Requires Immediate Attention: Nothing at this time H. Board and Office Policies, Practices, and. Activities: SEQRA Determinations by the ZBA After a number of preliminary meetings and discussions, ZBA Assistant Kim. Fuentes and 1 began working with Planning Director Heatber Lanza and Tier staff, and TA Duffy on setting up administrative procedures in our office whereby the ZBA, instead of the Planning Board, may assume lead agency and hire a consultant to make SE+QRA determinations on certain Special Exception Permit applications be-fore the Board of Appeals. These nonresidential applications also require site plan approval by the Planning Board. t discussed this procedure in a meeting with TA :buffy and. Supervisor Fussell prior to beginning the required administrative actions and training within our Department. The consulting coasts involved will be billed to the applicant. The rationale for this change is based upon the fact that property owners and the Planning Beard do not wish to proceed with site plan approvals without the assurance that the Special Exception Permit an applicant requires to implement their project is approved by the ZBA. However, the ZBA cannot render an approval or denial until SE'QRA has been determined. Historically the ZBA would hold a public hearing for a Special Exception Permit on applications also requiring site plan approval, and thorn. adjourn without a date so Planning, as lead agency, could proceed with SEQRA,, While this new administrative procedure will require substantial additional ZBA staff time, it will benefit property owners and :result in improved coordinated reviews on complex projects that have potentially large impacts on the Town. Several such applications have already been discussed at the regular monthly interdepartmental. meetings our office sets up among the .honing, Planning, and Building Department Heads and the TA. These meetings have proven to be very valuable in establishing best practices for coordinated reviews and identifying relevant procedural issues. Ill. Financial/Budget/Personnel issues: New ZBA Members In March two new members to the Board of Appeals were appointed by the Town Board; Nicholas Plariamento and Patricia Acampora. To get them, started, ZBA staff and I prepared for each a binder of relevant background readings on the role and jurisdiction of Zoning Boards, SEQRA, Guidelines on Open Meetings Law, our own ZBA Procedures and Code of Conduct, and samples of past decisions. I have made myself available for personal meetings to answer questions and provide oversight and training as needed. IV.
