BETWEEN
DAVID L. FISHER, residing at 1500 Brecknock Road, Apt. 318, Greenport, New York 11944,
as to a 50% interest, and DOUGLAS D. FISHER and CHERYL A. FISHER, husband and wife,
residing at 2165 Old Orchard Road, East Marion,New York 11939, as to a 50% interest,
party of the first part, and
BRIE DECHANCE, residing at 122 Jackie Court, Patchogue, New York 11772,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at East Marion, Town of
Southold, Suffolk County, New York, known and designated as Lots 10 and 11 on a certain map
entitled, "Map of Section 2, Gardiners Bay Estates", filed in the Suffolk County Clerk's Office
on September 23, 1927, as Map No. 275, being more particularly bounded and described as
follows:
BEGINNING at a point 120.15 feet distant from the corner of the southwesterly side of Oak
Court ("South Lane") and the northeasterly side of Old Orchard Road;
RUNNING THENCE along the arc of a curve having a radius of 431.68 feet, a distance of 82.12
feet to a point;
THENCE along the division line between Lots 11 and 12 on the aforesaid map, North 58 degrees
58 minutes 30 seconds East, a distance of 114.20 feet;
THENCE South 31 degrees 0l minutes 30 seconds East, 80.00 to a point;
THENCE along the division line between Lots 10 and 9 on the aforesaid map, South 58 degrees
58 minutes 30 seconds West, a distance of 96.20 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated October 19, 2011, and recorded December 13, 2011, in the Office of the Suffolk
County Clerk in Liber 12679, Page 319.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year
first above written.
