Members Present: Councilman Bill Ruland, Town Engineer Jamie Richter, Planning Dep't Director Heather Lanza, Chief Martin Flatley, Margaret Brown, Frank Field, Highway Superintendent Vincent Orlando, Jim Baker, Rona Smith and Tom Fox. Minutes of July 28, 2014 A motion to approve the minutes was made by Margaret Brown, was seconded by Jim Baker and was carried. EETC Update That organization met on July 23, 2104 at Riverhead Town Hall. With respect to the issue of bus shelter maintenance in the East End towns, Heather Lanza reported that those matters would be discussed with SCDPW. Public Requests ADA Access to Bus Shelters A visually impaired resident of East Marion has reported that despite his signaling for a stop, the S92 bus often passes without stopping. Neb suggested that attempting to board the bus at the designated stop would be helpful. Neb also advised him of the current bus shelter project and suggested that the local civic association should contact the Commission in order to puruse the issue with NYSDOT. Siqnage at Laurel Lane & Peconic Bay Boulevard Neb met with the local resident who had requested signage cautioning joggers, walkers and bicyclists to observe traffic rules at the above intersection so as to avoid accidents with motor vehicles. Vincent Orlando observed that signage cautioning them about the "wrong side" of the roadway may be appropriate to encourage self-regulation. Margaret Brown will contact the resident with an update on the situation. The Town Engineer and Highways Superintendent will confer concerning appropriate signage. Bicycle Travel Concern, Soundview Avenue & Horton Lane, Southold Appropriate signage at that location has been installed. Traffic Light Request at Ackerly Pond Lane & Route 25 -Southold A local resident at that location has requested a traffic signal at that intersection. Neb will write to NYSDOT concerning that issue. Request for Stop/Yield Signs—North Cross Road/Eastwood Drive Extension/ Holden Avenue Extension- Cutchogue Chief Flatley will investigate and report on the situation. Crosswalk Request by the Cutchoque F.D. on New Suffolk Road Signage designating a crosswalk to improve the safety of firefighters responding to alarms and also for the public attending various CFD-related functions has been approved and installed. Supervisor&Town Board Requests No Through Trucks— King Street, New Suffolk Chief Flatley advised that he would draft an SPD letter to local merchants concerning the above issue and Jim Baker will discuss the issue with NSSD. It was also suggested that a voluntary local solution would be ideal, with no parking on King Street across from the school as an example. Traffic Light at Route 25& Peconic Lane, Peconic& Planning Board Recommendations Heather Lanza reported that the Planning Board's request for the Commission's review of that traffic control issue is still outstanding. Planning Board Requests Town Comprehensive Plan Heather Lanza reported that issuance of the Transportation & Infrastructure Chapter has been delayed to December 2014. Current Transportation Issues - Updates Project Bus Stop SCDPW is still awaiting NYSDOT's approval for an additional shelter and for all suggested placements on SR25. Orientation/Interpretive Signage Project—RBA Phase II Neb reported that the prototype signage is very attractive and that RBA is working on a starting date for installation. Old Business Signage Concern, Intersection of Boisseau Avenue and CR48- Southold Neb's letter of July 30, 2014 to SCDPW requested further review of the recent repainting at that intersection concerning two issues that may be required to further enhance safety there. Repaving of SR25 between Manor Place, Greenport and CR 48 Vincent Orlando's letter of September 12, 2014 to NYSDOT requested that the current repaving of SR25 include the roadway section referred to above. Request for Road Restriping at Tuckers Lane &CR48 -Southold Jamie Richter requested SCDPW to review the eastbound striping at that location so as to alleviate the traffic safety problem as the roadway is reduced from two lanes to one lane eastbound. New Business Reuse of SR25 Excess Millinq Material for Additional Parkinq in the Rear of Town Hall - Southold Jamie Richter suggested that the excess material would provide excellent footing for a parking area and that NYSDOT should be contacted accordingly. Improved Pedestrian Safety- CR48 at Soundview Restaurant-Greenport In view of a recent pedestrian fatality at that location, Jamie Richter advised that SCDPW will realign the roadway there to provide for safer ingress and exit from the parking lot on the south side of the roadway. It is also understood that SCDPW may install a push-button type strobe light in way of the current crossing. Councilman Ruland advised that he will request a situation report from Legislator Krupski. We will be attending the vote on the bill #1913-2014 on November 18th, hopefully to encourage its passage. We are concerned about the time everyone assures us the DOT takes. How can we expedite this process? We can go to Albany...? We can have affidavits signed, but need paperwork...? We can become a squeaky wheel to our new friends at the DOT...? The group needs to obtain signed owners' affidavits that, in essence, they will be releasing their piece of property (approximately 10' x 6')to the town and agreeing to a right-of-way for the construction of the bus shelter which the Town/County will maintain. I still need to check this with the Town's attorneys before you do anything. 