The applicant obtained variance relief from the Zoning Board on April 28, 2017 and July 21,2017 for a side yard setback and boat parking in the R-40 zone. One of the conditions of approval is that six(6) storage sheds on the property are required to be removed prior to the issuance of a building permit. The storage sheds contain tractors, engine parts,tools, and supplies and it is the owner's intention to relocate these items to the one-story storage building upon its completion. It is essential that these items remain stored outside of the elements and the purpose of the new storage building is to eliminate the sheds locating equipment and supplies in one location. Upon review of the approved 15 ft. side yard setback,the applicant needs to scale back the proposed storage building in order to efficiently maneuver boats and equipment. PROPERTY LOCATION: 9605 Route 25,Mattituck,NY 11952 SCTM# 1000-122-6-12 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 22, 2016, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD PLANNING DEPARTMENT: This application was referred to the Town of Southold Planning Board. In the board's response dated December 21, 2016, the Planning Board listed reasons for not supporting the applicant's request, citing concerns with compatibility with the zoning code, off-street parking availability and visual impacts of the proposed structure located in a residential area, among others. PROPERTY FACTS/DESCRIPTION: The property is a conforming 76,230 square foot parcel located partially in a Business Zoning District(frontage on Main Road) with the rear portion located in the R-40 Zoning District. The parcel measures 100.00 feet along NYS Route 25 (Main Road) on the southerly boundary; 815.77 feet on the easterly property line; 100.00 feet along the northerly property line contiguous to the MTA Long Island Railroad; and 799.57 feet on the westerly property line. The parcel is currently improved with a one Story Frame Building, six storage sheds, and one pole tent as shown on a survey prepared by John C. Ehlers, L.S., revised February 28, 2017. BASIS OF APPLICATION: Request for Variance(s) under Article XI, Section 280-49; Article XVIII, Section 280-78(1); and the Building Inspector's September 19, 2016, amended September 30, 2016, Notice of Disapproval based on an application for a building permit to construct a storage building and to propose boat storage and parking, at: 1) the proposed building is less than the code required front yard minimum setback of 100 feet; 2) the proposed building is less than the code required side yard minimum setback of 25 feet; 3) no off-street parking spaces shall be located in any residential zone district unless the use to which they are accessory is permitted in such district or upon approval of the Board of Appeals; located, at: 9605 Route 25, Mattituck, NY. Page 12, April 6,2017 #7014, Captain Red's Marine Sales SCTM No. 1000-122-6-12 RELIEF REQUESTED: The applicant requests variances to construct a boat storage building with a 95.5 foot front yard setback from the southerly property line along Main Road/NYS Route 25 where the code requires a 100 foot minimum setback and a side yard setback from the easterly property line of 5 feet where code requires a 25 foot minimum setback. In addition, the applicant requests off-street parking spaces as an accessory use for vehicles, boat trailers and boats to be located in the residential zoned portion of the subject property located to the rear of the parcel. ADDITIONAL INFORMATION: The applicant has the benefit of the following three prior variances: ZBA#397 which extended the Business Zoning District on the parcel; ZBA file # 3375 granted the applicant permission to erect a 6 foot by 2 foot advertising sign, and ZBA # 4681 granted a Special Exception Permit for the applicant to display, store, sell, and service boats on the Business zoned section of the property. Recent site inspections by Members of the Board of Appeals revealed that the applicant currently stores and parks boats and boat trailers on both the residential and business zoned portion of the subject property without ZBA approval. Additionally, boats are also being stored on the neighboring residential properties adjacent to the westerly property line which the applicant also owns (SCTM 1000-122-6-13, 14, 15, and 16), also without approval. Boats and trailers are also stored and displayed in the front yard landscaped area of the subject property and in the NY State Route 25 right of way. There are six storage sheds on the property which do not conform to town code side yard setbacks, all of which are proposed to be removed. The Board asked the applicant's agent to submit evidence documenting the need for a 5 foot side yard setback from the easterly side yard for the proposed storage building. On March 15, 2017, the Board received photos of various sized boats and a letter of explanation about truck and trailer access to the rear of the property and the maneuverability of boats and vehicles on the applicant's narrow lot. The agent also stated that the applicant is proposing to maintain current boat and vehicle storage along the westerly property line which narrows the space needed for maneuverability. The Board does not find this reason compelling enough to warrant granting the proposed 5 foot side yard setback, given the impacts to the adjoining properties, the degree of non-conformance to the code, and the approval granted herein of almost two-thirds (2/3`d,) of the subject property for off-street boat storage. