NYANJ BARS enclosing Kimogener Point Co.'s Application for a Pre-CO for the Clubhouse building on the
NY,NJ&PA BARS above-referenced parcel together with our client's Consent to inspect the property and the _
application fee. I am also attaching a brief narrative of the historical use of the building as a
Clubhouse.
As discussed, it is our contention that the Clubhouse is a pre-existing, non-residential
building and that the proposed alterations are permissible as of right upon the issuance of the
Pre-CO, under Section 280-123(A)(1)(a)of the Town Code. After your office has had the
opportunity to inspect the property, please advise if you agree with our position.

KIMOGENOR POINT CLUBHOUSE
HISTORY and USE
The Kimogenor Point clubhouse was built in 1909 by developers Beverly S. King and
Stuart H. Moore. In 1900, King and Moore purchased the land on which the clubhouse
now stands from the Tuthill family, formed the Kimogenor Point Company, and in 1904
opened a bungalow rental colony on the site. By 1908 six of the eventual 11 rental
cottages were operational, and the clubhouse island had been created from the
developers' existing land by digging the canal that runs today around the clubhouse. By
June 1909 the clubhouse was complete and ready for the rental season.' (Exhibits 1 and
2)
As stated in the "Kimogenor Point Club Rules and Regulations" (Exhibit 3),the purpose
of the clubhouse during this period was "providing a place of amusement and recreation
for the summer residents of the Bungalow Colony." Activities there included swimming
in West Creek off the dock, quiet social interaction,parties, dances, and amateur
theatrical productions on the stage.
In 1920 Moore and King sold the Kimogenor Point Company to a group of former
cottage renters,who distributed shares among the owners. With share ownership came a
perpetual lease on one of the 11 cottages as well as equal share in the use of all the
common property,which included the clubhouse. This form of ownership is still in place
today.
Despite the change of ownership,the use of the clubhouse remained relatively the same.
The clubhouse continued to be the center of social interaction among the shareholders
and their guests. Much of this activity during the 1930s is chronicled in the Kimogenor
Put-Put, a seasonal weekly newspaper published by Kimogenor Point teenagers and their
friends from 1929 through 1935. (Exhibit 4)
Today,the clubhouse remains the hub of social interaction among the shareholders,their
children, and friends. Kimogenor Point children meet in the clubhouse,play Ping-Pong,
and occasionally produce and perform in theatrical events. Shareholders hold three or
four parties per season in the clubhouse (Exhibits 5 and 6), and the early-season and
annual shareholders meetings are held there (Exhibits 7 and 8). In the off-season,
shareholders' Sunfish are stored in the clubhouse as well as other small watercraft such as
kayaks and paddleboards.
