The following action was taken of the Southold Town Board of Trustees regular meeting held on
Wednesday, March 22, 2017:
RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a Transfer of
Wetland Permit #679 from Anthony R. Villano to Bruce Sands & Sara Karp Sands, as issued on
September 20, 1971; and
BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVE the
Administrative Amendment to Wetland #679 for the as -built docking facility consisting of a
5'x33.3' catwalk with a 7.3'x7.9' fixed catwalk extension including a bench at seaward end; a
3'x14' adjustable ramp; and a 6.2'x14.4' floating dock with two (2) floating dock support piles,
and as indicated on the survey prepared by Kenneth M. Woychuk Land Surveying, PLLC, dated
November 15, 2016, and stamped approved on March 22, 2017.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

INSTRUCTIONS
A. This application to be completely filled in by typewriter or in ink and submitted to the Town Trustees in dup-
licate.
B. Plot plan showing location of lot and buildings on premises, relation to adjoining premises, public streets, parks.
etc., and giving detailed description of proposed layout of project must be drawn on diagram which is part of this
application.
C. The work covered by this application may not be commenced before the issuance of a permit.
D. Upon approval of this application, Town Trustees will issue a permit to applicant. Such permit shall be kept on
the premises and available for inspection at all times.
E. Applicant shall notify the Board of Trustees upon completion of the work covered by permit.
APPLICATION IS HEREBY MADE to the Board of Trustees of the Town of Southold, Suffolk County, New
York, for the issuance of a permit pursuant to the laws, Ordinances and regulations governing construction of: docks,

L That there shall be no unreasonable interference with navigation as a result of
the work herein authorized.
2. That there shall be no interference with the right of the public to pass and
repass along that portion of the beach between low and high water mark.
3. That the work shall be subject to the supervision and approval of the said
Board of Trustees or its agents.
4. That if future operations of the Town of Southold require the removal and/or
alteration in the location of the work herein authorized, or if, in the opinion
of the Board of Trustees of the Town of Southold, such work shall cause un-
reasonable obstruction to free navigation, the said . Anthony. R... Villano
will be required upon due notice from the said Board of Trustees, to remove
or alter the location of the wore hereby authorized without expense to the
Town of Southold, so as to render navigation reasonably free and unobstruct-
ed.

The authority conferred by this permit may be terminated by the Board of Trustees

of Wetland Permit #679 from Anthony R. Villano to Bruce Sands & Sara Karp Sands, as issued on
August 9, 1971; and for an Administrative Amendment to Wetland Permit #679 for the as -built docking
facility consisting of a 5'x33.3' catwalk with a 7.3'x7.9' fixed catwalk extension including a bench at
seaward end; a 3'x14' adjustable ramp, and a 6.2'x14.4' floating dock with two (2) floating dock support
piles. Located: 2080 Deep Hole Drive, Mattituck. SCTM# 1000-123-4-3
The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town
of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions
The dock structure was constructed without a Chapter 275 Wetlands Permit.
Further, the applicant fails to prove that the action meets the following requirements
§ 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code.
9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and
the Town of Southold.
A. Limit grants, leases, easements, permits or lesser interest in lands underwater in
accordance with an assessment of potential adverse impacts of the proposed use, structure,
or facility on public interest in public lands under water.
The applicant enjoys access to the water via a previously permitted dock. Extensions
of private, residential, dock structures in public trust lands and/or waters results in a
net loss of public use of such lands and waters.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