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 5, 2017 and February 3, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-W)(b)(1). Grant of the variances for the front yard setback of the proposed boat storage building in the B Zoning District portion of the subject property and the outdoor storage of boats in the R-40 Zoning District portion of the subject property as an accessory to the principal business use, will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a mixed zoned neighborhood consisting of both residential houses and businesses. In addition to the subject business, the neighborhood includes a cell phone store, auto mechanic, ice cream store, pool supply store, restaurant, and the former Capital One bank headquarters. Behind the subject property is the Long Island Railroad train track. Dickerson's Marine, also a split zoned R40 and B zone parcel, is adjacent to the subject boat business along the applicant's easterly side yard. The proposed boat storage building will be located in the rear yard, 95 feet from the front (southerly) property line, behind an existing one story framed boat sales building which will lessen the visual impact from Main Road. The subject storage building will be closest to the easterly property line in the B zone where adjacent properties are primarily used for business purposes; and farthest away from the westerly property line where adjacent properties are primarily residential. Page 13,April 6,2017 #7014, Captain Red's Marine Sales SCTM No. 1000-122-6-12 Approval of the off-street parking of boats on the R40 portion of the subject property will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because of the conditions imposed herein and because the parking of boats and boat trailers is characteristic in this neighborhood. Grant of alternative relief for a 15 foot easterly side yard setback will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because it will create a more conforming setback to adjacent properties to the east and the building will be located entirely in the rear yard in the code permitted B zone. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than by area variances. There is an existing sales/office building that has a non- conforming front yard setback of sixty feet. The proposed boat storage building will be behind this building and the proposed non-conforming front yard setback keeps these two buildings in close proximity for operational purposes. The applicant has a special exception permit to operate a boat business and the applicant needs to be able to park boats and boat trailers on the split zoned subject property in order to operate the business. The benefit of a non-conforming side yard setback cannot be achieved without variance relief. The applicant has a narrow lot and requires a large building for boat storage. However, alternative relief for a fifteen foot side yard setback gives the applicant enough room to maneuver boats around the storage building on the West side while reducing the impact on residences and businesses to the east. 3. Town Law U67-b(3)(b)(3). The variance granted herein for the front yard setback is not mathematically substantial, representing 5% relief from the code. The alternative relief for the side yard setback is substantial representing 40% relief from the code. However, the applicant has a narrow lot and granting of this variance allows the applicant enough space to safely maneuver boats around the building. The approval of off-street parking of boats in the residential zoned portion of the parcel as an accessory use to the business operation in the B zone is not substantial because boats will be stored in the rear of the lot away from Main Road and will be subject to the conditions imposed herein. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The entire property will be reviewed by the town engineer to ensure compliance and site plan approval from the Planning Board is also required. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief for the front yard setback and the approval of parking boats in the R40 zone is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a storage building and boat business while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Granting of alternative relief for a 15 foot side yard setback is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a storage building with off-street parking. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance for the front yard setback of 95 feet and approval for off-street parking as an accessory use, as applied for, and shown on the survey prepared by John C. Ehlers, L.S., revised Feb. 28, 2017 and the undated, unsigned and unsealed building drawing by Shirk, LLC received March 15, 2017. DENY the side yard setback as Page 14,April 6,2017 #7014,Captain Red's Marine Sales SCTM No. 1000-122-6-12 applied for, and GRANT ALTERNATIVE RELIEF of a 15 foot side yard setback from the easterly property live. Subject to the following conditions: SUBJECT TO THE FOLLOWING CONDITIONS: 1) Site plan approval from the Southold Town Planning Board must be obtained. Failure to do so will void the relief and approval granted herein. 