Lewis Attn: Tom Lucak of Beixedon Estate PO Box 1432 Southold, New York 11971 ACTIVITY: Construct one (1) new 45-linear-foot low profile jetty and,one (1) new 60-linear-foot low profile jetty. The structures will extend approximately 3,5 and 20 linear feet respectively, in to-the waterway from the Mean Low Water line. The purpose of this project is to re-establish the beach area. WATERWAY: Southold Bay, a tributary of Little,Peconic Bay LOCATION: 885 Rogers Road, Town of Southold, Suffolk County, New York As this is minor in'nature, authorization may be by Letter of Permission. This is in accordance with current Federal Regulations governing work in navigable waters of the United States. To accomplish the coordination required, prior to the issuance of a Letter of Permission, your review of the enclosed drawings is requested. LEWIS, c/o TOM LUCAK 885 ROGERS ROAD, SOUTHOLD SCTM# 1000-66-2-39 Dear Ms. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, February 15, 2017 regarding the above matter: WHEREAS, Costello Marine Contracting Corp. on behalf of ESTATE OF GRACE R. LEWIS, c/o TOM LUCAK applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, original application dated January 13, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP under Policy 6.3 - Protect and restore tidal and freshwater wetlands, and Policy 4.2 - Protect and restore natural protective features of the LWRP strives to minimize interference with natural coast process (littoral drift), however, limited interference could be undertaken if the benefits are proven and necessary if certain parameters are met; and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 15, 2017, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the request to construct one (1) 45' long low-profile jetty and one (1) 60' long low-profile jetty, does not comply with the standards set forth in Chapter 275 of the Southold Town Code, and, WHERAS, the Board has determined that the application to construct one (1) 45' long low-profile jetty and one (1) 60' long low-profile jetty, will have a detrimental effect upon the health, safety and general welfare of the people of the town, the existing road runoff at that road end is a major issue that needs to be addressed, and pursuant to Chapter 275-11 C(1)(f) of the Southold Town Code - the proposed operations are permitted unless the work results in a net decrease in the total number of jetties in the subject area; NOW THEREFORE BE IT RESOLVED that the Board of Trustees DENIES WITHOUT PREJUDICE the application of WEST LAKE ASSOCIATION, INC. to construct one (1) 45' long low-profile jetty and one (1) 60' long low-profile jetty; and as depicted on the site plan prepared by Costello Marine Contracting Corp., last dated December 19, 2016. Lewis and c/o Tom Lucak. We are strongly opposed to this project because of the erosional impact it will have on our property(1890 Arshamomaque Avenue,Southold). The construction of 45' and 60'jetties to our west should not be allowed to be constructed. Our property to the east and the Hippodrome Pond Estuary to the west of these proposed structures will be severely environmentally impacted. We have already lost over 3ft. of elevation due to the construction of the Nickles 300 ft.jetty to our east as indicated by a comprehensive survey done in February, 2008 and another survey done in 2010. Our property would then be starved from sand in both east and west directions if this proposed jetty project is approved. If this project is permitted,we will be forced to bring legal action against Southold Town Trustees and the Estate of Grace R. Lewis, and Tom Lucak. We request that this letter be read at the Trustees Hearing on February 15, 2017, as we are out of town and will not be able to attend the meeting tonight. Protect and restore natural protective features of the LWRP strives to minimize interference with natural coast process (littoral drift), however, limited interference could be undertaken if the benefits are proven and necessary if certain parameters are met. The beach has eroded greatly reducing the ability to even walk along the shoreline during all tide cycles. We want to stabilize the beach by constructing two small, low profile jetties. We are confident that the addition of these minor structures will result in sand build up. This will allow continued communal use of the beach and protect further erosion of this property.
