Bredemeyer, III, President Board of Trustees RE: Variance Application of Southold Sunsets, LLC—#69 Pending Coastal Erosion Hazard Area(CEHA) and Wetland Permit The Southold Town Trustees held a public hearing on the above referenced application for CEHA and Wetland permit,on June 22, 2016 and have closed the public hearing while extending the time to accept written comments to the record of the applications until July 15, 2016. The Trustee's office in reviewing the applications with the Principal Building Inspector, Mike Verity, have found that the application and plans erroneously state the project lies within the AE Flood Zone and not the VE-13 FEMA flood zone as mapped. The applicant has been apprised of this error at the hearing and a correction'requested. The Trustees have also asked the applicant to provide an additional scale elevation drawing of the house to better enable the Board to visualize construction in the VE-13 zone from native grade to the peak of the roof. The Board will not schedule an additional work session discussion on this project until these materials are received and will forward our written comments to your Board after the Trustees have concluded the review of the public hearing record,the review of the corrected application and placed into consideration the issuance or denial of the requested permits. At this time it is doubtful whether this process will render a report to your office in time to review ahead of your August 4, 2016 public hearing. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposed action is recommended as INCONSISTENT with the LWRP This recommendation was based on the following: The purpose of Chapter 111, COASTAL EROSION HAZARD AREAS is to regulate, in coastal areas, land use and development activities so as to minimize or prevent damage or destruction to man-made property, natural protective features and other natural resources and to protect human life. In addition, the purpose of Chapter 111 is to regulate new construction or placement of structures in order to place them a safe distance from coastal hazard areas. § 111-4. Purpose. The Town of Southold hereby assumes the responsibility and authority to implement and administer a Coastal Erosion Management Program within its jurisdiction pursuant to Article 34 of the New York State Environmental Conservation Law. In addition, it is the purpose of this chapter to: iuw A. Establish standards and procedures for minimizing and preventing damage to structures from coastal flooding and erosion and to protect natural protective features and other natural resources. B. Regulate, in coastal areas subject to coastal flooding and erosion, land use and development activities so as to minimize or prevent damage or destruction to man- made property, natural protective features and other natural resources and to protect human life. C. Regulate new construction or placement of structures in order to place them a safe distance from areas of active erosion and the impact of coastal storms to ensure that these structures are not prematurely destroyed or damaged due to improper siting, as well as to prevent damage to natural protective features and other natural resources. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 1. Avoid development other than water-dependent uses in coastal hazard areas. Locate new development which is not water-dependent as far away from coastal hazard areas as practical. The proposed action does not have a functional relationship to coastal waters and therefore is not a water-dependent use pursuant to § 275-2. § 275-2 Definitions; word usage. WATER-DEPENDENT USES --An activity which can only be conducted on, in, over or adjacent to a water body because such activity requires direct access to that water body, and which involves, as an integral part of such activity, the use of the water. The uses include, but are not limited to commercial and recreational fishing and boating facilities, finfish and shellfish processing, fish storage and retail and wholesale fish marketing facilities, waterfront dock facilities, shipyards and boat-building facilities, navigation aides, basins and channels, industrial uses dependent upon waterborne transportation or requiring large volumes of cooling or processing water and which cannot reasonably be located or operated at an inland site, and uses which primarily provide general public access to marine or tidal. waters. a. No development is permitted in natural protective feature areas, except as specifically allowed under the relevant portions of 6 NYCRR 505.8. The proposed action is located entirely within the coastal erosion hazard area and the primary dune, a natural protective feature. A primary dune is defined in § 111-6 Definitions as a natural protective feature. NATURAL PROTECTIVE FEATURE--A nearshore area, beach, bluff,,primary dune, secondary dune or marsh and their vegetation. PRIMARY DUNE-- The most waterward major dune where there are two or more parallel dunes within a coastal area. Where there is only one dune present, it is the "primary"one. Occasionally one or more relatively small dune formations exist waterward of the primary dune. These smaller formations will be considered to be part of the "primary dune"for the purposes of this chapter. The waterward limit of a primary dune is the landward limit of its fronting beach. The landward limit of the primary dune is 25 feet landward of its landward toe. b. Avoid hazards by siting structures to maximize the distance from Coastal Erosion Hazard Areas. LIDAR mapping indicates that the residence is built on the major dune or primary dune in the area. The parcel is restricted in buildable area and the exposure and threats from storm damage and potential loss is high, therefore the action does not meet the LWRP policies. The Disapproval letter (attached) was issued referencing a 24,829 square foot parcel (0.57 A) and based its disapproval for minimum front and side yard setbacks in conformance to Section 280-124, requiring a 40ft. front yard and a 15 foot side yard setback. However, by deed, the owner has title to 13,827 square feet (0.32 A). See attached Schedule A description from the deed. I brought this to Damon's attention, but he informed me he had to adhere to the lot size in the Town records and could not alter the Disapproval letter. The difference can be corrected, but in a different forum and is mutually exclusive to the application before you. The Applicant's deed entitles him to 0.32 A, nothing more. Any correction of Town records would, out of legal necessity, be brought into conformance with the deed description. As such, the application has been prepared in relation to the 0.32A parcel and can be presented for a hearing since the Town's records would inevitably be changed to match the deed.. The proposed improvements meet the 20% maximum for density and is not an issue before the board. and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations; and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP under Policy 4.1-minimize losses of human life and structures from flooding and erosion hazards, and Policy 4.2-Protect and restore natural protective features, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 19, 2015, on June 22, 2016, and again on July 20, 2016, at which time all interested persons were given an opportunity to be