The following action was taken by the Board of Town Trustees during
its r,e~lar meeting held on Sept~er t7~ I~2 regardin~ the above
matter:
W~F~W.REA~ En~ConSultants 0'n behalf of Walter & Stanley KrUPski applied
to the Southol~ Town Trustees for a permit under the proVisio~ of
the Wetland Ordinance of the Town of Southold~ application dated July
2~ !~92 and,~
~HEREAS said application was referre~ to the Southo!d
Conservation 'Advisory CounCil for their findings and recomme~-.tiG~s,
h~{EREAS, a public hearing ~as held by the ~own ~rustees with respect
to said application on September !7, 1992 at which time all
interested persons were given an opportunity to be heard~ and~
WHEREAS~ the Board members have personally viewed and are f~miiiar
with the prea~ises in ~aestion and the surrounding area~ and,
~ER-EAS, tke Board has considered ali the t~stimony and docm~.entation
submitted concorning this application, and~
WHEREAS~ the. Board has determined that the project as proposed will
not affect~the health~ safety and gen~r'ai welfare of the people of
the town,

RESOLVED that the Board of Trustees approves the application of

This Agreement made this//--" day of February, 1992,
between BECKY JOHNSTON, residing at 471 West 22nd Street,
New York, New York 10011, hereinafter referred to as
JOHNSTON; and STANLEY KRUPSKI, residing at Route 48,
Cutchogue, New York 11935 and WALTER KRUPSKI, residing at
Bridge Lane, Cutchogue, New York 11935, hereinafter referred
to as KRUPSKI; and JAMES H. RAMBO, INC., with principal
place of business at Bishops Lane, Southampton, New York
11968, hereinafter referred to as RAMBO.
WHEREAS, JOHNSTON and KRUPSKI are the owners, of
adjacent lands fronting Long Island Sound at Cutchogue, New
York, and
WHEREAS, JOHNSTON has requested that she be permitted
to construct a bulkhead on KRUPSKI'S property, extending
easterly for 150 feet from the easterly end of her existing
bulkhead, in order to further protect her bulkhead from
erosion.
NOW THEREFORE, it is mutually agreed as follows:
1. In consideration of ONE DOLLAR ($~.00) and other
good and valuable consideration, KRUPSKI grants to JOHNSTON
the right to construct a bulkhead on their property at the
foot of the bluff, extending 150 feet easterly from the
easterly end of JOHNSTON's existing bulkhead, at her own
cost and expense.
2. That RAMBO be employed to construct the bulkhead in
compliance with the regulations of the DEC and the Town of
Southold, and provide public liability insurance amounting
to $2,000,000.00 to protec~ K~UPSKI during th~ entire term
of constrution. Such insurance shall be written by a
solvent 'insurance company licensed by. the State of New.York,
and a certificate of insurance naming KRUPSKI as additional
insured shall be furnished prior to commencement of the
construction.
3. That RAMBO and JOHNSTON shall obtain at their
expense all permits necessary to construct such bulkhead,
and shall install same in workmanlike manner in accordance
with said permits, all applicale ordinances' and regulations,
in accordance with plans and specifications to be approved
in writing by KRUPSKI prior to commencement of construction.
RAMBO and JOHNSTON shall also obtain all final approvals and
certificates immediately upon completion of the work.
4. That said work be completed before September 1,
1992.
5. JOHNSTON hereby indemnifies and holds KRUPSKI
harmless against any loss, claim, .liability, damages, or
expenses, including without limitation reasonable attorneys
fees, in any way arising from the construction or work
authorized by this agreement, or from RAMBO or JOHNSTON's
failure to comply with this Agreement.
6. KRUPSKI shall be the owner of the bulkhead upon
completion.

RE: BECKY JOHNSTON, BRIDGE LANE,.CUTCHOGUE
Dear Mr. Bredemeyer:
A legally~binding agreement has been entered into between
Becky Johnston as the party responsible for the constru-
tion 'and maintenance of the bulkhead; and Stanley and
Walter KrupSki as owners of the property on which the
bulkhead is to be located. A copy of that document is
attached for your records.
Also attached is correspondence from William Wickham,
attorney for Walter and Stanley Krupski, indicating that
the maintenance agreement is to be signed by Ms. Johnston
as per the attached document.
.This unique situation is necessitated by the property
lines that run diagonally to the shoreline. The property
directly north of the Johnston residence belonging to
Krupski is vital to the preservation of the Johnston
property and residence, thus, the reason for the agree-
ment and subsequent applications.

The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility i¢ applying for or obtaining such approval [n the
'event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees- of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume ail responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and ail claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
~his. permit are being conducted, do, by the acceotance of this permit, give consent to the 'Tow,%

make such inspections as the Town may deem necessa~ to insure that such operations are being

tation or the natural habitat thereof.
E, Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow af the tidal waters of the town°
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect the health, safety a.nd genersl welfare of the people of the town.
