successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, convenants that the party
of the first part will received the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total
of the same for any other purpose. The word "party" shall be construed as if it reads "parties" whenever
the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Fleet's Neck, Cutchogue, Southold Town, Suffolk
County, New York, bounded and described as follows:
BEGINNING at a concrete monument set on the easterly side of Fleetwood Road at the
northwest corner of the premises herein described adjoining land formerly of Joseph Hahn,
Jr., later of Andrea Jensen, said point of beginning being distant about 350.08 feet North of
the northerly side of East Road;
RUNNING THENCE along said last mentioned land, North 85 degrees 57 minutes 20
seconds East through a concrete monument set in the tip of the bank 265.00 feet (actual),
275 feet, more or less (deed) to high water mark of East Creek;
THENCE South 06 degrees 23 minutes 28 seconds West, along high water mark of East
Creek, 50.82 feet (actual), 50 feet, more or less (deed), to land formerly of Enda Brower,
later of William A. Kennedy and Ava M. Kennedy, his wife;
THENCE along said last mentioned land South 85 degrees 57 minutes 20 seconds West,
through a stake set in the top of the bank 254.50 feet (actual), 280 feet, more or less
(deed), to the easterly side of Fleetwood Road;
THENCE along the easterly side of Fleetwood Road, North 5 degrees 31 minutes 40
seconds West 50.00 feet to the concrete monument and the point or place of BEGINNING.
