Wilcenski, Chairman ow Members of the Planning Board dk4-� Date: January 3, 2017 Re: Request for Code Interpretation Site Plan for Surrey Lane Vineyards Located at 46975 NYS Route 25, Southold SCTM#1000-69-5-18.1 & 18.6 Zoning District: AC The Planning Board recently received an application for Site Plan approval from Surrey Lane Vineyards for a winery at the location referenced above. During the review of this application questions have been raised as to what constitutes a winery. The Planning Board requests a Code Interpretation as to whether this application can be considered a winery and a permitted use. This application was originally submitted with no evidence of wine-making on the Site Plan. The hearing on November 7 was held open to gather more information. Just before the-next Public Hearing date in December, the applicant submitted revised plans showing a second septic system, and a room with fermentation tanks and a drain in the basement where previously were shown only barrel and case storage. The hearing was adjourned without a date. The question then arose, if wine-making is only a minor use of the building, is that allowed under Town code? Should wine-making be the main principal use of a winery, with the wine-tasting and retail sales clearly accessory? Where is the tipping point? Section 280-4 of the Town code, which provides zoning definitions, contains no definition for winery, or any other terms that the Planning Board usually encounters when dealing with winery applications, such as, "wine production," "tasting," or"tasting room." The Town Code states the definition contained in Webster's Third New International Dictionary of the English Language, unabridged(or latest edition) shall be used when a word or term is not defined in section 280-4 of the Town Code. In many cases, the Webster's definition is of little help. For example, Webster's simply defines a "Winery" as "a building or structure where wine is made." The regulations addressing the winery use under the Town Code provide few details. Section 280-13 A(4) allows wineries that meet the following standards: (a) The winery shall be a place or premises on which wine made from primarily Long Island grapes is produced and sold, (b) The winery shall be on a parcel on which at least 10 acres are devoted to vineyard or other agricultural purposes, and which is owned by the winery owner, (c) The winery structures shall be set back a minimum of 100 feet from a major road, and (d) The winery shall obtain Site Plan approval. Section 280-13 C`(10) further provides that wineries "may have an accessory gift shop on the premises which may sell items accessory to wine, such as corkscrews, wine glasses, decanters, items for the storage and display of wine, books on winemaking and the region and nonspecific items bearing the insignia of the winery" and that "wineries may not have a commercial kitchen as an accessory use but may have a noncommercial kitchen facility for private use by the employees." Therefore, as set forth above, although the Code states that a winery is a place where wine is produced and sold, the code is silent as to what constitutes wine making. At their Public Meeting on December 5, 2016, the Planning Board heard testimony that a winery is present when the following is true: a. Wine in bottles are stored on site (because wine is still being "made" in the bottle as it ages), or b. Wine fermenting in barrels are stored on site (with no other typical wine- making amenities such as a lab, crushing pad, separate septic system for process water). In rendering its determination, the Planning Board requests that the Zoning Board of Appeals address the following issues: • What specific activities must be present for the proposed building to be considered a winery? • Is there a minimum quantity of wine that must be made on site for the building to be considered a winery under Southold Town Code? • Section 280-13 A (4) provides that a winery is a place where wine is produced and sold. Is the retail sale of wine part of the principal winery use, or is it accessory to wine producing? • For wine to be sold at this site, is there any connection that must exist between the amount of wine made on site and the total amount of wine sold? For example, if the site only makes one barrel of wine a year, and much of what is sold is made off-site, is that a winery use allowed by the Town Code? The Surrey Lane application proposes a retail area with tastings. In addition, the Site Plan proposes an outside area where presumably tastings will occur. The Planning Board requests the Zoning Board of Appeals provide an interpretation with regard to "wine tastings" and "wine tasting rooms" for this project: • Are "wine tasting" or "wine tasting areas/rooms" part of the