2) The six(6)storage sheds on the property must be removed prior to the issuance of a building permit. 3) Approval for off-street parking for boat and trailer storage as an accessory to the subject boat business only applies to the R40 zone on the subject lot (SCTM 1000-122-6-12) and to no other residential properties. All boats, trailers, and other non-residential vehicles related to boat storage and/or sales by the subject business must be removed from the applicant's neighboring residential properties and from the NY State Route 25 right of way prior to the issuance of a building permit. 4) No boats or trailers may be displayed and/or stored in the front yard of the "as built" one story framed boat sales building and office, unless approved by the Planning Board during the site plan approval process. 5) The approval of off-street parking in the R40 zoned portion of the subject property is granted as an accessory only in relation to the applicant's Special Exception Permit to operate his boat business on the premises. If the applicant changes the business use or sells the business, the applicant or new property owner must apply to the Board of Appeals for a new Special Exception Permit and to the Building Department for any variance relief or approvals that may be needed. 6) The applicant must install 6 foot high solid fencing along the entire perimeter of the property's code permitted side and rear yards 7) No storage of boats, boat trailers, vehicles or equipment shall be permitted in the easterly 15 foot side yard setback for the proposed storage building granted herein. The 15 feet side yard setback must remain open and unobstructed at all times. 8) If the applicant fails to comply with any of the above stated conditions, the Board may, through a public hearing process, revoke the previously granted Special Exception Permit(ZBA file#4681) That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Before applying for a buildingpermit,the applicant or agent must submit to the Board of Appealsfor approval and filing, two sets of the/amended,survey, conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) and approval granted herein as shown on the architectural drawings, site plan and/or survey required above, , such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Located at 9605 Route 25, Mattituck SCTM#1000-122-6-12 ZBA#7014 The Planning Board has reviewed the requested variances to construct a 120' x 46' (5,520 sq.ft.) principal storage building with a requested 5' side yard setback other than the required 25' side yard setback, a requested 965" front yard setback other than the required 100' front yard setback, and off-street (boat) parking as an accessory use in a residential district; in the General Business (B) Zone and does not support the requested variance. Our records indicate that a Site Plan under the name North Shore Yacht Sales was applied for and reviewed by the Planning Board in 2001 for the same use (sales) on the General Business (B) zoned portion of the parcel however Site Plan approval was not issued. The property is split zoned General Business and Residential 40 (R-40). During the site planning process the Planning Board tried to rectify the storage of boats within the R-40 portion of the property. In a March 20, 2001 letter to the landowner from the Planning Board the landowner agreed to contact the ZBA to resolve the issue of placing boats in the residential (R- 40)-zoned portion of the property. In a July 18, 2001 follow up letter to the applicant the Planning Board required the removal of the boats stored in the R-40 zoned portion of the property and within the front yard landscape area. Boats are currently stored in the R-40 Zone and the 25' front yard landscape area and these issues remains outstanding. A new Site Plan Application (incomplete)was submitted to the Planning Board on November 13, 2014. 0( Southold Town Planning Board Page 12 ---December 21, 2016 The Planning Board does not support the requested variance for the following reasons: 10)il 1. The storage of boats and trailers continues to occur on the residential (R-40) zoned portion of the property and on the two adjacent R-40 parcels to the west. The Board is uncertain if boat/trailer storage is compatible with the Code section below. Off-street parking areas (§280-78(i)): Lots divided by district boundaries. When aap rking lot is located partly in one district and partly in another district, the regulations for the district requiring the greater number of parking spaces shall apply to all of the lot. Parking spaces on such a lot may be located without regard to district lines, provided that no such parking spaces shall be located in any residence district unless the use to which they are accessory is permitted in such district or upon approval of the Board of Appeals. 