BOUNDARY LINE AGREEMENT

AGREEMENT made this 3O*day of January, 2017 between, Robert Ghosio, Jr.
and Gail A. Ghosio ("Adjoining Owners") residing at 33 Sunset Lane, Greenport, New
York and Pamela L. Hulse residing at 35 Sunset Lane, Greenport, New York ("Owner")
WITNESSETH
WHEREAS, Owner is currently in contract to Sell the premises known as 35
Sunset Lane, Greenport, New York to John M. Skinner and Kimberly A. Skinner and the
Adjoining Owners are the owners in fee simple of the adjoining premises known as 33
Sunset Lane, Greenport, New York, both parcels situated in the Village of Greenport,
Suffolk County in the State of New York and more fully described herein in the attached
Exhibit "A";
WHEREAS, there has been uncertainty, confusion and/or doubt concerning the
precise location of the common boundary line on the Southwest Corner of 35 Sunset
Lane, Greenport, New York. The uncertainty arises from the picket fence which is
situated 2.6 feet more or less north of the southerly property line;
WHEREAS a survey certified by John Gallacher Land Surveyor dated December
22, 2016 depicts the location of the picket fence and chain link fence which is situated
north of the southerly property line and said survey also establishes the common
boundary lines for owners and adjoining owners. Said survey is attached hereto as
Exhibit B and made a part of this agreement;
WHEREAS the parties now desire to fix and definitely establish their property
line between the two parcels mentioned above respectively owned by them;
NOW THEREFORE, in consideration of the sum of one dollar by each of the
parties hereto, the receipt of which is acknowledged, the parties, for themselves, their
successors and assigns, covenant and agree that the boundary line be established as a line
described as follows:
The Adjoining Owners acknowledge the picket fence and they agree that they
shall make no claim of either ownership or use of the 2.6 feet that lies between the picket
fence and the actual southerly property line of 35 Sunset Lane, Greenport, NY.
That the Adjoining Owners are not in possession of any portion of the 2.6 feet and
the adjoining owner hereby attests that they do not have an easement, license, or any
other right, title, or ownership interest to the 2.6 feet;
That the Adjoining Owners further release and quitclaim to Owner and its
successor and assigns forever all right, title, and interest in and to the land lying between
the fence wall and the southerly line as depicted on the survey attached hereto as in
Exhibit B. That the true and correct boundary line between the properties is 2.6 feet to the
south of the fence;

IT IS MUTUALLY AGREED AND COVENANTED that this agreement shall
run with the land and be binding upon and inure to the benefit of the successors in
interest of the parties and the parties agree to record same within the Suffolk County
Clerk's Office.

in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the westerly side of Sunset Lane, distant 175 feet northerly from the corner
formed by the intersection of the northerly side of Sutton Place and the westerly side of Sunset Lane,
said point being the point where the southerly line of the premises being described and the northerly line
of land nor formerly of Ghosio intersects said westerly side of Sunset Lane;
RUNNING THENCE along said land now or formerly of Ghosio, south 62 degrees 21 minutes 30
seconds west, 126.31 feet to the easterly line of Lot No. 33 as shown on Map of Easterly Shores, Section
