Dear Mr. Generosa:
The Southold Town Board of Trustees reviewed the survey prepared by Nathan Taft
Corwin, III Land Surveyor, dated October 26, 2012, and determined that the proposed
elevation of the existing dwelling on the captioned property is out of the Wetland
jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town
Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required.
Please be advised, however, that no clearing, no removal of vegetation, no cut or
fill of land or removal of sod, no construction, sedimentation, or disturbance of
any kind may take place within 100' landward from the top of the bluff, or seaward
of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the
coastal erosion hazard area as indicated above, without further application to,
and written authorization from, the Southold Town Board of Trustees pursuant to
Chapter 275 and/or Chapter 111 of the Town Code.
It is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result
from your project. Such precautions may include maintaining adequate work area

between the tidal wetland jurisdictional boundary and the coastal erosion hazard area
and your project or erecting a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Dear Sirs:
Please be advised that my office represents the Irrevocable Trust of James P. O'Neill and
Lynn M.C. O'Neill,Trustee,the owner of the single-family home located at 205 Fishermans
Beach Road, Cutchogue. The trust is participating in the New York Rising Elevation Program
and the Governor's Construction Program after sustaining damage in Super Storm Sandy. As
such,we are undertaking the required steps to obtain permits for the elevation project. It is my
understanding that the Board of Trustees has jurisdiction over projects that are within 100 feet of
tidal wetlands.
Submitted herewith please find the following:
1. Architectural plans of the proposed elevation project as designed by the trust's architect,
Mark A. Schwartz,AIA;
2. A recent survey prepared by Nathan Corwin that illustrates the distance from the nearest
tidal wetlands,Haywaters cove; and
3. A check for$50.00 to cover the fees for review.
As the enclosed documents illustrate,the home to be elevated is approximately 119 feet from the
nearest tidal wetlands,Haywaters Cove. Please advise if the Board of Trustees has jurisdiction

until the Trust's involvement in the reconstruction,refinbishment,elevation,and rehabilitation of the
subject property is complete or July 31,2018,whichever is sooner.
(h) CERTAIN GIFT TRANSACTIONS:STATUTORY GIFTS RIDER(OPTIONAL)
In order to authorize your agent to make gifts in excess of an annual total of$500 for all gifts
described in(I)of the grant of authority section of this document(under personal and family maintenance),
