AGREEMENT made a�. 19 ' 2-t'4etween VISHNUDAT SEODAT, residing at 580
Lloyds Lane, Mattituck, NY 11952 (hereinafter the "first party") and THOMAS ERRICO residing
at 640 Lloyds Lane, Mattituck, NY 11952, (hereinafter the "second party").
WHEREAS the first party VISHNUDAT SEODAT is the owner in fee simple of the
property located at 580 Lloyds Lane, Mattituck, New York (Suffolk County Tax Map District 1000
Section 099.00 Block 03.00 Lot 004.002), acquired by deed annexed as Exhibit A hereto and made
a part hereof from Robert Fox & Victoria Friedman, as tenants in common, dated 1115/04, recorded
11/24/04 in Liber 12356 page 905 in the records of the County Clerk of Suffolk County, being Lot
2 on a certain map entitled "Map of Honeysuckle Hills" filed in the Office of the Clerk of Suffolk
County on October 16, 1981 as File Map No. 7019 annexed as Exhibit B hereto and made a part
hereof (hereinafter "Parcel T);
WHEREAS the second party THOMAS ERICO is the owner in fee simple of the property
located at 640 Lloyds Lane, Mattituck, New York (Suffolk County Tax Map District 1000 Section
099.00 Block 03.00 Lot 004.001), acquired by deed annexed as Exhibit C hereto and made a part
hereof from James Mahalios, dated February 10, 2012 recorded 2/22112 in Liber 12685 page 565
in the records of the County Clerk of Suffolk County, being Lot I on said File Map No. 7019
entitled "Map of Honeysuckle Hills" (hereinafter "Parcel IT');
WHEREAS Parcel lI is adjoining and due west of Parcel I and Parcels I and H share a
common boundary line;
WHEREAS the possible prior existence of fences and/or encroachments across the
common boundary line lying between Parcels I and lI may have created an ambiguity as to true and

correct location of said common boundary line lying which the parties seek herein to mutually
resolve and clarify;
1. Presently no fence or fences running generally South to North are erected along the
West side of Parcel I, which adjoins the East side of Parcel U, nor are there any
structures known to presently encroach into Parcel I from Parcel II, or into Parcel II
from Parcel I. Accordingly, no "Out of Possession Exception" or no "Encroachment
Exception" is known to affect title of Parcel I or Parcel H. To the extent, if any, that
there are prior agreements affecting Parcel I in favor of Parcel U or affecting Parcel
II in favor of Parcel I which requires the maintenance of landscaping between the
two parcels along the common boundary, such agreements are hereby extinguished.
2. The parties recognize that the survey of Joseph A. Ingegno, dated .Tune 28, 2002,
copy annexed as Exhibit D, (hereinafter "Survey") shows the true and correct
boundary lines of Parcel I, and that the western boundary as depicted thereon is also
the Eastern boundary of Parcel H.
3. The first and second parties hereby waive for themselves, their heirs, assigns and
successors in interest any claim to prescriptive rights in and to or acquisition of title
by adverse possession of the land of which either owner is or maybe out of
possession and regardless of any encroachment and all parties hereby recognize the
same boundary line as depicted upon the Survey hereinbefore referred to and hereby
waive any claim to title or ownership of any of land to which the owner of the parcel
might be considered to be out of possession, or as to which any encroachments may
exist on either Parcel I or 11.
4. The parties agree to rely on the boundary line as delineated on the aforesaid survey
as proof as to what the proper boundary line is and acknowledge that any use by the
first party of the property to the West of the common boundary line or by the second
party of the property East of the common boundary line has been permissive since
its inception.
