PROPERTY FACTS/DESCRIPTION. The property is a non-conforming 15,475 square foot waterfront parcel located in an R-40 zone. The parcel has 111.87 feet on Long Creek. The parcel has 161.61 feet along a right of way on the South side, 106.42 feet on the East side,and 147.87 feet on the North side. The property is accessed by a 641,38 foot right of way that connects to Wickham Avenue. The property is improved with a one story frame house with decks as shown on a survey prepared by John T Metzger, LLS dated August 4, 2016 and last revised November 7,2016. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 2,2017 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance(s)will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family waterfront homes. The house is at the end of a private right of way and the additions and alterations will not be visible from a public road. 2. ,Town Law 5267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing one story frame house has a non- conforming rear yard setback and front yard setback. Any proposed second story will require the benefit of an area variance. The expansion upwards relieves the need to request permission to encroach towards the protected wetlands. 3. Town Law 5267-b(3)(b)(3). The variance(s) granted herein is mathematically substantial, representing 12% (30.7 ft.) and 13% (30.5 ft.) relief from the code. However, this is a second story addition of an existing non- conforming dwelling and the non-conforming yard setbacks will not be changed. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 5267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second story while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
