(103-ED-32365-2013) March 29,2017 Name of Responsible Entity and Recipient: New York State Homes and Community Renewal (HCR), 38-40 State Street, Hampton Plaza, Albany, NY 12207, in cooperation with the New York State Housing Trust Fund Corporation (HTFC), of the same address. The Governor's Office of Storm Recovery(GOSR), an office of HCR's HTFC, is responsible for the direct administration of the United States Department of Housing and Urban Development(HUD) Community Development Block Grant—Disaster Recovery(CDBG-DR)program in New York State. On or about April 6, 2017, the HCR certifying officer will submit a request and certification to HUD for the release of CDBG- DR funds appropriated under Public Law 113-2, as amended and as authorized by related laws and policies for the purpose of implementing the New York CDBG-DR Action Plan. Project Descriptions: GOSR proposes to provide HUD CDBG-DR funding to the following projects("Proposed Projects"): Strong's Marine, LLC (103-ED-33805-2013) is located at 2400 Camp Mineola Road, Hamlet of Mattituck, Southold, Suffolk County,New York 11952.HUD CDBG-DR funding of$6,730.42 is proposed for completed floating dock and gas pump repairs after the property was impacted by Superstorm Sandy. Strong's Marine of Southampton Management, LLC (103-ED-33819-2013) is located at 1810 North Sea Road, Southampton, Suffolk County, New York 11968. HUD CDBG-DR funding of$7,760.01 is proposed for in-kind dock replacement after the property was impacted by Superstorm Sandy. Simply Unique Caterers Inc. dba Crabby Amy's Clam and Oyster Bar(059-ED-33659-2013) is located at 2880 Ocean Avenue, Hamlet of Seaford, Hempstead, Nassau County, New York 11783. HUD CDBG-DR funding of$21,248.37 is proposed for completed construction-related activities which included storm clean-up,repairs to interior floors,walls,cabinets,plumbing,and electrical infrastructure, rebuilding a deck and shed, the replacement of a business sign, and installation, repair and replacement of equipment after the property was impacted by Superstorm Sandy. Montauk Marine Basin,Inc.(103-ED-33597-2013)is located at 426 West Lake Drive,Village of Montauk,East Hampton,Suffolk County,New York 11954. HUD CDBG-DR funding of$125,000.00 is proposed for: $100,000.00 for 81 linear feet of bulkhead and $25,000.00 in future repairs including machinery rental and associated labor charges after the property was impacted by Superstorm Sandy. The HUD CDBG-DR funded 81-foot section is part of a larger bulkhead repair by the Applicant which includes replacement of an additional 132-foot existing bulkhead. Vanderbilt's Wharf Marina,Inc. (103-ED-32365-2013)is located at 445 Vanderbilt Boulevard,Hamlet of Oakdale,Islip,Suffolk County, New York 11769. HUD CDBG-DR funding of$102,675.00 is proposed for completed landscaping services, clean-up from the storm, replacement of pilings, and future mitigation to improve and elevate the restaurant building. 25 Beaver-Street,New York,NY 10004 1 Recovery Hotline:1-855-NYS-Sandy I www,stormrecovery.ny.gov 2 The Proposed Projects are categorically excluded from the National Environmental Policy Act of 1969 (NEPA) by HUD regulations at 24 CFR Part 58. This combined notice is being sent to individuals and groups known to be interested in these activities, local news media, appropriate local, state and federal agencies,the regional office of the U.S. Environmental Protection Agency having jurisdiction, and to the HUD Field Office, and is being published in a newspaper of general circulation in the affected community. Public Comments on NOIRROF: Any individual,group or agency may submit written comments on each Project. Comments should be submitted via email, in the proper format, on or before April 5, 2017 at NYSCDBG DR ER@nyshcr.org. Written comments may also be submitted at the following address, or by mail, in the proper format,to be received on or before April 5, 2017: Governor's Office of Storm Recovery,38-40 State Street,Hampton Plaza,Albany,NY 12207.Comments may be received by telephone by contacting Lori A. Shirley at(518)474-0755. All comments must be received on or before 5:00 PM on April 5, 2017 or they will not be considered. If modifications result from public comment, these will be made prior to proceeding with the expenditure of funds. Environmental Certification: HCR certifies to HUD that Lori A. Shirley, in her capacity as Certifying Officer, consents to accept the jurisdiction of the U.S. federal courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows GOSR to use CDBG-DR program funds. Objection to Release of Funds: HUD will accept objections to its release of funds and GOSR's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request(whichever is later). Potential objectors may contact HUD or the GOSR Certifying Officer to verify the actual last day of the objection period. The only permissible grounds for objections claiming a responsible entity's non-compliance with 24 CFR Part 58 are: (a) Certification was not executed by NCR's Certifying Officer; (b) the responsible entity has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the responsible entity has committed funds or incurred costs not authorized by 24 CFR Part 58 before release of funds and approval of environmental certification;or(d)another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