principal use of this winery? • Or are the wine tastings and wine tasting rooms/porches/terrace and gazebo allowed as an accessory use customary and incidental to the winery use? • Or is the tasting room considered part of the accessory gift shop allowed for wineries? • Is there any proportion of wine production area to tasting room area (inside and out) that has to be present on this site for it to meet the code for a winery? This proposal is for a very modest winery building for production and a tasting room. The property will be merged with the adjoining 43.73 acres of vineyard and farmland to which development rights have been sold,upon final Town permitting of the project. The applicant has farmed his vineyard for over five years, and is now in a position where he needs a retail outlet and on-site wine production to make his venture profitable. In order to accommodate the 2017 crop,he needs to move the approval process and construction forward. He has adjusted the plans to provide for a larger production facility in the lower level of the tasting room building. Per your staffs email request, enclosed are copies of the applicant's licenses: 1. NYS Farm Winery License, State Liquor Authority. 2. US ATT Permit to Establish and Operate Wine Premises 3. NYS Certificate of Authority, Sales Tax Article XXIV of the Southold Town Code("Code") specifies the issues which are to be reviewed by the Planning Board in considering a site plan: primarily traffic,parking, access, layout and certain aesthetics. Information requested in questions 1,3,4,6,14, 15, 18, 19, and 20 of the Letter are outside of the scope of site plan review, and will be addressed by the applicant in compliance with the requirements of the applicable regulatory authorities. The responses to the remaining,relevant questions are as follows: 2. Wine Production. The wine will be produced in the basement of the winery in both tanks and barrels,per revised Basement Floor Plan(Al). 5. Waste Water from Production. A separate waste water system is required for the proposed trench drain,per attached Basement Floor Plan(U1). 7. Vehicle trips: Vehicle trips for any winery vary depending upon the season,day of the week, and the popularity of the particular winery. Vehicle trips are dependent upon weather, product desirability, occupant load,the number of people traveling in each vehicle,the length of stay of each vehicle,the number of parking spaces required/provided,and the projected deliveries of supplies and pickups of wine cases. It is extremely difficult to estimate the number of vehicle trips per day for a start up such as the proposed operator. However, vehicle trips by visitors are necessarily limited to the capacity of the project as set forth in Question 8 below. Notwithstanding the variables set forth above,we believe vehicle trips for peak weekends can be estimated as: 18 parking spaces X 3 turnovers/day= 54 trips/day. Weekends for the rest of the year and weekdays will be significantly less. Vehicle trips for other than visitors can be estimated as five or six trips per day,Fall and Summer(employees and supplies/deliveries); two to three trips per week in Winter and Spring. None of the agricultural workers or agricultural vehicles will access the property from the winery driveway, as those vehicles will use other access points. 8. Number of visitors. The maximum number of people will generally be those that can be accommodated in the parking spaces (and, if necessary,overflow parking shown)provided, subject to the capacity of the project. 9. Occupancy of outdoor terrace,roof deck and covered porch/pavilion: According to the International Building Code 2015 (recently adopted by NY State)there is not a"maximum floor area allowances per occupant" for exterior ground floor areas as there is for interior functions as egress is not an issue. As a result,to determine the number of occupants for these areas, we have attached a floor plan indicating the number of tables and chairs that are possible. Other outdoor areas: No amenities are proposed for the outdoor lawn areas. 