The public hearing on this application was held on January 25, 1984.
Upon application of NORTH FORK BAPTIST CHURCH, by G.L. Horton, Box
21, New Suffolk, NY for a Variance to the Zoning Ordinance, Article III,
Sections 100-30(A) [1], 100-31, and Article XI, Section 100-118(D) & (E)
for permission to construct modular home containing less than 850 sq. ft.
of livable floor area and reinstating the use of this structure as a
one-family residence, exceeding the limit of dwellings permitted on this
parcel in this A-Residential and AGricultural District. Location of
Property: North Side C.R. 48, Mattituck, NY; County Tax Map Parcel
No. 1000-141-2-16, 17, 18, 19, 21, 21.1.
The board made the following findings and determination:
By this appeal, applicant seeks a variance to Article XI, Section
100-118(D) & (F) of the zoning code for permission to reinstate a
one-family dwelling use for a modular home which will replace an existing
nonconforming building structurally unsound due to a recent fire. The
building in question is situated near the center of the entire premises
and approximately 15' west of the side line of premises now or formerly
of Hannafin (Parcel No. 1000-141-2-3) and approximately 37.5 feet from
the rear line of premises now or formerly of Catalano (Parcel No.
1000-141-2-4). Applicant also seeks a variance from Article III, Section
100-31, Bulk Schedule, of the zoning code which requires a minimum of
850 sq. ft. of livable floor area for a new dwelling structure, and a
variance from Article III, Section 100-30(A) [1] which limits the number
of dwellings permitted in this A-Residential and Agricultural Zone to
not more than one dwelling on each lot.
The premises in question is shown on the December 16, 1981 plan
for North Fork Baptist Church as a 3.5+- acre parcel and is improved
with the following existing structures: (1) church (2) two portable
structures (3) concrete basketball court (4) 1½-story frame house
northwest of the church (5) the subject 1½-story frame house in
poor condition.
For the record it is noted that this property was the subject of
a prior appeal dated March 3, 1983, under Appeal No. 3094, wherein
the insufficient area of one of the parcels was denied on May 27, 1983,
for the reasons stated therein.

Decision Rendered January 25, 1984
In considering this appeal, the board determines: (a) that
the use will not prevent the orderly and reasonable use of adjacent
properties or of properties in adjacent use districts; (b) that
the use will not prevent the orderly and reasonable use of permitted
or legally established uses in the district wherein the proposed use
is to be located, or of permitted or legally established uses in
adjacent use districts; (c) that the safety, health, welfare,
comfort, convenience or order of the town will not be adversely
affected by the proposed use and its location; (d) that the use
will be in harmony with and promote the general purposes and intent
of this chapter. The board has also considered items (a) through (1)
of Article XII, Section 100-121(C) [2] of the zoning code, which in
the board's opinion will not be affected since the subject dwelling
has been used as a dwelling continuOusly from the date of zoning. It
is also the board's opinion that practical difficulties have not been
shown to warrant relief from the 850 sq. ft. requirement of livable
floor area.
Now, therefore, on motion by Mr. Goehringer, seconded by Mr.
Grigonis, it was
RESOLVED, that Appeal No. 3197, application for the NORTH FORK
BAPTIST CHURCH, for permission to replace existing dwelling with a
modular home and reinstate the one-family dwelling use, BE AND HEREBY
IS APPROVED, PROVIDED THAT SAME HAVE A MINIMUM LIVABLE FLOOR AREA OF
850 SQUARE FEET.

