Box 1179 Southold, NY 11971 Telephone (631) 765-1892 Fax (631) 765-6641 A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex, Capitol One Bank Building, First Floor Conference Room, 54375 Main Road at Youngs Avenue, Southold on Thursday, April 20, 2017 commencing at 5:00 P.M. Present were: Leslie Kanes Weisman, Chairperson/Member Gerard P. Goehringer, Member Nick Planamento, Member Eric Dantes, Member Kim Fuentes, Zoning Board Assistant Damon Hagen, Assistant Town Attorney (for executive session until 5:45 p.m.) Absent: Patricia Acampora, Member Call to Order at 5:04 P.M. by Chairperson Weisman. 5:07 p.m. Motion was offered by Chairperson Weisman, seconded by Member Goehringer to enter Executive Session for Attorney/Client advice. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Acampora was absent. EXECUTIVE SESSION: A. Attorney/Client advice. '5:45 p.m. Motion was offered by Chairperson Weisman, seconded by Member Goehringer to exit Executive Session. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Acampora was absent. Page 2 — Minutes Special Meeting held April 20, 2017 Southold Town Zoning Board of Appeals WORK SESSION: 1. Requests from Board Members for future agenda items. 2. Southold Sunsets #6951— withdraw application pursuant to Applicant's Attorney's request in email dated April 18, 2017. 3. Elizabeth Branch ZBA #7010. 4. Board Member Annual Training to be scheduled. POSSIBLE RESOLUTION TO CLOSE THE FOLLOWING HEARINGS MATTEBELLA VINEYARDS #7041 - Request for Variances under Article III, Section 280- 14 and Section 280-15; and the Building Inspector's November 16, 2016, Amended January 27, 2017 Notice of Disapproval based on an application for permits to legalize seven (7) "as built" residential and agricultural related buildings, and to allow both residential and winery uses upon a 134,246 sq. ft. developable portion of a parcel at: 1) building nos. 3, 4, 5, 6, 9 and 14 are located less than the code required side yard minimum setback of 20 feet; 2) building no. 14 is located less than the rear yard minimum setback of 75 feet; 3) residential accessory structure, building no. 2, located less the code required side yard minimum setback of 25 feet; 4) residential and winery uses upon a single parcel less than the minimum allowed 160,000 sq. ft. in total area, at: 46005 Main Road, Southold NY. SCTM#1000-75-2-15.1 & 15.2. BOARD RESOLUTION: Motion was offered by Chairperson Weisman, seconded by Member Goehringer to adjourn the Public Hearing to May 4, 2017. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Acampora was absent. DILIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: The Board continued with agenda items, and commenced deliberations on the following applications. The original determinations of each of the following applications as decided are filed with the Southold Town Clerk: APPROVE AS APPLIED WITH CONDITIONS SHELLY and LINDSEY SCOGGIN #7040 LAUREN MCCALL #7044 PAUL PAWLOWSKI #7042 MICHAEL AND SARA COLODNER #7043 JOHN FISCHETTI and DEBORAH DEAVER #7045 GRANT IN PART DENY IN PART, GRANT ALTERNATIVE RELIEF W/CONDITIONS CAPTAIN RED'S MARINE SALES. INC. #7014 Page 3 — Minutes Special Meeting held April 20, 2017 Southold Town Zoning Board of Appeals Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Acampora was absent. TABLED RESOLUTIONS: MARIALICE DOYLE #7033 — Motion offered by Chairperson Weisman, seconded by Member Dantes, that matter be TABLED until applicant has received a certificate of occupancy for in -ground swimming pool. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Acampora was absent. TOWN OF SOUTHOLD PLANNING BOARD/ACKERMANN AGRICULTURAL BARN #7037 — Motion offered by Chairperson Weisman, seconded by Member Dantes, that matter be TABLED until May 4, 2017. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Acampora was absent. RESOLUTIONS: A. RESOLUTION ADOPTED: Motion offered by Chairperson Weisman, seconded by Member Goehringer, to authorize advertising of hearings for the next Regular Meeting to be held May 4, 2017 at 8:30 AM. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0). Member Acampora was absent. B. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Goehringer to approve minutes from April 6, 2017 Regular Meeting. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-0), Member Acampora was absent. There being no other business properly coming before the Board at this time, Chairperson Weisman declared the meeting adjourned. The meeting was adjourned at 6:30 P.M.
