The reasons why such Notice of Violation should be rescinded are as follows: 1. The Notice of Violation fails t6 correctly set forth the statute violated. law. 2. The Notice of Violation fails to set forth a violation of 3. The We~_lands Ordinance of the Town of Southold with respect to its provisions andoperation is unconstitutional and unenforceable, both as to the United States Constitution and the New York State Constitution. In the alternative, the undersigned does hereby request a waiver of permit in that the work performed by the applicant fully complies with the standards set forth in Section 97-28 of the Code. RESOLVED that the Southold Town Trustees TABLED the application no. 577 on behalf of Anthony W. & Carolyn R. Leggio whereas the violation has not been satisfied.