III, Section 100-31, Bulk Schedule, for approval of lot having insuffi-
cient area and frontage along Westphalia Road, Mattituck, NY; County
Tax Map Parcel ID No. 1000-141-02-021.1.
The public hearing concerning this application was held on
March 23, 1983 and April 20, 1983, at which time the hearing was
declared closed pending deliberations.
The board made the following findings and determination:
By this appeal, appellant seeks a variance to Article III, Section
100-31, Bulk Schedule, of the Zoning Code for approval of a proposed
Lot #3 of this proposed three-lot Minor Subdivision located at Matti-
tuck, NY. Parcel No. 1 would contain an acreage of 2.14; Parcel No. 2
would contain an area of 40,013 square feet, and Parcel No. 3 would
contain an area of 20,000 square feet. Parcels 1 and 2 would have
a frontage along C.R. 48 of 243.96 feet and 254.36 feet respectively;
and Parcel No. 3 would have frontage along Westphalia Avenue of 100
feet.
Article III, Section 100-31, Bulk Schedule, of the Zoning Code
as amended May 16, 1983, requires a minimum lot area of 80,000 square
feet and a minimum lot width (road frontage) of 200 feet for parcels
in the "A" Residential and Agricultural District. It is noted for
the record that prior to May 16, 1983, the Bulk Schedule required a
minimum lot area of 40,000 square feet and a minimum lot width of
150 feet.
Upon inspection of the premises in question, the board finds
the following structures existing: Parcel 1: church, two portable
structures, 1½-story frame house, concrete basketball court and
an accessory building to the easterly most side; Parcels 2 and 3 are
vacant.
In considering this appeal, the board determines: (1) that
the variance request is substantial in relation to the requirements
of the zoning code (by more than 50%); (2) that the difficulty can
be obviated by a method feasible to appellant other than a variance;
(3) that the circumstances herein are not unique; and (4) that by

allowing the variance, detriment to adjoining properties may be
created.
It is also the findings of this board that the applicant has
demonstrated practical difficulties, and accordingly, the variance
must be denied.
On motion by Mr. Sawicki, seconded by Mr. Doyen, it was
RESOLVED, that Appeal No. 3094, application for NORTH FORK
BAPTIST CHURCH for approval of lot having insufficient lot area
and width, BE AND HEREBY IS DENIED.

tuck, NY; County Tax Map Parcel No. 1000-141-2-21.1.
Vote of the Board: Ayes: Messrs. Goehringer, Doyen, Doug-

was unanimously adopted.
RESERVED DECISION: Appeal No. 3121.
Application of ALFRED AND ZINA'HULL, 333 Pearl Street, New York, NY
10038, for a Variance to the Zoning Ordinance, Article XI, Section 100-
l18E for permission to reconstruct and alter existing building which
would exceed 50% of the fair market value of this structure, requiring
a variance to continue or reinstate a second-dwelling unit in this
"A-Residential" District, at 3630 Soundview Avenue, Peconic, NY; County
Tax Map Parcel No. 1000-68-04-004.
The public hearing on this matter was held earlier this evening, at
which time the hearing was declared closed pending deliberations.
The board made the following findings and determination:
This is an appeal from the Notice of Disapproval issued
by the building inspector dated April 6, 1983, wherein it is
the decision of the building inspector that "proposed recon-
struction and alteration ...to existing building as a second
living unit...would exceed 50% of the fair market value...a
variance is required for continued use .... " In a letter dated
March 29, 1983, the appellants herein were notified by the
same building inspector that because there have been no
sanitary facilities in this building, and this building has
been without electrical service since 1973, and since this
building has been completely gutted, that there has not been
a use of this structure and the structure to the west continu-
ously for more than two years.
At the hearing, the appellant stated: (1 that when they

A Variance to the Zoning Ordinance
,s requested for the rea~?~we would like to replace our building which was burned
in August with aam~ft~m~ modular home on a permanent foundation, we desire to use
the existing foundation with an addition to the North. We have recently hired a youth
pastor to work on our staff, it is our desire to develop a youth minister to minister to
the youth of our co,unity. We desire for this pastor to live on the premises so the
local youth would have access to him at anytime.

REASON FOR APPEAL Continued
'1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because
ge believe that in order to have an effective youth ministry, the teenagers must
have 24 hour access to the youth worker. Also he must be near the property to make
full use of the facilities which the churh has to offer, and saving time and money
in transportation costs. The church cannot afford to pay a youth worker the salary
he would need to find housing in the local housing market. This modular home has
been donated to us and is currently being lived in on a lot in Reydon Shores.
2. The hardship created is UNIQUE and is not shared by ail properties alike in the immediate
vicinity of this property and in this use district because We are the oz~y church in the
immediate area