2. I am checking also to ascertain where the SCDPW's funding for these shelters is coming from. I have a hunch that this is federal funding which brings me to the point that all these efforts will need to be approved by the NYSDOT since Route 25 is a state road. 3. If this is the case, the requirements are horrendous and time-consuming. I am attaching a case in point - a sign that was to be erected on Southold's Historical Society property. We finally gave up on this. This is the situation as I see it at this time - not very encouraging. I will let you know what I find out. I reached out to Chris McVoy today but he was out in the field. After a careful review of the stated requirements and subsequent discussions with the Southold Historical Society liaison Commissioner as well as with the RBA Group project officer, decision has been reached to remove the proposed interpretive sign at this location from the overall project. This decision was also based on the fact that time is running out and that the project needs to proceed expeditiously with the construction/placement of the remaining signs. It is a nightmare and I don't think that we ought to go that route(at least not now). I agree that RBA's suggested second option is much more preferable. However, I wonder whether if just the kiosk alone on the Hamlet of Southold's"village green"at Youngs Ave and Route 25 would suffice(and perhaps solve the issue with Southold Historical Society's private property) by covering the hamlet altogether? Moreover, perhaps SHS's pictures could be included in the kiosk. Presumably the"village green" is Town of Southold property and the entire placement there might obviate or lessen the issues with the NYSDOT. It seems to me than an agreement between the Town and NYSDOT(if necessary) might be easier under the circumstances. Although I appreciate that my suggestions might not be workable, Im just brainstorming. I would suggest that we go with the second option and that further contact with the Historical Society be deferred pending the emergence of a clearer picture in the short term. Currently the Town is at the Design stage for the subject project and it appears that an acquisition of private property is necessary for the installation of interpretive signage. The New York State Department of Transportation, Office of Right-of-Way is responsible for offering guidance and direction as it relates to the acquisition of property/,property rights, temporary or otherwise, for transportation improvement projects that involve federal funds in ANY stage. The Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (Uniform Act) applies to all projects receiving Federal funds or Federal financial assistance where real property is acquired or persons are displaced as a result of acquisitions, demolition, or rehabilitation. The Uniform Act applies when Federal money is utilized in any phase of a project, even if not used specifically for property acquisition, but elsewhere in the project, such as planning, environmental assessments, or construction. Failure to comply with the provisions of the Uniform Act can result in denial of Federal participation in project costs. The purpose of this letter is to promote familiarity with federal and state requirements that apply to projects where right-of-way(ROW) needs to be acquired. It is requested that you forward this memo to the office assigned to coordinate right of way activities within your agency should acquisitions be necessary. Design Approval must be attained before Authorization to Acquire can be given and the actual acquisition process can begin. The following right-of-way requirements are necessary before receiving Authorization to Acquire: Right-of-Way Procedure for Local Projects November 23, 2011 Page 2 Plans with Highway Boundaries: For all projects, including those that can be constructed within the existing right of way, plans showing the limits of the work area in relation to the highway boundary need to be submitted. The ROW plans make it possible for our agency to arrive at the appropriate review determination regarding necessary right-of-way acquisitions for the project. Eminent Domain Procedure Law (EDPL)Hearing: In all situations where right-of-way is to be acquired, the need for an EDPL Hearing must be addressed. This formal hearing allows the community-at-large to have involvement and input in the process. The public would be informed of the potential impacts of the project, as well as be able to state opinions and offer support for the-project. In certain-situations,-the EDPL—hearing may be waived-as-per NY State- - _ Law. The laws governing requirements for this formal hearing are found in the NY Laws link: http://public.leginfo.state.ny.us. Maps: Any work or occupancy by the contractor outside of the right-of-way should be mapped. These maps should be executed in a format suitable for filing with the County Clerk. Cost Estimate: A cost estimate must be submitted for all expenditures related to the acquisition of right-of-way for a project. This estimate should include staffing and consultant costs. Please see the section headed Links for the appropriate link to the website for Chapter 11 Appendices. Authorization to Acquire: An audit of the project and property files will be conducted by the NYSDOT Office of Right-of-Way to monitor compliance with the preliminary requirements (for Design Approval). Upon satisfactory completion of this audit, Phase Authorization would be granted allowing the acquisition process to begin. Acquisition Process: Acquisition through negotiation is the preferred method of acquiring property, however at times, condemnation may be necessary. Just compensation must be developed through the use of appraisers and review appraisers unless the property owner waives this requirement and the property/right is being donated. Property owners must be given an