16. Food Trucks. Food trucks are not scheduled as of this time,but applicant reserves the right to employ them on site in accordance with applicable regulations. Parking will be provided within the parking area. 17. HD Classification of Farm Stand. The farm stand is categorized as a convenience store for purposes of sanitary flow,not proposed usage. The Suffolk County Department of Health Service's STANDARDS FOR APPROVAL OF PLANS AND CONSTRUCTION FOR SEWAGE DISPOSAL SYSTEMS FOR OTHER THAN SINGLE-FAMILY RESIDENCES lists uses for particular building types and uses. A Farm Stand use is not specifically listed and as a result we have used the closest match,Convenience Store/Market. See attached list. The Farm Stand will sell fruits,vegetables and farm canned products so it fits within that category to determine sanitary flow. 2'1. Kitchen. Currently a kitchen is not located within the Building, although"a noncommercial kitchen facility for private use by the employees"is permitted by the zoning code. 22. Buses and Limousines. At the last hearing,it was stated that buses and limousines would be allowed on site by appointment only. a. Buses will be allowed by prior appointment only,and only on days when the winery is not open to the public. This will allow sufficient area to park the buses in the parking area. The capacity of the project as well as the area of the parking area will,limit the number of buses. b. Limos will be allowed by prior appointment only,to be parked and maneuvered as indicated on the site plan in the parking area. Capacity and parking area will limit how many limos can be accommodated as space for individual cars must also be made available. c. Vehicles entering from the west. See attached drawing SP3. d. Oversized vehicle navigation is shown on SP3. The applicant believes that transportation by bus and limo is a safe and efficient method of transportation for the winery visitors and does not wish to preclude it,but has planned-for in order to avoid congestion of the parking area and the tasting room. 23. Driveway offset. The distance from the driveway to the intersection of Lower Road and NYS Rt 25. is approximately 130 feet; See attached drawing(SP3) 24. Traffic incident history is difficult to ascertain. We have been advised that the Southold Fire Department has experienced an accident history at Rt. 25 and South Harbor Road,,and Rt. 25 and Ackerly Pond Road; and that the incidents at Rt. 25 and Lower Road and those at Rt. 48 and Ackerly Pond Road are far fewer. Vehicles are able to turn North on Ackerly Pond Road to access Rt. 48, as shown on the attached aerial. Notwithstanding the unrelated nature of your other questions,we do wish to assure the Board that the applicant's proposal for a small, owner supervised winery is the example of what the 3 Town expects a local winery to be. He is focused on the viticultural aspects of the wine, and wishes to attract customers who are interested in the wine,not in consuming alcohol. He does not wish to be overrun by large groups which his staff and parking areas cannot properly accommodate. The grapes from which his wine are made will be sourced, and the wine to be produced and sold,will be in compliance with the Southold Town Zoning Code,NYS SLA, and NYS Ag&Markets regulations and his licensing. There are currently 25 acres of vineyard in active production on his farm, 17 acres of which were planted years ago by Ray Blum. The winery proposed is small and the property is of adequate size and appropriately zoned. To the South there is a small park, which will not be adversely affected, and further to the South the Catapano greenhouse facility. The farm is to the north. The Town sump is immediately to the east. We believe that the public hearing should be closed at your December 5,2016 meeting,as further delay will greatly prejudice the applicant. Agriculture continues to be a leading economic driver,in the town of Southold and provides the scenic background for Southold's rural quality of life. In order for agriculture to survive,it is critical that farming remains economically viable. Southold town needs to recognize that agriculture continues to evolve and move towards direct farm marketing such as on farm processing and value added products, including, but not limited to jams,jellies, cheeses, potato chips, wine and other alcoholic beverages. As farmers generate better returns on their crops from retail sales, it is imperative we provide them avenues to operate their businesses in the most profitable ways. If farmers are profitable it is a greater incentive for them to continue farming,pass their farms down to a younger generation, and keep the prime agriculture soils in the town utilized as working farmland. Recently, the delays in approvals for projects unfairly penalize agricultural businesses. The length of time between site plan submissions and receiving final approval for agricultural operations cannot be dragged out for months. As seasonal businesses, agriculture is on a tight schedule and postponements ultimately cause farmers to miss the opportunity to complete new plans to support their livelihood. Farmers need to capitalize on the local interest in buying locally produced products and adjust their business models in a timely fashion. The agricultural community remains open to proactively addressing all issues with the town through working groups, code changes and other means that do not stall the growth and evolution of the industry.
