The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event mat such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees- of written' notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume ali responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and ai~ claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
¢is permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such ooerations are being conducted to
make such inspections as the Town may deem necessar¢ to insure that such operations are beinc_ con-
ducted in conformity with this permit.
This operation will not substantially: A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tat~on or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely effect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of an,/channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
Otherwise adversely affect the health, safety an, d general welfare of the people of the town,

GENERAL CONDITIONS
1. The permitfee shall file in the office of the appropriate Regional
Permit Administrator, a notice of intention to commence work at least 48
hours in advance of the time of commencement and shall also notify
promptly in writing of the completion of the work.
2. The permitted work shall be subject ID inspection by an authorized
representative of the Department of Environmental Conservation who may
order the work suspended if the public interest so reouires.
3. AS a condition of the issuance of this permit, the applicant has ac-
cepted expressly, by the execution of the application, the furl legal respon*
sibJlity for all damages, direct or indirect, at whatever nature, and bY whom-
ever suffered, arising out of the project described herein and has agreed to
indemnify and save harmless the State from suits, actions, damages and
costs of every name and description resulting from the said project.
4. Any material dredged in t~e prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across the
bed of the waterway or flood plain or deep holes that may have a tendency
cause injury to navigable channels or to the banks of the waterway.
5. Any material to be deposited or dumped under this permit, either in
the waterway or on shore above high-water mark, shall be deposited or dumped
at the locality shown on the drawing hereto attached, and, if so prescribed
thereon, within or behind a good and substantial bulkhead or bulkheads, such
as will prevent escape of the material into the waterway.
6. There shall be no unreasonable }nterterence with navigation by the
work herein authorized.
~. That if future operations by the State of New York require an alteration
in the position of the structure or work herein authorized, or if, in the opinion
of the Department of Environmental Conservation it shall cause unreasonable
obsb'uctioo to the free navigation of said waters or flood,flow~ .or endanger
the health, safety or welfare of the people of the State, or loss nr destruction
of the natural resources of the State, the owner may be ordered by the Depart-
ment to remove or alter the structural work, obstructions, or hazards caused
thereby without expense to the State; and if, upon the expiration or revocation
of this permit, the structure, fill, excavation, or other modification of the
watercourse hereby authorized shall not be completed, the owners shall,
withou] expense to the State~ and to such extent and in suc~ time and manner
as the Department of Environmental Conservation may require, remove all or
any oortion of the uncompleted structure or fill and restore to its [ormel
condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or
alteration.

8. That the State of New York shall in no case be liable for any damage
or injury to the structure or work herein authorized which may be caused by or
result from future operations undertaken by the State for the conservation or
improvement of navigation, or for other purposes, and no claim or right to
compensation shall accrue from any such damage.
g. That if lhe display of lights and signals on any work hereby authorized
is not otherwise provided for by law, such lights and signals as may be pre-
scribed by the United States Coast Guard shall be installed and maintained

The Department of State has completed its evaluation of your Federal Con-
sistency Assessment Form and certification that the above proposed permit
activity complies with New York State's approved Coastal Management Program,
and will be conducted in a manner consistent with this program.
Pursuant to 15 CFR Section 930.63, and based upon the project information
submitted, the Department of State concurs with your consistency certification.
This concurrence is without prejudice to, and does not obviate the need to
obtain all other applicable licenses, permits, and approvals required under
existing State statutes.
The U.S. Army Corps of Engineers is being notified of this decision by
copy of this letter.

a. That this permit does not authorize the interference with any existing or proptmed Federal project and that the permittee
shall nat be en~tled to c0mpensat~gn for damage or fujury to the structures or work authorized herein which may be caused by
· or result from existing or future operations undertaken by the United States in the public interest.
b. That no attempt shall be made by the permittee to prevent the full and ~Tee ass by the public of all navigable waters a~ or
sd}acent to the activity authorized by this permik
c. That if the display of lights and signals on any structure or work authorized herein is not otherwise provided for by law,
such lights and signals as may be preserfbed by the United States Coast Guard shall be installed and maintained by and at the
expense of the permittee.
cL That the permittee, upon receipt of a notice of revocation of this permit or upon its explratlon before completion of the
authorized structure or work, sim]l, without expense to the United States and in such time and manner as the Seerctm~ of the
Army or his authorized representative may direct, restore the waterway to its former conditions. If the pe~ falls to com-
ply with the direction of the Secretary of the Army or his authorized representative, the Secretary or his designee may restore
the waterway to its former condition, by contract or otherwise, and recover the cost thereof from the permittee.
e. Structures for Small Boatsc That permittee hereby recognizes the poesibllity that the structure permitted herein may be
subject to damage by wave wash from paesin~ vessels. The issuance of this permit does not relie~ethe permittse from taking all
proper steps to tnmlre the integrity of the s~ructttre permitted herein and the safety of boats moored thereto fram damage by
wave wash and the permittee shall not hold the United States liable for any such damag~
~ That when the work authorized herein includes periodic maintenance dredging, it may he performed under t~iz permit
b. That the permittee will advise the DIZ~rics Engineer in w~iting at least two weeks before he intends to undertake any
maintenance dredging.
DISCHARGES OF DREDGED OR FILL MATERIAL iNTO WATERS OF THE UNITED STATES:
a. That the discharge will be carried out in cenformity with the goals and objestives of the EPA Gnidelinse established par'
suant to Section 404th) of the Clean Water AcS and published in 40 CFR 230:
