WITNESSETH, that the party of the first part, in consideration of Ten dollars and other good
and valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever a one-third interest as tenant-in-common
ALL those certain plots, piece or parcels of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, bounded and described as follows:
FIRST TRACT: BEGINNING at a point in the Easterly side of East Shore Road, between the
Mansion House and the Durfey Grass Meadow, said road being taken as forty (40') feet from the
Southernmost gate post, now or formerly standing, and running thence along the Easterly line of said
road, South thirty-six and one-half(36 ``/2°) degrees East four hundred seventeen and one-half(417'/')
feet; thence North fifty-three and one-half (53'/2°) degrees East four hundred seventeen and one-half
(4171/') feet; thence North thirty-six and one-half(36%°) degrees West four hundred seventeen and one-
half(417%2') feet and thence South fifty-three and one-half(53%2°) degrees West four hundred seventeen
and one-half(417'/2') feet to the point or place of beginning, containing four (4) acres of land, more or
less.
SECOND TRACT: COMMENCING at its Southeast comer at a mere stone situated in the
Southwest corner of a lot of land now or formerly of Charlotte Augusta Allen, and on the Northerly side
of a street or highway leading to the South Shore, and also to Eastern Point, thence at right angles to the
North Line of the Street, by and along the Westerly side and contiguous to the lot of the said Charlotte
Augusta Allen, and by course of compass North fifty-three and one-half (53'/2°) degrees East four
hundred seventeen (41T) feet, five (5) inches to a mere stone marking the Northwest corner of said
Charlotte Augusta Allen's lot; thence at right angles to the line described,and by course of compass North
thirty-six and one-half(36'/,°)degrees West by and along the Southerly side of a contemplated street, two
hundred ten (210')feet to a stake; thence at right angles to said line and by course of compass South fifty-
three and one-half(53'/2°) degrees West and parallel to the opposite line above described four hundred ten
(410') feet to the Northerly line of said road to Eastern point, thence Easterly by and along the line of said
street two hundred ten (210') feet to a mere stone, being the point of beginning, containing two (2) acres
of land.

EXCEPTING THE, all that certain piece or parcel of land located on Fishers Island,
'County of Suffolk,and State of New York, and in the Northeast corner of the property now or formerly of
John McHugh, being part of land formerly owned and called the "Robertson" place, bounded and
described, as follows:
On the east by the town road or highway, then North by lands owned now or formerly by "Our
Lady of Grace R.C. Church", beginning at the Northeast corner at a mere stone in the town road line and
following West one hundred (100') feet along the said Church property to a stone; thence from this stone
in a Southerly direction one hundred fifty(I50') feet to another stone;then East one-hundred(100') feet to
the road and a mere stone one hundred fifty(150')feet from the starting point.
This makes the lot rectangular in shape; i.e., one hundred fifty (150') feet long on the road and
one hundred(100')feet wide and containing fifteen thousand(15,000)square feet.
TOGETHER,with all right, title and interest of the party of the first part in and to the land lying
in the bed of any street, road,or avenue,open or proposed,adjoining the above described property.
THIRD TRACT: BEGINNING at a monument at an angle in the Westerly line of Montauk
Avenue, said monument being located 1621.96 feet North of a point which is 654.13 feet West of another
monument marking the United States Coast and Geodetic Survey Triangulation Station "PROS", and
thence running along said Avenue line South 01 degree 26 minutes 20 seconds West 152.30 feet to a
monument; thence along the Southwesterly line of said Avenue South 19 degrees 22 minutes 20 seconds
East 40.02 feet to a monument; thence South 44 degrees 14 minutes 30 seconds West 136.41 feet to a
a monument; thence North 45 degrees 44 minutes 40 seconds West 227.74 feet;thence North 53 degrees 43
minutes 40 seconds East 280.21 feet to the Southwesterly line of said Avenue; thence along said Avenue
line South 31 degrees 46 minutes 20 seconds East 43.57 feet to the point of BEGINNING. Containing
1.06 acres more or less.
SUBJECT, HOWEVER, to any and all right, title and interest the Town of Southold may have
acquired over the Easterly portion of the above described premises by reason of sidewalk or road
encroachment,
FOURTH TRACT: BEGINNING at a stone monument at the intersection of the northwesterly
line of The Gloaming and the northeasterly line of Oriental Avenue, said monument being 903.74 feet
North of a point which is 890.53 feet West of another monument marking the United States Coast and
Geodetic Survey Triangulation Station "PROS" and thence running North 46 degrees 10 minutes 40
seconds West 192.42 feet to another monument,abutting southwesterly on Oriental Avenue; thence North
44 degrees 14 minutes 30 seconds East 414.95 feet to another monument, abutting northwesterly on land
now or formerly of John McHugh; thence continuing North 44 degrees 14 minutes 30 seconds East
136.41 feet to another monument, abutting Northwesterly on land now or formerly belonging to Fishers
Island Farms, Inc.; thence South 19 degrees 22 minutes 20 seconds East 244.92 feet to a point; thence
South 6 degrees l I minutes 10 seconds East 184.97 feet to another monument, these last two lines
abutting Northeasterly on Montauk Avenue; thence South 71 degrees 54 minutes 50 seconds West 365.05
feet to the point of beginning, this last line abutting Southeasterly on The Gloaming, containing 3.11
acres, more or less.
SUBJECT HOWEVER to a 10 foot wide.right of way for a water line, the center line of which
right of way is specifically described as follows:
BEGINNING at a point on the Nortlicasterly line of Oriental Avenue, said point being 979.91
feet North of a point which is 969.90 feet West of said "PROS"; thence running North 45 degrees 12
minutes 00 seconds East about 504 feet.

SUBJECT HOWEVER to the following covenants and restrictions which shall run with the land:
I. The above described premises and any buildings erected or to be erected thereon, shall be used
for residential purposes only, and shall not be used for any commercial use or purpose
whatsoever, except however, the premises or any part thereof may be rented for residential
purposes only.
2. The buildings to be erected on the above described premises shall be limited to two (2) one-
family dwelling houses and accompanying garages.
SAID premises are commonly known as No Number Oriental Avenue, Southold, New York
06390, and by the tax map designation of Section 0100, Block 0800, Lots 12, 14 and 15.
THIS deed is a correction deed intended to correct the deed made to Frances Kernan, Jr. on June
6,2000 and recorded on July 7, 2000 in Liber 12053, Page 871 in the office of the Suffolk
County Clerk, which deed should have been dated as of June 12, 2000, the date the party of the
first part took title to an undivided one-third tenant-in-common interest to the premises. Frances
Kernan, Jr. died on February 13, 2015.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof and all strips
and gores of land adjacent thereto;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.

AND the party of the first part, in compliance with Section 13 of the lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.
