This new structure will be located on an adjacent vacant parcel of land situate upland and out of the area Flood Zones on the property as noted above. Please consider the following: 1. The height of the proposed Accessory structure on the water side of the new Boat House is noted as 26'-7" above grade. This item should be reviewed by the Building Department to verify the need to address the overall height of an accessory structure. The average grade at the perimeter may already be compliant but the Building Department should confirm it. 2. The property where the Boat House will be constructed appears to have relatively steep slopes. Erosion & Sediment controls have been indicated on the plans but there should be apprehension given to establishing and maintaining these controls throughout construction and maintenance until'the site has reached final stabilization. 3. Drainage issues have been addressed with design calculations for containment of stormwater from the new roof structure. Additional drainage will also be required for the proposed gravel driveway. This item will be addressed when the building permit is applied for. 4. At this time, I have no other concerns related to engineering difficulties that could be addressed with regard to the construction of this proposed accessory structure on a vacant lot that is immediately adjacent to the lot with the existing Principal Dwelling. The subject land identified on the Suffolk County'Tax Maps as 1000- 10-4-7.1 is made up of lot numbers 22, 24 and 25 as shown on the Plan of the Peninsula at Fishers Island, filed with the Suffolk County Clerk March 11, 1913. This land is merged with land identified on the County Maps as 1000-10-4-9.3 is made up of lots numbered 21, 23, 79, and 80 on the aforementioned Plan, plus a right-of-way between lots 23 and 80. 'The subject land is separated by a 20-foot right-of-way. The total size is approximately 1.02 acre, according to a survey by Richard H. Strause dated October 6, 1997. This land nd intervening right-of-way were purchased by Elbert Burr in February 1964, together with a number of surrounding properties. In March 1974, Elbert Burr deeded the subject property, but not the intervening right-of-way, to his daughter, Bette Burr Spohn, and in October 1997 she sold the property to David and Anne Burnham. In April 1998, the property was transferred to the sole ownership of David Burnham. BASIS OF APPEAL: The Building Inspector issued a Notice of Disapproval on February 10, 1998, stating that the subject land being of nonconforming size in this R- 40 District and having both been owned by Bette Burr 'Spohn, is merged pursuant to Section 100-25A. Applicant's concern is that the action by Elbert Burr in 1974, deeding the two subject lands to Bette Burr Spohn and deeding certain surrounding lots to other daughters, created lots that are not large enough to be recognized pursuant to Section 100-24A-1 of the Zoning Code. REASONS FOR BOARD ACTION and RESOLUTION/ACTION: On the basis of the testimony presented and personal inspection, the Board made the following findings: 1. The waiver would recognize a lot that is not,consistent with the size of lots in the neighborhood because County Map Parcel #1000-10-4-7.1 would be dissected from a larger parcel of 4+- acres presently improved with one (1) single-family dwelling .as shown on the Counly Tax MaDs as Nos. 7.1 9.3 7.2. 7.4 and 8 combined, and also dissects Lot 1000-10-4-9.3 from a larger parcel of 1.50+- acre undeveloped land, now identified on the County Tax Maps as 9.3, 7.11 9.2, and 9.4 (merged). 3. The waiver requested by applicant will not avoid economic hardship for the application because a waiver of the merger of No. 7.1 from No. 9.3 will not only create two vve small nonconforming lots but will also strip the merged parcel (Nos. 7.1 and 9.3) of its waterfront property and greatly impact the economic value of the whole parcel. The waiver alternatively granted by the Board will avoid economic hardship for the applicant because a waiver of merger, leaving 71 and 9.3 combined as a single lot separate from the remainder of the surrounding lots does create a lot that is 1.02+- acre in size although a large pgrtion is wetland area unusable for building purposes. 4. Hedge and Frances G.Thorp, made by Chandler&Palmer, Engineers, Norwich, Conn. 1913", which map was filed in the Office of the Suffolk County Clerk on March 11, 1913, file No. 223, said real property being more particularly described on Schedule A hereto; and WHEREAS, a predecessor in title to the Declarants previously made application to the Board of Appeals of the Town of Southold for a waiver to cause two merged lots, each consisting of several lots as shown on the aforementioned Plan of Peninsula and described on Schedule A hereto as Parcel I and Parcel II, to be recognized as separate building lots by the Town of Southold; WHEREAS, the Board of Appeals granted alternative relief whereby such Parcel I and Parcel II would be recognized as a single building lot; WHEREAS, for and in consideration of said granting of relief, the Board of Appeals of the Town of Southold has deemed it to be in the best interests of the Town of Southold and the owner and prospective owners of said Parcel I and Parcel II that the within covenants and restrictions be imposed on said Parcels and, as a condition of said 1 approval, said Board of Appeals required that the within Declaration be recorded in the Office of the Suffolk County Clerk; and WHEREAS, the Declarants have considered the foregoing and determined that the same will be for the best interests of the Declarants and subsequent owners of said Parcels; NOW, THEREFORE, THIS DECLARATION WITNESSETH: That the Declarants, for the purpose of carrying out the intentions above expressed, do hereby make known, admit, publish, covenant and agree that the said Parcel I and Parcel II described on Schedule A hereto shall hereinafter be subject to the following covenants which shall run with the land and shall be binding upon all purchasers of said premises,theirheirs,executors,legal representatives,distributees,successors and assigns, to wit: 1. We own a home on the Peninsula on combined lots 11-16 and the adjoining lots to Brad Burnham's lots No. 77 and 78. We also own all the unpaved roads on the Peninsula. As we see it,the plan submitted for the boathouse(storage building)is in a bad location for several reasons. The lot is one of the smallest on the Peninsula as measured from the road to the water. The footprint of the proposed structure with building and shoreline setbacks seems to make the plan very questionable. The lot has severe grades as it slopes off to the shoreline. We also cannot understand how the proposed dock,which stretches over many feet of very fragile tidal grass wetlands located in the rear of Darbies Cove, could be constructed without doing considerable permanent damage to the wetlands and possibly cause flooding of the lower part of our lots 15 & 16. If I understand the appeals process, the applicant also needs to show financial hardship. Thank you for your consideration of our concerns.
