applications within
the Town of Southampton for three months," which provides as follows:
LOCAL LAW NO. OF 2017
A LOCAL LAW to consider amending Town Code Chapter 319 to extend the moratorium on
all new Planned Development District (PDD) applications within the Town of Southampton
for three months.
BE IT ENACTED by the Town Board of the Town of Southampton as follows:
SECTION 1. Legislative Intent.
On May 24, 2016, by Local Law No. 8 of 2016, the Town Board of the Town of Southampton
imposed a one year moratorium on the processing, reviewing, or accepting of any new PDD
applications within the Town. As articulated in the legislative intent of Chapter 319, the
moratorium was necessary in order to preserve the status quo while the Town Board
assessed and evaluated whether PDD legislation was a tool it wanted to continue to utilize
within the Town. Indeed, the moratorium allowed the Town to critically study the current
law, and consider whether it wanted to continue to utilize this discretionary land use tool in
the future.
In short, the objective of the moratorium was to allow the Town decision-makers to engage
in a comprehensive analysis and review of the current PDD provisions, prior to taking action
on any new PDD applications. Having done that, the Town now stands ready to draft and
present new legislation addressing PDDs within the Town, and this three month extension of
the moratorium will preserve the status quo while the proposed legislation undergoes the
necessary public hearing process.
SECTION 2. Amendment.
The definition of "Moratorium Period" in subsection 2 (Definitions) of Town Code Chapter
319 (Planned Development District (PDD) Moratorium), is hereby amended by deleting the
stricken words and adding the underlined words as follows:
§319-2. Definitions.
As used in this Article, the following terms shall have the meanings indicated:

MORATORIUM PERIOD - The peFied of one yeaF fFeng the effective date heFein. This chapter
shall expire on September 1, 2017. The same may be extended for good cause by
appropriate action of the Town Board.
SECTION 3. Authority.
This local law is adopted pursuant to Municipal Home Rule Law §§10(1)(ii)(a)(11), (12) and
(14), 10(1)(ii)(d)(3), and 22. In addition, all current provisions of §319-5 addressing the
statutory authority for Chapter 319, and the supersession of Town and state laws, remain in
full force and effect.
SECTION 4. Severability.
If any section or subsection, paragraph, clause, phrase or provision of this law shall be
adjudged invalid or held unconstitutional by any court of competent jurisdiction, any
judgment made thereby shall not affect the validity of this law as a whole or any part
thereof other than the part or provision so adjudged to be invalid or unconstitutional.
SECTION S. Effective Date.
This local law shall take effect immediately upon filing with the Secretary of State pursuant
to Municipal Home Rule Law.
AND BE IT FURTHER RESOLVED, that the Town Board of the Town of Southampton hereby
directs the Town Clerk to forward a copy of this proposed local law to the Southampton
Town Planning Board, as well as the Suffolk County Planning Commission pursuant to
General Municipal Law §239-m, for their review and recommendations; and be it further
RESOLVED, that the Town Clerk is hereby directed to publish the following Notice of Public
Hearing:

116 Hampton Road, Southampton, New York, to hear any and all persons either for or

Summary of Proposed Law
The Town Board of the Town of Southampton proposes to extend the current moratorium on
any new PDD applications within the Town for a period of three months in order to preserve
the status quo while proposed legislation, resultant of the moratorium review period,
undergoes the public hearing process.
Copies of the proposed law, sponsored by Supervisor Schneiderman and Councilman
Bouvier, are on file in the Town Clerk's Office, Monday through Friday, from 8:30 a.m. to
4:00 p.m.
