THIS INDENTURE, made the 30th day of December, 2016,
between Frances C. DiVello, as surviving tenant by the entirety, of 4400 Westphalia Avenue, P.O. Box
234, Mattituck, New York 11952 (hereby transferring a 25% interest in the premises described herein)
party of the first part, and
Frances C. DiVello, of 4400 Westphalia Avenue, P.O. Box 234, Mattituck, New York 11952, as to a 75%
interest and
Jay P. Quartararo, Esq., as Trustee of The DiVello Family Trust #11, of 33 West Second Street, P.O. Box
9398, Riverhead, New York 11901, as to a 25% interest in the whole
party of the second part:
WITNESSETH, that the party of the first part, in consideration of one dollar and other good and
valuable consideration, lawful money of the United States, paid by the party of the second part, does
hereby remise, release, and quitclaim unto the party of the second part, or to his or her heirs, successors,
or assigns forever,
All the certain plot, piece or parcel of land, with the building and improvements thereon erected, situate,
lying and being at Mattituck, in the Town of Southold, and State of New York, shown and designated as
Lots 1 to 7, both inclusive, on a certain map entitled, "Map of Lots located at Mattituck, Longs Island,
Property of William B. Codling", which map was filed in the Office of the Clerk of Suffolk County, on
May 10, 1921 as Map No. 745, together with a parcel adjoining said lots, which said parcel and aforesaid
lots, when taken together as one parcel are more particularly bounded as described as follows:
BEGINNING at the corner formed by the intersection of the northerly side of Westphalia Road with the
easterly side of Meday Avenue (a private road); and
RUNNING THENCE North 16 degrees 09 minutes 40 seconds West along said easterly side of Meday
Avenue and along the easterly line of land now or formerly of T. Galligan, a distance of 625 feet more or
less to the "ordinary high water mark" of Mapes Creek;
THENCE along the said "ordinary high water mark" of Mapes Creek in an easterly direction as it turns, a
distance of 295 feet more or less to land now or formerly of A. Galgano. (The tic line courses and
distances being South 71 degrees 00 minutes East, 120 feet and North 76 degrees 01 minutes East, 172.64
feet);
THENCE along said land, the following two courses and distances:
(1) South 20 degrees 39 minutes 10 seconds East, a distance of 575 feet more or less; and
(2) North 69 degrees 49 minutes 30 seconds East, a distance of 74.0 feet to land now or formerly of A.
Penny;
THENCE along said land South 15 degrees 55 minutes 20 seconds West, a distance of 145.83 feet to the
northerly side of Westphalia Road;
THENCE along same, the following two courses and distances;
(l) North 74 degrees 04 minutes 40 seconds West, a distance of 282.75 feet;
(2) South 67 degrees 35 minutes 20 seconds West, a distance of 72.80 feet to the point or place of
Beginning.
Being and hereby intending to convey the same premises as conveyed to the party of the first part
by Deed dated October 24, 1978, and recorded in the Suffolk County Clerk's Office on October 26, 1978,
in Liber/Reel 08522 of Deeds, at page 132-135.

TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, Jay P.
Quartararo, Esq. and assigns forever.
AND the party of the first partigrantor, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part/grantor will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement before using
any part of the total of the same for any other purpose. The word "party" or "grantor" shall be construed
as if it read "parties" or "grantors" whenever the sense of this document so requires.
