MA ZBA FILE: 7044 uthold Town Clerk NAME OF APPLICANT: Lauren McCall PROPERTY LOCATION: 10643 New Suffolk Avenue, Cutchogue NY 11935 SCTM#1000-116-1-6 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 6, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 23, 2017. Based upon the information provided on the LWRP Consistency Assessment Form submitted, as well as the records available, it is the coordinator's recommendation that the proposed action is CONSISTENT with the LWRP Policy Standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The applicant's parcel is a conforming 132,371 square foot, irregular- shaped, waterfront lot located in the Agricultural Conservation (AC) Zoning District accessed by a private, 30 foot wide right of way. Lot coverage excluding flagged wetlands is approximately 60,561 square feet. Site access is over lands with a Peconic Land Trust Conservation Easement in place. The parcel measures 434.80 feet on the southern lot line with 242.96 feet along the private right of way on the western lot line and 299.46 feet along the northern lot line. The eastern lot line, shared with the Town of Southold, represents creek frontage and measures 36.17 feet, 160.17 feet, and 197.22 feet north to south. A single-family residence is located to the south. The right of way is part of the undeveloped lot to the north. The property is improved with a garage built prior to 1957 as shown on the survey prepared by John C. Ehlers, LS, dated September 9, 2016 and revised March 23, 2017. BASIS OF APPLICATION: Request for Variances under Article III, Section 280-14 and Section 280-15 and the Building Inspector's January 27, 2017 Notice of Disapproval based on an application for a permit to construct a single family dwelling and an accessory in-ground swimming pool, at: 1) proposed single family dwelling located less than the code required minimum front yard setback of 60 feet; 2) proposed construction places in-ground swimming pool in other than the code required rear yard; 3)proposed construction places existing accessory garage in other than the code required rear yard at: 10643 New Suffolk Avenue, Cutchogue,NY. SCTM#1000-116-1-6 Page 2,April 20,2017 #7044,McCall SCTM No. 1000-116-1-6 RELIEF REQUESTED: The applicant requests variances to construct a new dwelling that will result in a front yard setback of 44 feet where code requires a minimum of 60 feet, locating a swimming pool in a side yard where code requires location in the rear yard, and locating an existing garage in a side yard where code requires location in a rear yard. ADDITIONAL INFORMATION: The applicant's representative submitted to the Board a revised survey dated March 23, 2017 showing additional site details. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 6, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is part of a larger family compound consisting of irregularly shaped parcels containing wooded areas, open fields and salt meadow. The proposed dwelling and pool will not be seen from the road since it is accessed by a long right of way and will be located behind the existing garage, built prior to 1957, and the existing dwelling that fronts on New Suffolk Avenue. The front yard faces woods and vineyard and the rear yard faces wetlands and Down's Creek. The undeveloped lot to the north which shares a right of way also has additional road frontage on New Suffolk Avenue creating the potential for the applicant to be the sole user of the right of way. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant's lot consists of substantial wetlands with the building envelope limited to the western edge of the site. Working within strict confines presented by the NYS Department of Environmental Conservation and Town of Southold Trustees with regard to flagged wetlands and non-disturbance areas, the applicant proposes to increase the rear yard setback from the creek and thereby needs zoning relief from the front yard setback requirement of 60 feet. Additionally, the survey indicates that by placing the dwelling upland from the flagged wetlands they will benefit by Zone X flood rating. Without a typical rear yard placement of the pool can only occur in a side yard. The "as built" accessory garage has been in its current location since prior to zoning and will be located in a side yard when construction of the new dwelling is completed. 3. Town Law X267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 26% relief from the code. However, the 30 foot right of way along the applicant's frontage will make the front yard setback appear to be compliant with the required 60 feet setback. Furthermore, given the site requirements of the sanitary system and dry well placement, odd shape of the lot and setback from the creek, variances are required to allow the existing garage to remain. As a result of environmental requirements and site development previously addressed the pool can only be located in the side yard. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant acquired the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling with accessory garage and in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Planamento, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variances as applied for and shown on the survey prepared by John C. Ehlers, LS, and last revised March 23, 2017. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Pool mechanicals shall be placed in a sound deadening enclosure. 2. Drywell for pool de-watering shall be installed as shown on the approved survey cited above. 3. Approval from the Southold Board of Town Trustees and the NYS Department of Environmental Conservation are also required. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: ZONING BOARD OF APPEALS This property is part of the McCall family compound. Applicant's uncle, Robert McCall, owns the adjoining property on the South,which contains a cottage in its rear yard which, together with the existing garage on the subject property, blocks the view of the existing and proposed structures on applicant's lot. Therefore, applicant's structures l' will not be a detriment to Robert McCall's property. The applicant's property is wooded, which minimizes the impacts of the proposed construction. The two other nearby properties, owned by applicant's two brothers, are large lots (tax lot 4, 2.6 acres; and tax lot 3.1, 15.4 acres and restricted to one dwelling) where improvements can be constructed without being close to applicant's structures. The variance for the reduced front yard setback is along a private right of way servicing only one additional property,that of applicant's brother, who owns the flag on which the right of way is located as part of the 15.4 acre parcel (tax lot 3.1) and on which only one residence may be built. The structures are proposed to be built in an area of the lot where clearing has already occurred from construction of the pre-existing frame storage shed (which has been removed since the survey was completed) and the agricultural operations associated with the nearby McCall Ranch and Vineyards operation. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance,because: The placement of the residence and swimming pool is designed to maximize the distance of the residence and the swimming pool from the wetlands,to avoid the need to take down large trees north of the proposed house location, and to preserve the large rhododendrum grove on the south part of the property. The applicant feels that it is better from an environmental position to seek a front yard setback variance than to request a reduction of the Trustee's and DEC setbacks from the wetlands boundary. 3. The amount of relief requested is not substantial because: The setbacks of both structures is comparable to the setback of the existing garage and an existing storage building which has been used fairly intensively for farm use and will be removed. Since the 30 foot right of way will only be improved to a width of 15 feet for the use of only two residential properties, the visual impact of the setback from the road will be similar to that required by Code. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The topography is flat so no drainage issues will be created. The area where the variances are located is not visible from any public highway. This proposal maximizes the distance of the structures from the wetlands. The building area will be where ground disturbance and clearing has already occurred from prior usage. 5. Those approvals have expired, and the current 100 foot wetlands setback has resulted in the necessity of a variance.
