party of the second part,
WITNESSETH, that the party of the first part, in consideration of
Ten dollars
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Town of Southold, County of Suffolk and State of New York, at Nassau Point, being part of Lot 246 as shown on Map entitled
"Amended Map A of Nassau Point", filed in Suffolk County Clerk's Office August 16, 1922, under Map File No. 156, bounded and described as follows:
BEGINNING at a point on the ordinary high water mark of Wunneweta Pond and the easterly line of said lot 246, which point lies South 19 05'40" West
176.97 feet from a monument set at the northwesterly comer of lot 226 on said map and from said point of beginning;
RUNNING THENCE southerly and thence easterly and thence southeasterly,
THENCE southerly and thence westerly or northwesterly along said ordinary high water mark of Wuruteweta Pond and along the exterior boundary lines
ofsaid lot 246, a distance of 600 feet, more or less, to a point;
THENCE RUNNING North 22 W40" East across said lot 246, a distance of 157 feet, more or less, to the point or place of beginning, being the
southeasterly portion of said lot 246.
TOGETHER with a right of way 16 feet in width for purposes oringress and egress and for all ordinary utility purposes over said lot 246 fmm a point in
the westerly boundary line of the premises above described a short distance south of Wunneweta Pond and thence in a northerly and northeasterly
direction, paralleling in a general way the shore of said Pond and ending at the easterly line of said lot 246 to connect up with a 15 foot right of way which
lies between lots 226 and 227 on said map and which extends easterly from the easterly line of lot 246 to Wunncweta Road, formerly known as Hillside
Road, the said rights of way being more particularly shown on map of land surveyed for James H. Rambo at Nassau Point on December 22, 1952, and
thereafter at various times revised, made by Otto W. Van Tuyl & Son, Licensed Surveyors, (the southerly line of said right of way first mentioned
beginning at a concrete monument set at the northwesterly comer oflot 226 as shown on said map.) Said right ofway shall run with the land.
TOGETHER with all the right, title and interest of the party of the first pan in and to any land under the waters of Wunneweta Pond on the south and in
and to the waters of said Pond adjacent to the premises above described.
TOGETHER with easements in common with others over the mads and rights of way laid out on Nassau Point for access and egress to and from public�Q

AND the party of the second par, for himself, his heirs and assigns, does hereby covenant to and with the party ofthe first part, his successoRssigns, that
the party of the second part, his heirs and assigns, will not at any time erect more than one house on the premises above described except the ordinary out
houses and that no such dwelling shall cost less than $3,000.00.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
