SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 6, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 23, 2017. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is the Coordinator's recommendation that the proposed action is CONSISTENT with the LWRP Policy Standards, and therefore, is CONSISTENT with the LWRP, provided that the Board considers and acknowledges the 10 feet wide landscape buffer shown on the site plan dated January 11, 2017, and established under Wetland Permit No. 8640 in any decision. PROPERTY FACTS/DESCRIPTION: The property is a code conforming 109,159 square foot waterfront parcel located in an R-80 Zoning District. This irregularly shaped parcel measures 693.02 feet along the easterly property line fronting a wetland area on Richmond Creek, 128.07 along the northerly property line, 196.18 feet along the southerly property line and 599.81 feet along the westerly property line fronting Wells Road. The parcel is improved with a one story single family dwelling with an attached garage and deck, a detached accessory garage with an attached patio, and an existing dilapidated shed as shown on survey prepared by John T. Metzger, LS, last revised August 4, 2014. Also submitted with the application is a site plan prepared by Thomas Samuels, R.A., dated January 11, 2017, that depicts the dilapidated shed to be removed, as well as existing and proposed improvements. BASIS OF APPLICATION: Request for Variance(s) from Sections 280- 15 and the Building Inspector's January 23, 2017 Notice of Disapproval based on an application for a permit to construct an accessory pool house at 1) located in other than code required rear yard; at 2615 Wells Road, (Adj. to Richmond Creek)Peconic,NY SCTM# 1000-75-2-15.1 & 15.2 Page 2,April 20,2017 #7045,John Fischetti and Deborah Deaver SCTM No. 1000-86-2-1.2 RELIEF REQUESTED: The applicant requests a variance to build a pool house in a side yard location where code requires that accessory structures be placed in the rear yard, or the front yard location on waterfront properties. ADDITIONAL INFORMATION: The applicants have the benefit of a prior ZBA variance Appeal No. 6854 which granted relief for a front yard setback of less than the required 60 feet for improvements and additions to a single family dwelling. The applicant's representative presented a letter he received from the New York State Department of Environmental Conservation (NYSDEC) dated October 13, 2015 which disapproves the applicant's request to place a swimming pool seaward of the dwelling, closer to the wetlands. Following input at the public hearing from the applicant's neighbors to the south, the applicant's architect/agent agreed to move the location of the required pool mechanical equipment from the shared southerly side yard and install it to the west of the proposed pool house. In addition, the Board of Town Trustees resolution dated March 23, 2016 is part of the application, which approved, among other improvements, a 200 sq. ft. pool house. In this current ZBA appeal, the applicant is proposing the pool house to measure 264 sq. ft. Accordingly, the applicant will be required to reapply to the Town Trustees to amend the wetland permit to permit the construction of the proposed 264 sq. ft. pool house. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 6,2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following fundings: 1. Town Law 4267-b(3)(b)(1). Grant of the relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's property is large in size and bordered by Richmond Creek to the east. The neighborhood consists of single family waterfront homes and the proposed pool house will be placed twenty feet from the side yard line and will not visually affect the neighborhood. Also, to mitigate opposition made by the neighbors to the south, the applicant's representative agreed to locate pool equipment alongside the west side of the pool house which would, in effect, be further away from neighboring property. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has a waterfront property. The NYSDEC has denied the placement of the pool and pool house seaward of the residence in a rear yard location. Placing the pool house in the front yard would also require the benefit of an area variance for a non-conforming front yard setback of less than 60 feet. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the placement of a pool and pool house on the subject property is limited by extensive wetlands and the pool house meets the required side yard setback of a principle structure. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code 5. Town Law &267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of relief as requested is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a pool house while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3,April 20,2017 #7045,John Fischetti and Deborah Deaver SCTM No. 1000-86-2-1.2 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried,to GRANT the variance as applied for, and shown on the site plan by Samuels and Steelman, Architects dated January 11, 2017 and architectural drawings labeled sheet 22. SUBJECT TO THE FOLLOWING CONDITIONS: 1) The pool equipment shall be located on the west side of the pool house and placed in a sound deadening enclosure. 2) Evergreen vegetation shall be planted for the purpose of visually screening the pool house from neighbors to the south and from the street. 3) A drywell for pool de-watering shall be installed. 4) An amended or new wetland permit granting a 264 sq. ft. pool house must be obtained from the Southold Board of Town Trustees. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. We object to the project as proposed because it does not meet the standards for permit issuance pursuant to 6NYCRR Part 661.9 (c)(1), (2) and (3) (Tidal Wetlands Regulations). We find that the current proposal will have undue adverse impacts on the present and potential values of the nearby tidal wetlands. These values include marine food production, wildlife habitat, cleansing of the ecosystem, absorption of silt and organics, and open space and aesthetics. Specifically, the proposed swimming pool and patio do not comply with the development restrictions of Part 661.6 which state that all structures must be a minimum of 75 feet from the tidal wetlands boundary. Your client's pool and deck are proposed within 50 feet of the tidal wetlands at the site, and we do not believe such a variance from this provision is warranted because the application does not adequately demonstrate that a practical difficulty exists which would preclude reasonable alternatives to the proposed project. This Department suggests that the applicant consider shifting the sanitary system to the front of the dwelling and exploring the possibility of constructing a pool in the southern side yard in order to meet the 75' setback requirement. The existing deck could be expanded up to the 75' setback line. The proposed additions to the existing dwelling are reasonable; however, the expansion of the dwelling will result in additional impacts to the nearby tidal wetlands. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 2,2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. The LWRP Coordinator issues an inconsistent finding regarding an accessory in-ground swimming pool which is,however, not before this Board. PROPERTY FACTS/DESCRIPTION: The parcel is a code conforming 109,159 square foot water front parcel located in an R-80 zone. The parcel is irregularly shaped with 693.02 feet of wetland frontage on Richmond Creek. The parcel runs 196.18 feet on the South side, 599.81 feet on Wells Road, and 128.07 feet on the North side. The parcel is improved with a residence, and existing garage, and an existing shed. The existing residence is located 57.5 feet off of Wells Road. All is shown on a site plan by Samuels and Steelman, Architects dated March 4, 2015. BASIS OF APPLICATION: Request for Variance from Article III Section 280-14 and the Building Inspector's March 3, 2015 Notice of Disapproval based on an application for building permit for additions and alterations to an existing single family dwelling, at; 1) less than the code required minimum front yard setback of 60 feet. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to a structure with a front yard setback of 56.8' feet where 60 feet is required per code. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 7, 2015 at which time written and oral evidence were presented. The existing residence has a non-conforming 57.5 foot front yard setback. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing structure has a non-conforming front yard setback. Further, the rear yard of the property borders Richmond Creek and tidal wetlands.
