Present were: Leslie Kanes Weisman, Chairperson/Member Gerard P. Goehringer, Member Ken Schneider, Member George Horning, Member Eric Dantes, Member Kim Fuentes, Zoning Board Assistant William Duffy, Town Attorney Call to Order at 5:03 P.M. by Chairperson Weisman. 5:04 a.m. Motion was offered by Chairperson Weisman, seconded by Member Goehringer to -enter Executive Session for Attorney/Client advice.Vote of the Board: Ayes: All. This Resolution was duly adopted(5-0)- EXECUTIVE SESSION: A. Attorney/Client advice. 5:45 a.m. Motion was offered by Chairperson Weisman, seconded by Member Goehringer to exit Executive Session.Vote of the Board: Ayes: All. This Resolution was duly adopted(5-0). Page 2—Minutes Special Meeting held March 16, 2017 Southold Town Zoning Board of Appeals WORK SESSION: 1. Requests from Board Members for future agenda items. 2. April 6, 2017 Adjournments: Croteaux#7013;Astley#7038. POSSIBLE RESOLUTION TO CLOSE THE FOLLOWING HEARINGS CAPTAIN RED'S MARINE SALES. INC. #7014 — (Adjourn from February 2, 2017) Request for Variance(s) under Article XI, Section 280-49; Article XVIII, Section 280-78(I); and the Building Inspector's September 19, 2016, amended September 30, 2016, Notice of Disapproval based on an application for a building permit to construct a storage building and to propose boat storage and parking, at: 1) the proposed building is less than the code required front yard minimum setback of 100 feet; 2) the proposed building is less than the code required side yard minimum setback of 25 feet; 3) no off-street parking spaces shall be located in any residence district unless the use to which they are accessory is permitted in such district or upon approval of the Board of Appeals; located, at: 9605 Route 25, Mattituck, NY. SCTM#1000-122- 6-12. BOARD RESOLUTION: Motion was offered by Chairperson Weisman, seconded by Member Dantes to close Public Hearing reserving decision. Vote of the Board: Ayes: All. This Resolution was duly adopted (4-1). Member Goehringer recused himself. TOWN OF SOUTHOLD PLANNING BOARD/ACKERMANN AGRICULTURAL BARN#7037 The Southold Town Planning Board has requested that the Southold Town Zoning Board of Appeals, pursuant to the Planning Board Memorandum dated December 2, 2016, provide an interpretation as to whether agricultural equipment storage for a vineyard management operation qualifies as a permitted agricultural storage use relative to a proposed building located on eight acres of lands on which development rights are owned by the Town, located at: 1350 Alvahs Lane, Cutchogue, NY. SCTM#1000-102-4-6.1. BOARD RESOLUTION: Motion was offered by Chairperson Weisman, seconded by Member Goehringer to close Public Hearin reserving decision, subject to receipt of written comments until March 24, 2017. Vote of the Board:Ayes:All. This Resolution was duly adopted (5-0).. DILIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: The Board continued with agenda items, and commenced deliberations on the following applications. The original determinations of each of the following applications as decided are filed with the Southold Town Clerk: APPROVE AS APPLIED DAVID and JUDITH MILLER#7031 LEJON ENTERPRISES. INC.#7034 APPROVE AS APPLIED WITH CONDITIONS JOHN E. MCDONALD and CATHERINE MCDONALD#7036 JOHN MURNAME#7027 IAN and LYNETTE CROWLEY#7035 Page 3—Minutes Special Meeting held March 16, 2017 Southold Town Zoning Board of Appeals GRANT IN PART, DENY IN PART, GRANT ALTERNATIVE RELIEF W/CONDITIONS DAVID BOFILL#7028 (Grant Deck & shed#1. Deny shed#2 - Grant Alternative Relief with conditions.) Vote of the Board:Ayes:All. This Resolution was duly adopted (5-0). RESOLUTIONS: A. RESOLUTION ADOPTED:Motion offered by Chairperson Weisman, seconded by Member Goehringer, to authorize advertising of hearings for the next Regular Meeting to be held April 6, 2017 at 8:30 AM.Vote of the Board:Ayes:All. This Resolution was duly adopted (5-0). B. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Goehringer to approve minutes from March 2, 2017 Regular Meeting. Vote of the Board:Ayes:All. This Resolution was duly adopted (5-0). There being no other business properly coming before the Board at this time, Chairperson Weisman declared the meeting adjourned. The meeting was adjourned at 6:11 P.M.
