Villano to Bruce Sands & Sara Karp Sands, as issued on September 20, 1971; and BE IT FURTHER RESOLVED, that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Wetland #679 for the as -built docking facility consisting of a 5'x33.3' catwalk with a 7.3'x7.9' fixed catwalk extension including a bench at seaward end; a 3'x14' adjustable ramp; and a 6.2'x14.4' floating dock with two (2) floating dock support piles, and as indicated on the survey prepared by Kenneth M. Woychuk Land Surveying, PLLC, dated November 15, 2016, and stamped approved on March 22, 2017. Any other activity within 100' of the wetland boundary requires a permit from this office. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions The dock structure was constructed without a Chapter 275 Wetlands Permit. Further, the applicant fails to prove that the action meets the following requirements § 275-11 Construction and operation standards C. 2 (d) of the Southold Town Code. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The applicant enjoys access to the water via a previously permitted dock. Extensions of private, residential, dock structures in public trust lands and/or waters results in a net loss of public use of such lands and waters.
