Dear Mr. Lappe:
Pursuant to your request for ah inspection to determine if the Trustees
have jurisdiction regarding the work to be done on the property above
referenced, please be advised that President John M. Bredemeyer has reviewed
this matter on February 4, 1988.
It has been determined that this work is an ordinary and usual maintenance
or:repair of a presently existing building2 In accordance with 97-12 [5] this
work does not require a permit from the Trustees.
However, no fill is to be placed within 75' of the waters edge. A row of
hay bales are to be placed at the seaward side of any excavation or stock piles
on the site to prevent any run-off into the creek.
Please return to the Building Dept. for a determination on the need of any
other permits that may be required for this project.

WETLANDS § 97-12
m order to minimize damage from erosion, turbidity or
siltation, saltwater intrusion, loss of fish, shellfish or other
beneficial marine organisms, aquatic wildllf~ and
vegetation and the destruction of the natural habitat
thereof, to minimize danger of flood and storm.tide damage
and pollution, and ~o otherwise pro~ec~ the quality of
wetlands, tidal wa~srs, marshes, shore lines, beaches and
natural drainage systems for their conservation, economic,
aesthetic, recreational and other public uses and values,
and, further, to protect the potable fresh water supplies of
the town from the dangers of drought, o-)erdraft, pollution
from saltwater intrusion and misuse or mismanagement.
Therefore,'the Town Board declares that the kegulation of
the wetlands of.the Town of Southold is essential to the
health, safety and welfare of the people of the Town of
Southold. '
§ 97-12. Exceptions,
A. The provisions of this chapter shall not affect or prohibit
nor require a permi~ for the following:
(1) The ordinary and usual mosquito control operations
conducted by any public authority.
· (2) The ordinary and usual oper. ations incidental to the
cultivation and/or harvesting of fish and shellfish.'
The ordinary and usual operations relative to conser-
vation of soil, vegetation, fish, shellfish and wildlife.
(4)' The ordinary and usual operations relative to agri-
culture, aquaculture or horticulture. .
(5) The ordinary and usual maintenance or repair of a
presently existing building, dock, pier, wharf, bulk-
head, jetty, groin, dike, dam or other water control
device or structure.: '
B. Nothing contained in this chapter shall be deemed to affect