2. The 5' side yard setback of the large storage building from the residential (R-40) zoned properties to the east (SCTM#122-6-13) could result in adverse impacts to the residential use. There is a concern regarding the large building and potential increase in intensity of the existing use. If the building is located, as proposed, in the 25' wide required transitional buffer between the Business and Residential Zoning Districts it could adversely impact the residential uses to the east. A transitional buffer is also required along the R-40 zoned property (SCTM#122-6-7) to the west of the subject parcel where boats are currently stored. The transitional buffer section of the code (Section 280-94 (D)) does allow the Planning Board to accept alternative buffering materials in the Site Plan process, however it is recommended that the Boards identify which materials would sufficiently mitigate impacts to residential properties. Note that a perimeter fence was required in the April 1999 ZBA decision, but has not been installed. 3. There are concerns regarding the storage of boats and trailers in the B Zone, in the front yard and storage/display of boats and trailers in the New York State Route 25 right of way. Open storage of materials and equipment is a permitted accessory use in the B Zone, however the use requires that open storage of materials or equipment be at least 25 feet from any lot line, not be more than 6 feet high and be suitably screened by a solid fence or other suitable means of at least six feet in height. The storage of boats on the property does not comply with this provision. Boat storage is also occurring in the 25' setback from the front property line. In the 2001 Site Plan the Planning Board was requiring a landscaped buffer in the area to prevent the storage of boats in this area. Boat and trailer storage in the New York State Route 25 right of way is not permissible; is re-occurring and needs to be rectified. The property is located approximately 800 feet deep from the Main Road to the Long Island Railroad, and the southerly half is zoned B Business while the northerly half is zoned R-40 Residential. Applicant has submitted a survey map' prepared by Young & Young, Surveyors May 31, 1988 for Dale Bergen, a prior owner. The 1988 survey shows the layout of the property with dimensions and setbacks of the buildings. The principal building consists of approximately 1104 sq. ft., and is situated 59.5 feet from the front line, 6.9 feet from the east side line, 42.1 feet from the west side line. The 1988 survey shows three oil storage tanks and a second building, all of which have been removed, according to applicant's testimony. Applicant submitted a sketch of a map with driveway and parking areas, entrances and exits, fencing and similar details related to this Special Exception use. For record purposes, it is noted that the following Town determinations were issued regarding this property: (a) Certificate of Occupancy No. Z-1157 issued September 20, 1961 to Robert L. Bergen for a business building, referring to Building Permit No. Z1447 dated June 15, 1961; (b) Certificate of Occupancy No. Z-5900 issued May 9, 1974 to Robert L. Bergen for a business building (repair shop) with addition, referring to Building Permit No. 6973Z dated November 7, 1974; (c) ZBA approval rendered July 13, 1961 which extended the 'B' Business District boundary line 50 feet west, and specified a permanent westerly side yard of 14 feet and permanent rear yard of 14 feet. The proposed location will not adversely impact the physical or environmental conditions of the neighborhood. An aerial is also enclosed which shows the split zone on the subject parcel and the neighboring parcel of Dickerson's Marine (Koch Holding Corp.). The enclosed revised John Ehlers' survey shows the split zone on the Dickerson's Marine parcel. In reviewing the aerial and survey, it is evident that the Dickerson storage building and boat parking is in the R-40 portion of their property (directly adjacent to the proposed building envelope for the storage building). The proposed storage building will not extend beyond the existing Dickerson storage building. The applicant submits that the proposed location serves to minimize impact to surrounding neighbors and will work with Planning Staff on buffering during the Site Plan phase. The granting of the requested variances will not cause an undesirable change in the character of the neighborhood or be a detriment to nearby properties. There has been no opposition from neighbors and the split zone of the property creates an undue hardship for the applicant and limits the location of the proposed building. Likewise, storage of boats in the R-40 portion will not adversely impact neighbors and we will work with the Planning Department in the site plan process to address concerns of buffering and screening. The need for locating the storage building as proposed is one of access. There is currently access via a 14 ft. wide opening at the front gate and it is difficult to get trailers and trucks to the rear of the property. There exists,and we are proposing to maintain, boat and vehicle parking along the western property line in the B zone. Due to the dimensions (length and width) of the variety of boats and need for truck and trailer access to the rear of the property,the applicant will have roughly 22 ft. of access between the parking on the western side and the proposed storage building. Moving the proposed storage building further west then the existing office building would not only inhibit truck and trailer access to the rear of the property, but it will also impact the maneuverability of boats and vehicles.