heard; and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area; and, 2 - WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application; and, 4(,OR& WHEREAS, the proposal of SOUTHOL® SUNSETS LLC seeks to construct a new home on a primary dune and beach as defined by Chapter 275 Wetlands and Shorelines; and, WHEREAS, the proposal consists of a two-story house in excess of 3,300 square feet of living space and seeks to replace a one-story residence of 916 square feet; and, WHEREAS, flood plain requirements compel any new house construction on this lot to have a first floor elevation at a minimum of 13 feet; and WHEREAS, the proposed house with its additional second floor may be higher than the existing home by nearly 18 feet blocking sunshine from the south, it will cause increased shading of the beneficial vegetation of the dune and beach adversely affecting these natural protective features recognized as part of the Long Island Sound Estuary and associated wetlands; and, WHEREAS, the primary dune will receive insufficient sunlight during the growing season and subsequently may not be able to recover from the impacts associated with severe winter weather and storms frequenting the southern shore of Long Island Sound; and, WHEREAS, the entire Board of Southold Trustees has inspected homes of similar height in relation to the primary dune wherein portions of the primary dune were shaded for as much as seven hours a day and appear to be distressed; and, WHEREAS, the additional height associated with the addition of a second story is a self-imposed hardship as opposed to the additional height necessary associated with construction to FEMA standards; and, WHEREAS, any destruction of dune and dune vegetation associated with house construction or ongoing negative impacts may weaken the lateral support of lands in the vicinity including public facilities; and, WHEREAS, the project seeks to develop a much larger house on a parcel that does not directly access the public road proper, but a beach parking lot, thereby raising issues of safety, health and welfare of residents and first-responders with a sworn obligation to protect lives and property even during storm events; and, WHEREAS, the project will adversely affect the aesthetic values of the wetland and adjacent areas including a public bathing beach; and, WHEREAS, this proposed greatly enlarged residence immediately contiguous to and looming over a public bathing facility imputes additional beach and foreshore user access conflicts; the President of the Trustees again visiting the site on July 13, 2016; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 19, 2015,_on June 22, 2016, and again on July 20, 2016, at which time all interested persons were given an opportunity to be heard; and, WHEREAS, the application of SOUTHOLD SUNSETS LLC has been found to be a Type 11 action pursuant to the State Environmental Quality Review Act; and, WHEREAS, the proposed activity of SOUTHOLD SUNSETS LLC has been found to be wholly within the Coastal Erosion Hazard area, having been found to be seaward of the Coastal Erosion Hazard area line during the review of the application and field inspections; and, WHEREAS, the proposed activity lies within a region best characterized as a low profile vegetated primary dune and beach; and, WHEREAS, the proposed activity lies within 100 feet of the unconsolidated earth and open sandy beach of Long Island Sound, therefore qualifying the site as "beach" under Chapter 111; and, WHEREAS, non- major additions to existing structures are allowed on primary dunes pursuant to a coastal erosion management permit pursuant to 111-13A(5), which may allow expansion less than 25%; and, WHEREAS, the existing house has one floor and the proposed home two; and, WHEREAS, the addition of a second story and construction to FEMA flood standards will likely result in home construction in excess of 18 feet higher than the existing house; and, WHEREAS, the existing primary dune consists of a plant community of American Beach Grass Ammophila brevigulata, Seaside goldenrod Solidago sempervirens, Beach pea Lathyrus maritimus, all known to require full sun as characterized by the USDA plant lists; and, WHEREAS, this primary dune is linked to a secondary dune and connecting swale which is a globally rare ecological unit; and, WHEREAS, the siting of the proposed house within the primary dune will result in extensive shading of the primary dune's flora; A number of very serious issues have come to the fore as a result of the review of this application, not unique to it, which are likely to repeat, such as the inability of any Town agency to compel a DEIS for development activities proposed within the CEHA due to NYSDEC SEQRA rules changes of 1996,whereby this sort of activity is mandated as a Type II action and presumed to have no statewide impact on the environment,this in stark contrast to the express leglislative and regulatory intent of NYS in adopting CEHA to severely limit development on beaches and dunes wthin the CEHA to protect natural resources and the environment.The Town willingly adopted CEHA on behalf of NYS to maintain home rule and protect our shorelines ourselves. However,this unfunded mandate and subsequent SEQRA rules change tie our hands by imputing such projects will not have a significant impact on NYS's environment, compelling local government to regulate development in a fragile coastal environment with a the law it has undermined for convenience. This posture of NYS is so internally and externally inconsistent with sound environmental planning and our Town's Master Plan and goals that the Town Board may desire to provide additional zoning protections to preclude monster rebuilds within or immediately adjacent to the CEHA zone. I fear this type of application is becoming the new norm for our coastlines,with many more to come.These sorts of proposals well beyond the ability of a part time Board of Trustees to manage without additional resources in the form of staff and or supportive legislation or both. The Notice will be published in the next issue of The Suffolk Times. 1) Before April 18th: Please send the enclosed Legal Notice, with both a Cover Letter including your telephone number and a copy of your Survey or Site Plan (filed with this application) which shows the new construction area or other request, by CERTIFIED MAIL, RETURN RECEIPT REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or improved, which abuts and any property which is across from any public or private street. Use the current owner name and addresses shown on the assessment rolls maintained by the Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If you know of another address for a neighbor, you may want to send the notice to that address as well. If any letter is returned to you undeliverable you are requested to make other attempts to obtain a mailing address or to deliver the letter to the current owner, to the best of your ability, and to confirm how arrangements were made in either a written statement, or during the hearing providing the returned letter to us as soon as possible; AND not later than April 25th: Please either mail or deliver to our office your Affidavit of Mailing (form enclosed) with parcel numbers, names and addresses noted, along with the green/white receipts postmarked by the Post Office.