opportunity to accompany the appraiser during the time of inspection. Once just compensation is established a written offer should be delivered to the property owner. The package should include a description of the real property or real property interests being acquired, the specific purchase price being offered, and a Summary Statement of Just Compensation which explains the basis for the offer and provides information necessary for the owner to make a reasonable judgment concerning the amount of the offer. Each owner must be allowed sufficient time to review the offer before title is transferred. Toward this end, approval by this office must be obtained PRIOR TO vesting the first map. Where the mapped area permanently affects the boundary of a state highway, concurrence from NYSDOT Design Services, Survey and Mapping Group must also be obtained. At all times, the owners must receive payment (or have funds available to them in an account exclusively established for this purpose) PRIOR TO surrendering possession. Right-of-Way Procedure for Local Projects November 23, 2011 Page 3 Right-of-Way(ROW) Clearance Certificate: After all properties have been vested, the Right-of-Way (ROW) Clearance Certificate can be officially signed by the Regional Real Estate Officer. Without the signed ROW Clearance Certificate the project cannot proceed to advertising and letting. Staff and Consultants: Your agency may either use its own staff or consultant firms to perform right of way activities. Either way, the staff must be sufficiently qualified. Title searchers must be licensed to perform search activities in the county where the project will take place. Attorneys must be licensed to practice in New York State. Appraisers and appraisal reviewers must be licensed by the State of New York as general appraisers experienced in the types of property being acquired and meet all USPAP --- requirements:--Negotiators-must-be-familiar with-the-Uniform-Act-and-EDPL,-and -should-have--prior - -- experience negotiating the purchase of property and condemnation procedures. Our agency will monitor the projects by reviewing the checklists and files. The files must document all activities as well as all contacts, written or verbal, with the property owners. Each file should be chronologically bound and be made available at one central location. During our review, compliance with applicable laws will be confirmed and assistance will be offered as needed. Permission to advertise your project MUST await the outcome of this review, the resolution of all engineering issues, and official notification that advertising can proceed from our Planning &Program Management Municipal Assistance Unit. After a phone call to the Village Hall today, I was told to get in touch with you directly. I had called to invite the Mayor or his representative to be part of a meeting scheduled for October 28. The meeting is to identify the exact location of a kiosk to be erected in the municipal parking lot near the ,gazebo. The issue was discussed by the Commission at our regular monthly meeting on September 22"d This three-way intersection of North Cross Road, Eastwood Drive Extension and Holden Avenue Extension was visited also by two of the Commissioners this past week, given stated concerns. Historically, this intersection has been this way forever since one can see well in all directions, being used mainly by local area residents. There is also no record of motor vehicle accidents at this location in the past. Should there be signage given this background was the question raised by the Commission. Also, do the other residents want or need it? The conclusion reached was to request a signed petition from the residents in the area. The picture was taken to depict the guard rails at this site.The one guardrail is buried in the hedges (and rusting) and the other guardrail is just to the left of it.As far as the signage at the three way intersection in Cutchogue, like I said,it has been this way forever because you can see well in all directions and it is just used by residents in this area for the main part,should it have signage, probably,but do the residents want or need it? The principal student and staff entrance to the school is directly off of King Street and the path to our playground crosses King Street diagonally at the Fourth Street intersection. In recent years we have become increasingly concerned over student safety given the frequency of large commercial delivery trucks transiting King Street between New Suffolk Road and First Street. At a minimum of three times each school day, at the start of school, at recess/gym and at dismissal, our students must cross King Street. On days when they have physical education classes, the number of crossings increases. As it passes the school, King Street is narrow. In addition, there are normally staff cars parked along the north side of the road. Although there is technically a no parking zone along the south side that is in fact where parents stop their cars to drop off and pick up their children, who are then forced to cross the street. Taken together these factors severely restrict a driver's visibility. For safety reasons, large commercial trucks simply do not belong in this very limited zone. This is especially true since there are several existing, entirely viable, alternate routes between New Suffolk Road and First Street. Any one could easily be utilized to ameliorate the problem. In view of the above, we are hereby requesting that the town prohibit through trucks from transiting King Street between New Suffolk Road and Third Street. For the safety and security of our school children,we hope you will look favorably upon our request.
